AGENDA ITEM: CONSIDER A REPORT CONCERNING
POTENTIAL AMENDMENTS TO THE ZONING
ORDINANCE
In the past several months, there have been several
discussions about potential amendments to the Zoning
Ordinance. As with any ordinance, changes may be
required because of changing circumstances, the
realization that the Zoning Ordinance does not
adequately address some new conditions, or the need
for equity in the administration of the ordinance.
The purpose of this memorandum is to outline the items
that have been discussed. The staff is requesting the
City Council provide direction on these issues.
The potential amendments include the following:
. An amendment to permit free-standing
parking lots in residential use districts
(Captain Jack's and DNR access);
. An amendment to reduce the setback for a
water-oriented accessory structure on riparian
lots;
. An amendment regarding the treatment of
temporary structures (Le., temporary storage);
. An amendment allowing additional materials
to be considered Class I materials;
. An amendment dealing with the zoning
classification for newly annexed property;

· An amendment to restrict fences along the
lakeside of riparian property;
. An amendment to allow off-premise
advertising signs for regional facilities such as
Mystic Lake;
· An amendment to allow the Planning
Commission final authority on Conditional Use
Permits, with the opportunity to appeal that
decision to the City Council.
ISSUES:
According to Section 1108.501, amendments to the
Zoning Ordinance may be initiated in the following
manner:
. The Planning Commission may initiate an
amendment by motion;
. The City Council may initiate an amendment
by motion to refer the amendment to the
Planning Commission;
. Any individual may initiate an amendment by
petition.
The staff is requesting direction from the City Council on
how to proceed with these items. One suggestion is for
the Council members to determine which, if any, of the
proposed amendments they are interested in pursuing.
Once that decision is made it would be helpful to staff to
discuss each of the proposed amendments during a
workshop. This approach will provide staff with some
perspective on what direction to take during the process
of actually drafting the proposed amendment.
Another suggestion is for the Council to direct staff to
bring all of the amendments to the Planning Commission
for further discussion. This does not trigger the public
hearing process; it does, however, allow the Planning
Commission to discuss the need for any amendment and
the potential language. The staff would then report the
results of these discussions to the Council during the
workshop.

The Council may also choose to take no action. This
does not preclude any individual or group from filing a
formal petition to amend the Zoning Ordinance.
The staff is requesting Council direction on these
matters.
The City Council has three alternatives:
1. Direct staff to bring potential amendments to a City
Council workshop for future discussion.
2. Direct staff to bring the potential amendments to the
Planning Commission for further discussion and report
the results of this discussion to the City Council.
3. Take no action.
Staff recommends Alternative #1. This requires the
following motion:
1. A motion and second to direct staff to schedule a
workshop to discuss the potential amendments to the
Zoning Ordinance for further discussion.
