HomeMy WebLinkAbout5G JPA with MN BCAe�� PRIOR ti U 4646 Dakota Street SE ` �IN1vESO� P Prior Lake, MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: February 22, 2011 AGENDA #: 5G PREPARED BY: Bill O'Rourke, Chief of Police PRESENTER: Bill O'Rourke AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING AND AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN A NEW MASTER JOINT POWERS AGREEMENT BETWEEN THE MINNESOTA BUREAU OF CRIMINAL APPREHENSION AND THE CITY TO USE SYSTEMS AND TOOLS AVAILABLE OVER THE STATE'S CRIMINAL JUSTICE DATA COMMUNICATIONS NETWORK DISCUSSION: Introduction The purpose of this agenda item is to: (1) seek City Council approval of a Joint Powers Agreement between the State of Minnesota, acting through its Department of Public Safety, Bureau of Criminal Apprehension ( "BCA ") and the City of Prior Lake on behalf of its Police Department ( "Agency "); and (2) to authorize the Mayor and City Manager to execute the Joint Powers Agreement on behalf of the City. History There are as many as eleven (11) service agreements and /or Joint Powers Agreements in place between the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension and the Prior Lake Police Department. It is through the Bureau of Criminal Apprehension that the Department is given access to the Federal Bureau of Investigation (FBI) National Crime Information Center. These various agreements allow the Police Department to access and share information necessary for both entities to perform their public safety functions. The agreements detail the obligations and requirements placed on the Prior Lake Police Department and ensure that the necessary safeguards are in place to assure that the information received is only available to cleared personnel of the Police Department. Current Circumstances The Prior Lake Police Department, along with all the other law enforcement agencies in Scott County, has recently requested additional services from the BCA. Specifically, we will be moving toward e- charging, a service to allow law enforcement, prosecutors and courts to electronically prepare and transmit charging documents with each other. E- charging enables automated routing, temporary retention, filing, and printing on demand for criminal complaints, tab charges, citation, and DWI administrative forms. The Bureau of Criminal Apprehension sees this requested change as a timely opportunity to adopt its new Master Joint Powers Agreement. In addition to consolidating the various existing service agreements, the new Master Joint Powers Agreement makes adding future services easier. Specifically, the Master JPA designates the Chief of Police, or the Chief's successor, as the Agency's Authorized Representative for such purposes. ISSUES: �his joint powers agreement signals a change in the services provided to customers by utilizing the capabilities of the electronics which are now commonplace in public safety. This joint powers agreement is the only way we can get access to such services in a coordinated statewide way. FINANCIAL There are no new fees associated with this Master Joint Powers IMPACT: Agreement. The Department currently pays two - hundred - seventy dollars ($270) quarterly, or an annual cost of one - thousand - eighty dollars ($1,080) to the BCA. These fees are included in the Department's operating budget. ALTERNATIVES: 1. Adopt the Resolution approving the agreement and authorizing the Mayor and City Manager to sign the Master Joint Powers Agreement between the Bureau of Criminal Apprehension and the Prior Lake Police Department. 2. Deny approval and direct further action. RECOMMENDED Alternative #1. MOTION: Reviewed by Frank Boyles,; City Manager jr; ✓ C:ADocuments and Settingslogreen\My Docunnents\SharePoint DraftsWaster JPA.doc 2 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 11 -XX A RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENT WITH THE PRIOR LAKE POLICE DEPARTMENT MOTION BY: SECOND BY: WHEREAS, The City of Prior Lake on behalf of its Prosecuting Attorney and Police Department desires to enter into a Joint Powers Agreement with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State's criminal justice data communications network for which the City is eligible. The Joint Powers Agreement further provides the City with the ability to add, modify and delete connectivity, systems and tools over the five year life of the Agreement and obligates the City to pay the costs for the network connection. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA that: 1. The Joint Powers Agreement by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the City of Prior Lake on behalf of its Prosecuting Attorney and Police Department is approved. 2. The Prior Lake Chief of Police, Bill O'Rourke, or the Chief's successor is designated the Authorized Representative for the Police Department. The Authorized Representative is authorized to execute documents that may be required to maintain the City's connection to the systems and tools offered by the State. Cindy Kline is appointed as the Authorized Representative's designee. 3. The Mayor and City Manager are authorized to execute Joint Powers Agreement on behalf of the City.
