The review is based upon the supposition that the data on which the design is based are correct, and that necessary legat authority has been obtained to construct the project. The responsibility for the design of structural features and the efficiency of equipment must be taken by the project designer. Approval is contingent upon satisfactory disposition of any requirements included in this report. Special care should be taken to insure that the material and installation of the plumbing system are in accordance with the provisions of the Minnesota Plumbing Code. A copy of the approved plans and specifications should be retained at the project location for future reference. A set of the identified plans and specifications is being returned to Mr. Charles Novak. Enclosed is a copy of the report to be fonnrarded to the project owner. INSPECTIONS: All plumbing installations must be tested and inspected in accordance with the requirements of the Minnesota Plumbing Code. As specified in Minnesota Rules, part 4715.2830, no plumbing work may be covered prior to completing the required tests and inspections. Provisions must be made for applying an air � test at the time of the roughing-in inspection as outlined in Minnesota Rules, part 4715.2820, subpart 2, of the code. A manometer test, as specified in Minnesota Rules, part 4715.2820, subpart 3, is required at the time of the finished plumbing inspection. It is the responsibility of the contractor/installer to notify the State Health Department when the installation will be ready for a test and inspection. All ptumbing shall be installed in accordance with the Minnesota Plumbing Codie (see Minnesota Ruies, part 4715.0320). 2. The minimum size for underground waste pipe shall be 2 inches in diameter (see Minnesota Rules, part 4715.2350). Some of the sizes of the underground waste pipes are not labeled on the submitted plans. 3. Water closets must be provided with a 3-inch waste pipe as a minimum (see Minnesota Rules, part 4715.2300, subpart 3). The sizes of the water closet wastes were not labeled on the submitted plans. 4. Water closets in public restrooms must have open-front seats. 5. Vent pipes shall be at least 2 inches in diameter through the roof and must terminate not less than 12 inches above the roof (see Minnesota Rules, part 4715.2530, subpart 1 and subpart 2). 6. All underground sections of building drain and buiiding sewer pipe located within 10 feet of buried water supply pipe must be constructed in accordance with Minnesota Rules, part 4715.1710, subpart 2. 7. Full-way valves must be provided at all iocations described under Minnesota Rules, part 4715.1800, including the following locations: a. At the water service entrance to the building. b. The combination fire protection/domestic water service shall comply with the backflow protection requirements of AVWVA-M14, Chapter 6(1990) with the exception that the following statement is deleted from section 6.3: "At any time where the fire sprinkler piping is not an acceptable potable water system material, there shall be a backflow-prevention assembiy isolating the fire sprinkler system from the potable water system." 9. The direct connection befin►een a potable water supply and the lawn irrigation system sha11 be provided with an approved backflow preventer in accordance with Minnesota Rules, part 4715.2020 and part 4715.2;10. 10. The installation of reduced pressure zone backflow preventers is permitted onty when periodic testing is done by a t�ained backflow preventer tester acceptable to the administrative authority. Testing intervals shall not exceed one year, and records must be kept. All devices must be tested after initial installation to assure that debris from the piping installation has not interfered with the functioning of the device. The devices shall be overhauled at least once every five years. The installation of new backflow preventers must be at least 12 inches, but not more than 6 feet above the finished floor or ground level. 11. Type-L hard-temper copper tubing used for water distribution may not be buried under or embedded in a concrete slab (see Minnesota Rules, part 4715.0520, F). The copper water distribution piping must meet ASTM Standard B 88. 12. All solder and flux used for the potable water distribution systems shall contain less than 0.2 percent lead. Use of 50-50 solder or flux containing more than 0.2 percent lead is prohibited in potable water � distribution systems. Any solder other than 95-5 tin-antimony or 96-4 tin-silver must be specifically approved by the administrative authority prior to use (see Minnesota Statutes, Section 326.371). 13. If plastic pipe is used for the drain, waste and vent system: _ a. PVC plastic pipe shall comply with ASTM Standard D 2665, D 2949 or F 891. b. It must be installed in accordance with Minnesota Rules, part 4715.0580(F) and part 4715.0600. Above-gsade horizontal runs of plastic waste and vent pipe cannot exceed 35 feet in totat fength. Above-grade vertical stacks constructed of plastic pipe may exceed 35 feet in total height only if an approved expansion joint is used. c. Solvent weld joints in PVC and CPVC pipe must include use of a primer which is of contrasting color to the pipe and cement (see Minnesota Rules, part 4715.0810, subpart 2). 14. PVC plastic pipe complying with ASTM D 3034 may not be used for interior storm sewer systems, unless the project owner obtains specific permission from the city and this department. This pipe may not be used for interior sanitary sewer systems. 15. The plumbing system shall be tested in accordance with Minnesota Rules, part 4715.2820. 16. The water piping system shall be disinfected in accordance with Minnesota Rules, part 4715.225Q. NOTE(S): 1. The scope of this project consists of the construction of a new building. The plumbing installation includes four restrooms and four service sinks. 2. This facili#y is sen►ed by municipal water and sewer. Authorization for construction in accordance with the approved plans may be withdrawn if const�uction is not undertaken within a period of two years. NOW TI-IEREFORE, in consideration of the mutual promises and agreements of the parties hereto, the parties hereby grant to each other, for their benefit and the benefit of their heirs, representatives, successors and assigns, an access easement for vehicular and pedestrian ingress and egress over and across the Easement Parcel upon the following terms and conditions: 1. The Easement Parcel is legally described as follows: . A 20 foot wide strip of land contiguous to the westerly boundary line of Commerce Avenue, and being 10 feet in width on either side of the following described centerline: Commencing at the southeasterly comer of Lot 2, Block 1, James 1 st Addition, same being the point of beginning; thence continuing westerly along the south line of said Lot 2 for a distance of 14I .77 feet and there terminating. Attached hereto and incorporated herein by this reference is a sketch of the site plan which depicts ' in bold oudine tt►e location and dimensions of the Easement Parcel. 2. The Easement Parcel shall be used as a nonexclusive access for vehicular and pedestrian ingress and egress to and from the Burdick Parcel and the James Parcel, and may be used by the parties hereto, and their employees, agents, guests, invitees and licensees for the purposes permitted herein, it may not be used for pazking, storing, building, or recrearion. Neither party hereto shall create, suffer or permit any ha�ard, contamination, obstruction, interference, impediment or encroachment to the Common Driveway or the Easement Parcel. 3. The Easement Pazcel is currently unimproved. Burdick shall improve the Easement Parcel by . constructing the Common Driveway using a crushed rock base and blacktop wear course. In addition, Burdick shall install (or replace as the case may be) concrete curb and gutter to match the existing as required along the entire northerly boundary of the Easement Pazcel and along the new driveway approach off Commerce Avenue. All such work shall be performed in accordance with municipally approved plans and specifications at Burdick's sole risk and cost. 4. The parties hereto agree to jointly maintain the Common Driveway, and to shaze equally the work and cost of any such maintenance. Such maintenance will include repair or replacement of crushed rock, blacktop and concrete curb and gutter due to normal weaz and tear resulting from use, weathering or � erosion, and will also include sealing and resurfacing. If any such maintenance becomes necessary, either party hereto may notify the other thereof, and, within a 10 day period thereafter, the parties shall mutually agree to the manner of performance of such maintenance, and the payment thereof. Should the parties be unable to reach agreement, the noticing party shall have the right to cause the necessary maintenance to be performed, and, thereafter, to bill the other party for one-half of the actual cost thereof. If payment thereof is not paid within 10 days thereafter, the noticing party may pursue coilection thereof, together with costs of collection, including, but limited to reasonable attorney's fees and court costs, if the noticing party prevails in court in proving the necessity of the work and the reasonableness of the cost. 5. The parties hereto agree that any damage caused to the Common Driveway resulting from the use thereof by construction vehicles and heavy equipment shall be the sole t�esponsibility of the party initiating the work and said party shall repair or replace the surface materials, as necessary, at the earliest opportunity, and shall save and hold harmless the other party from any risk or cost associated therewith. 6. The pazties hereto agree to maintain, at all times, insurance against claims for personal injury and property damage occurring upon the Common Driveway and the Easement Parcel, in an amount sufficient to cover any liability resulting from the use thereof. . 7. The parties hereto agree that, in order to avoid over-burdening the Common Driveway and the Easement Parcel, in the event that James shall develop and improve the James Parcel in the future, James shall install at least one more access to the James Parcel off Commerce Avenue, subject, however, to municipal approval of the additional access. 8. Sands and Mr. Burdick, This letter is to inform you that a Certificate of Occupancy (temporary or permanent) wiil not be issued for your building currently under construction at 141 b2 Commerce Avenue untii the following items are completed: • Grading approved by Engineering, including berm along adjacent residential area. Please call Jeff Evens in the Engineering Deparnnent prior to planting/sod/placing of irrigation system for approval of the grading. • Building Inspector must approve the building for occupancy. • The required fence along the adjacent residential properties must be in place as on approved plan. _ • All landscaping must be in place, including irrigation system. • The City must receive a Cross Access Agreement for the trash enclosure. A revised site plan must be submitted including the changes made with respect to the trash enclosure. The berm and landscaping issues are condirions of the James lst Addirion plat. In regards to signs, you can add on to the existing ground monuznent signs at Commerce Avenue and HWY. 13 provided the size does not exceed 120 square feet, has 2 sides or less, is no higher than 10' above natural grade, and is setback 10 feet from the property line/right-of-way. A sepazate permit will be required. I have included a sign permit application and a buiiding pemut applicarion. The issuing of a sign pemut is conringent upon the removal of any non-confoiming sigis on the site.
