Building must be completed as per approved plans. Any deviation from
the approved plans will result in revised plans being required. Based
on a recent inspection, the following issues need to be submitted or
addressed prior to Planning Department approval/sign off:
• Landscaping must be installed per approved plan dated 5/3/97.
Specifically, the following are missing from Burdick #3:
• Plantings in front boxes. -
• Sod the site including the berm in the rear all disturbed areas and 6
feet beyond the north driveway as indicated on the plans.
• Fence is missing on berm in rear yard.
• 27 Trees on berm as per plan and only 22 planted in field. Will
need to piant trees as shown on approved plans or submit revised
landscape plan that meets City Code.
• North side of trash enclosure is missing on tree and all of the
required shrubs.
• Shrubs and one tree around electrical box are missing.
• Landscaping on Burdick #2 (in rear only) need to be completed. Sod
and trees are not in place. Fence is missing. Berm is too high, does
not match approved plan.
• Area along south side of Burdick #3 needs to be finished with sidewalk
as shown on plans.
• Parking lot needs to be striped.

1. Provide parking lot striping and signing per approved plans.
2. Pave entire site per approved plans. -
3. Clean out a�l storm sewer structures and lines. Remove all silt, debris, etc.
4. Provide a mylar "As-built" survey of the entire site which includes, but is not limited
to, actual elevations of all new utilities, ties to all vatves, length of all pipes, size and
type of all utilities, actual site elevations, etc.
5. Establish turf on entire site per the approved plans. This includes properry to the
north.
6. Provide copy of passing bacteria test for all watermain improvements.
7. Grout aII storm sewer structures per detail on sheet C 1.
8. Grade and construct berm along west property line of Bld. #3 to match sheet C1
dated 6/12/97. Center berm between retaining wall and rear lot Iine. Provide actual
field survey of benrn and calt the Engineering department prior to placing topsoil and
turf establishment.
9. Grade and construct berm along west property line of Bld. #2. Grade slopes to

approved the site plan for Burdick Building #3 contingent upon the following changes

4. A lighting plan indicating the illumination of all exterior lighting must be
submitted. A level of one or less foot candles at the pxoperty line is acceptable.

� 5. The size and species of the one tree existing on the lot must be provided. If the
'" tree doesn't survive construction, the replacement will be easier to determine.
The Landscaping Ordinance requires a Letter of Credit (LOC) for landscaping.

The Engineering Department has reviewed the plans for the subject project and have the
following comments:
1. Show existing contours 200 feet beyond the property line.
2. Provide a detail plan and specification for the retaining wall.
3. Plans must include details of all storm sewer, structures and connections.
4. Provide plan and profile of all water, sanitary sewer and storm sewer.
5. Show profile view of storm sewer connection.
6. Submit storm water runoff calculations.
7. Submit an erosion control plan.
8. On the utility plan, show all existing utility lines adjacent to the property.
9. Show bituminous construction limits and locations of pavement sawcuts.
10. Show all existing and proposed easements.
11. All sheets must be signed by a registered professional engineer.
12. Plans are to include details of curb, concrete apron, pavement section, etc. per
city standazds.
13. The handicap access ramp at the northeasterly comer of building must not be
located in the driveway.
14. Construction of the driveway offsite to the north of the building must be
justified.
15. Storm drain tie-ins to existing 21" storm sewer pipe at the south property line
must be made in a manhole structure.

SCOPE: This review is limited to the design of this particular project only insofar as the provisions of the
"9inna�ota Pl;.�rbi^g �ode, as amende�+, apply, and d�es no# cove► the water supply or sewerage system to
which this plumbing system is connected. The review is based upon the supposition that the data on which
the design is based are correct, and that necessary legat authority has been obtained to construct the project.
The responsibility for the design of structural features and the efficiency of equipment must be taken by the
project designer. Approval is contingent upon satisfactory disposition of any requirements included in this
report. Special care should be taken to insure that the material and installation of the plumbing system are in
accordance with the provisions of the Minnesota Plumbing Code. A copy of the approved plans and
specifications should be retained at the project location for future reference.
A set of the identified plans and specifications is being returned to Mr. Charles Novak. Enclosed is a copy of
the report to be fonnrarded to the project owner.
INSPECTIONS: All plumbing installations must be tested and inspected in accordance with the requirements
of the Minnesota Plumbing Code. As specified in Minnesota Rules, part 4715.2830, no plumbing work may be
covered prior to completing the required tests and inspections. Provisions must be made for applying an air �
test at the time of the roughing-in inspection as outlined in Minnesota Rules, part 4715.2820, subpart 2, of the
code. A manometer test, as specified in Minnesota Rules, part 4715.2820, subpart 3, is required at the time of
the finished plumbing inspection. It is the responsibility of the contractor/installer to notify the State Health
Department when the installation will be ready for a test and inspection. To scheduie inspections, co�tact the
state plumbing standards representative for your region, or call the metro office at 1-800-926-6216, or Gary
Topp at 612/215-0841.
REQUIREMENT(S):
1. All ptumbing shall be installed in accordance with the Minnesota Plumbing Codie (see Minnesota Ruies,
part 4715.0320).
2. The minimum size for underground waste pipe shall be 2 inches in diameter (see Minnesota Rules,
part 4715.2350). Some of the sizes of the underground waste pipes are not labeled on the submitted
plans.
3. Water closets must be provided with a 3-inch waste pipe as a minimum (see Minnesota Rules,
part 4715.2300, subpart 3). The sizes of the water closet wastes were not labeled on the submitted
plans.
4. Water closets in public restrooms must have open-front seats.
5. Vent pipes shall be at least 2 inches in diameter through the roof and must terminate not less
than 12 inches above the roof (see Minnesota Rules, part 4715.2530, subpart 1 and subpart 2).
6. All underground sections of building drain and buiiding sewer pipe located within 10 feet of buried water
supply pipe must be constructed in accordance with Minnesota Rules, part 4715.1710, subpart 2.
7. Full-way valves must be provided at all iocations described under Minnesota Rules, part 4715.1800,
including the following locations:
a. At the water service entrance to the building.
b. On the discharge side of the water meter.

8. The combination fire protection/domestic water service shall comply with the backflow protection
requirements of AVWVA-M14, Chapter 6(1990) with the exception that the following statement is deleted
from section 6.3: "At any time where the fire sprinkler piping is not an acceptable potable water system
material, there shall be a backflow-prevention assembiy isolating the fire sprinkler system from the potable
water system."
9. The direct connection befin►een a potable water supply and the lawn irrigation system sha11 be provided
with an approved backflow preventer in accordance with Minnesota Rules, part 4715.2020 and
part 4715.2;10.
10. The installation of reduced pressure zone backflow preventers is permitted onty when periodic testing is
done by a t�ained backflow preventer tester acceptable to the administrative authority. Testing intervals
shall not exceed one year, and records must be kept. All devices must be tested after initial installation to
assure that debris from the piping installation has not interfered with the functioning of the device. The
devices shall be overhauled at least once every five years. The installation of new backflow preventers
must be at least 12 inches, but not more than 6 feet above the finished floor or ground level.
11. Type-L hard-temper copper tubing used for water distribution may not be buried under or embedded in a
concrete slab (see Minnesota Rules, part 4715.0520, F). The copper water distribution piping must meet
ASTM Standard B 88.
12. All solder and flux used for the potable water distribution systems shall contain less than 0.2 percent lead.
Use of 50-50 solder or flux containing more than 0.2 percent lead is prohibited in potable water
� distribution systems. Any solder other than 95-5 tin-antimony or 96-4 tin-silver must be specifically
approved by the administrative authority prior to use (see Minnesota Statutes, Section 326.371).
13. If plastic pipe is used for the drain, waste and vent system: _
a. PVC plastic pipe shall comply with ASTM Standard D 2665, D 2949 or F 891.
b. It must be installed in accordance with Minnesota Rules, part 4715.0580(F) and part 4715.0600.
Above-gsade horizontal runs of plastic waste and vent pipe cannot exceed 35 feet in totat fength.
Above-grade vertical stacks constructed of plastic pipe may exceed 35 feet in total height only if an
approved expansion joint is used.
c. Solvent weld joints in PVC and CPVC pipe must include use of a primer which is of contrasting color
to the pipe and cement (see Minnesota Rules, part 4715.0810, subpart 2).
14. PVC plastic pipe complying with ASTM D 3034 may not be used for interior storm sewer systems, unless
the project owner obtains specific permission from the city and this department. This pipe may not be
used for interior sanitary sewer systems.
15. The plumbing system shall be tested in accordance with Minnesota Rules, part 4715.2820.
16. The water piping system shall be disinfected in accordance with Minnesota Rules, part 4715.225Q.
NOTE(S):
1. The scope of this project consists of the construction of a new building. The plumbing installation
includes four restrooms and four service sinks.
2. This facili#y is sen►ed by municipal water and sewer.
Authorization for construction in accordance with the approved plans may be withdrawn if const�uction is not
undertaken within a period of two years. The fact that the plans have been approved does not necessarily
mean that recommendations or requirements for change will not be made at some later time when changed
conditions, additional information, or advanced knowledge make improvements necessary.

Please fmd enclosed two easement agreements for our office building properties in Prior Lake.
The first easement agreement is for the area between Building No. 2 and the new Building No. 3.
The second easement agreement is between Building No. 3 and Lot No. 2 to the north of building
No. 3.
Paul, our architect, Mr. Charles Novak, has brought to my attention that there may be another
question relating to the access easement agreement and the dumpster enclosure area for the new
building. If the City has further questions, we will address these promptly and assure you that
we (Burdick Properties) will handle this accordingly with the City.
We do not want to "delay" the actual building permit due to a small technicality on an issue such
as this. We hope that you will be able to authorize the building permit at this time and we will
promptly forward any additional information you so desire.
Mr. Mark Lindell from the C.O. Field Company will be completing the application for the �
building permit as they are the general contractor for this project. We (Burdick Properties) will
be paying the actual cost of the building permit fee directly to the City as soon as we know the
amount. In fact, if you currently have this amount, please contact our office so that we may
promptly forward a check to the City.

ACCESS EASEMENT AGREEMENT "
THIS ACCESS EASEMENT AGREEMENT ("Agreement") made this ��� day of April,
1997 by and between B. C. Burdick, hereinafter referred to as Burdick, and T. F. James Company,
formerly iaiown as James Refrigeration Company, an Iowa Corporation, hereinafter refened to as James.
WI1'NESSETH:
WHEREAS, Burdick is the lawful fee owner of certain real estate located in the County of Scott, .
State of Minnesota, legally described as:�`�,�+t�tc l, Jammes lst Addition�hereinafter referred to as the
Burdick Parcel, and
WHEREAS, James is the lawful fee owner of certain real estate located in the Connty of Scott,
State of Minnesota, legally described as Lot 2, Block 1, James 1 st Addition, hereinafter referred to as the
James Parcel, and
WHEREAS, the Burdick Parcel and the James Parcel are adjoining parcels which the parties
hereto hereby agree shall hereafter share a common driveway, hereinafter referred to as the Common -
Driveway, over and across a strip of land being 20 feet in width and located along the common boundary
line separating the Burdick Parcel and the James Parcel, hereinafter referred to as the F.asement Parcel
which is more particulazly described hereinafter, and
WHEREAS, Burdick and James aclrnowledge and agree that said pazties have the lawful
authority, without restriction, to grant to each other an easement upon their respective portions of the
Easement Pazcel and that any other party having an interest (whether recorded or unrecorded) in the
Easement Pazcel has consented and subordinated their interest to the easement granted herein and that said
parties hereby set forth in writing their entire understandings and agreements with respect to the use, �
enjoyment, improvement and maintenance of the Common Driveway upon the Easement Parcel.
NOW TI-IEREFORE, in consideration of the mutual promises and agreements of the parties
hereto, the parties hereby grant to each other, for their benefit and the benefit of their heirs, representatives,
successors and assigns, an access easement for vehicular and pedestrian ingress and egress over and across
the Easement Parcel upon the following terms and conditions:
1. The Easement Parcel is legally described as follows: .
A 20 foot wide strip of land contiguous to the westerly boundary line of Commerce Avenue, and
being 10 feet in width on either side of the following described centerline:
Commencing at the southeasterly comer of Lot 2, Block 1, James 1 st Addition, same being the
point of beginning; thence continuing westerly along the south line of said Lot 2 for a distance of
14I .77 feet and there terminating.
Attached hereto and incorporated herein by this reference is a sketch of the site plan which depicts '
in bold oudine tt►e location and dimensions of the Easement Parcel.
2. The Easement Parcel shall be used as a nonexclusive access for vehicular and pedestrian ingress
and egress to and from the Burdick Parcel and the James Parcel, and may be used by the parties hereto, and
their employees, agents, guests, invitees and licensees for the purposes permitted herein, it may not be used
for pazking, storing, building, or recrearion. Neither party hereto shall create, suffer or permit any ha�ard,
contamination, obstruction, interference, impediment or encroachment to the Common Driveway or the
Easement Parcel.
3. The Easement Pazcel is currently unimproved. Burdick shall improve the Easement Parcel by .
constructing the Common Driveway using a crushed rock base and blacktop wear course. In addition,
Burdick shall install (or replace as the case may be) concrete curb and gutter to match the existing as
required along the entire northerly boundary of the Easement Pazcel and along the new driveway approach
off Commerce Avenue. All such work shall be performed in accordance with municipally approved plans
and specifications at Burdick's sole risk and cost.
4. The parties hereto agree to jointly maintain the Common Driveway, and to shaze equally the work
and cost of any such maintenance. Such maintenance will include repair or replacement of crushed rock,
blacktop and concrete curb and gutter due to normal weaz and tear resulting from use, weathering or �
erosion, and will also include sealing and resurfacing. If any such maintenance becomes necessary, either
party hereto may notify the other thereof, and, within a 10 day period thereafter, the parties shall mutually
agree to the manner of performance of such maintenance, and the payment thereof. Should the parties be
unable to reach agreement, the noticing party shall have the right to cause the necessary maintenance to be
performed, and, thereafter, to bill the other party for one-half of the actual cost thereof. If payment thereof
is not paid within 10 days thereafter, the noticing party may pursue coilection thereof, together with costs
of collection, including, but limited to reasonable attorney's fees and court costs, if the noticing party
prevails in court in proving the necessity of the work and the reasonableness of the cost.
5. The parties hereto agree that any damage caused to the Common Driveway resulting from the use
thereof by construction vehicles and heavy equipment shall be the sole t�esponsibility of the party initiating
the work and said party shall repair or replace the surface materials, as necessary, at the earliest
opportunity, and shall save and hold harmless the other party from any risk or cost associated therewith.
6. The pazties hereto agree to maintain, at all times, insurance against claims for personal injury and
property damage occurring upon the Common Driveway and the Easement Parcel, in an amount sufficient
to cover any liability resulting from the use thereof. .
7. The parties hereto agree that, in order to avoid over-burdening the Common Driveway and the
Easement Parcel, in the event that James shall develop and improve the James Parcel in the future, James
shall install at least one more access to the James Parcel off Commerce Avenue, subject, however, to
municipal approval of the additional access.
8. This Agreement, and the rights, privileges, duties and obligarions hereunder, shall attach to, run
with and inure to the benefit of the Burdick Parcel and the James Parcel, and shall be binding upon the
parties hereto, and their heirs, representatives, successors and assigns. �

the support of the exterior sidewalk and it is my opinion that the sloped block in addition to

Dear Mr. Baumgartner:
I have reviewed the attached revised architectural detail which provides a ledge for
the support of the exterior sidewalk and it is my opinion that the sloped block in addition to
the granular fill will alleviate any concerns for frost heave acting on the ledge.
I have also attached a detail for adding "X" bracing to the North and South walls
which is required due to the replacement of the plywood sheathing with gypboard
sheathing.

This letter is to inform you that a Certificate of Occupancy (temporary or permanent) wiil not be issued for
your building currently under construction at 141 b2 Commerce Avenue untii the following items are
completed:
• Grading approved by Engineering, including berm along adjacent residential area. Please
call Jeff Evens in the Engineering Deparnnent prior to planting/sod/placing of irrigation
system for approval of the grading.
• Building Inspector must approve the building for occupancy.
• The required fence along the adjacent residential properties must be in place as on
approved plan. _
• All landscaping must be in place, including irrigation system.
• The City must receive a Cross Access Agreement for the trash enclosure. A revised site
plan must be submitted including the changes made with respect to the trash enclosure.
The berm and landscaping issues are condirions of the James lst Addirion plat.
In regards to signs, you can add on to the existing ground monuznent signs at Commerce Avenue and
HWY. 13 provided the size does not exceed 120 square feet, has 2 sides or less, is no higher than 10' above
natural grade, and is setback 10 feet from the property line/right-of-way. A sepazate permit will be
required. I have included a sign permit application and a buiiding pemut applicarion. The issuing of a sign
pemut is conringent upon the removal of any non-confoiming sigis on the site. There currently exist non-
confoiming signs on the back of the building, facing HWY. 13 coming north. Signage is only allowed on
walls that fronts a street. Please call me if you have any quesrions.

The following items are required by the Engineering department per the approved set of
plans:
1. Provide parking lot striping and signing per approved plans.
2. Pave entire site per approved plans.
3. Clean out a11 storm sewer structures and lines. Remove all silt, debris, etc.
4. Provide a mylar "As-built" survey of the entire site which includes, but is not limited
to, actual elevations of all new utilities, ties to a11 valves, length of all pipes, size and
type of all utilities, actual site elevations, etc.
5. Establish turf on entire site per the approved plans. This includes properry to the
north.
6. Provide copy of passing bacteria test for all watermain improvements. ,
7. Grout a11 storm sewer structures per detail on sheet C 1.
8. Grade and construct berm along west property line of Bld. #3 to match sheet C 1
dated 6/12/97. Center berm between retaining wall and rear lot line. Provide actual
field survey of berm and ca11 the Engineering department prior to placing topsoil and
turf establishment.
9. Grade and construct berm along west property line of Bld. #2. Grade slopes to
maximum 4:1.
10. Install 18" retaining wall in the rear of Bld. #2  per plan sheet C1.
11. Install fence along rear lot line per plan sheet C 1.

Buiiding must be completed as per approved plans. Any deviation from
the approved plans wilf resuit in revised plans being required. Based
on a recent inspection, the following issues need to be submitted or
addressed prior to Planning Department approval/sign off:
• Landscaping must be installed per approved plan dated 5/3/97.
Specifically, the following are missing from Burdick #3:
• Plantings in front boxes.
• Sod the site incfuding the berm in the rear af1 disturbed areas and 6
feet beyond the north driveway as indicated on the plans.
• Fence is missing on berm in rear yard.
• 27 Trees on berm as per plan and only 22 planted in field. Will
need to plant trees as shown on approved plans or submit revised
landscape plan that meets City Code.
• North side of trash enclosure is missing on tree and all of the
required shrubs.
• Shrubs and one tree around electrical box are missing.
• Landscaping on Burdick #2 (in rear only) need to be completed. Sod
and trees are not in place. Fence is missing. Berm is too high, does
not match approved plan.
• Area along south side of Burdick #3 needs to be finished with sidewalk
as shown on plans.
• Parking lot needs to be striped.
• Address needs to be on building.
• Sign permits are required for all signs whether temporary or
permanent.

Thank you for your letter of May 14, 1999, regarding our Letter of Credit (LOC) pertaining to the above
referenced property.
As of today, I have not had an opportwuty to review the 14 dead pine trees as referenced in your letter.
However, we will assume your count of the dead trees is accurate and fair.
As you ha.ve requested, we will be replanting the dead trees as soon as reasonably possible. Please find
enclosed a copy of the contracbproposal to plant these trees. We will complete the contract promptly.
I am also including a new LOC at 125% of the cost to replant these trees in the amount of $4,698.75. Please
retum our current LOC that expires on June 25, 1999 no later than June 4, 1999.
For the record, we have no intention of removing the current LOC until we ha.ve the reduced LOC as you
have requested.

` When the psesenter is a permitted Transferee under paragraph 3 above, the documents required for a draw shall include:
A. All documents required elsewhere in this Letter of Credit, except that such documents may be in the name of either the original

B. When the presenter is a permitted Transferee under paragraph 3.A or a third party under 3.6, a certified copy of the one or more
documents which show the presenter's authority to claim through or to act with authotity for the original Beneficiary.
5. TIMING OF DISHONOR __ _ _ . _
Under no circumstances shalf Lender. be precluded from relying upon any reason for dishonor given in a communication which
Beneficiary or the pteserner receives within th�ee (3) banking days after Lender has received the last document forming part of
Beneficiar�s presentment (the 'Three-Day Period"). Lender shall be entitled to rely upon any such reason without regard to either (i) the
timing of any presentment made before the Expiration Date, or (ii) the timing inside the Three-Day Period of any preliminary
; communication(s) from Lender concerning the dishonor decision itself or any reason for dishonor. For any such reason so given during
the Three-Day Period, Lender shall be concfusively deemed to have met the "reasonable time", 'without delay", and other timing
� requirements as the llCP (as hereafter defined) and U.C.C. may impose. The Expiration Date shall not be extended to accommodate a
presentment made with {ess than three (3) banking days to go before the Expiration Date, and Beneficiary shall not be entitled to submit
' a draw request or provide Lender with any documerrts in support of a draw after the Expiration Date hereof. Nor shall lender ever be
required to communicate a dishonor decision or its reasons within a time less than the Three-Day Period.
� 6. COMPLIANCE BURDEN
Under no circumstances shall Lender be held responsible for any impossibility or other difficulty in achieving strict compliance with the
requirements of this Letter of Credit precisely as written. Beneficiary understands and acknowledges: (i) that unless and until the present
. wording of this Letter of Credit is amended with Lender's prior written consent, the burden of complying strictly with such wording
'.' remains solely upon Beneficiary; and (ii) that Lender is, relying upon the lack of such amendment as constituting Beneficiary's initial and
� continued approval of such wording.
� : 7. NON-SEVERABILITY
. If any aspect of this Letter of Credit is ever declared unenforceable for any reason by any court or governmental body having jurisdiction,
� Lender's entire engagement under this Letter of Credit shall be deemed nu11 and void ab initio, and both Lender and Beneficiary shall be
restored to the position each would have occupied with al{ rights available as though this Letter of Credit had never occurred. This
non-severability provision shall ove�ride all other provisions in this Letter of Credit, no matter where such provision appears within the
