HomeMy WebLinkAbout98-86RESOLUTION 98-86 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING A VARIANCE TO ALLOW A CUL-DE-SAC GREATER THAN 500 FEET IN LENGTH AND TO ALLOW A HAMMERHEAD DESIGN INSTEAD OF THE STANDARD TEAR DROP DESIGN MOTION BY: KEDROWSKI SECOND BY: WUELLNER WHEREAS: WHEREAS: WHEREAS: WHEREAS: Wensmann Realty, Inc., has applied for a variance to Section 6-6-2 (E) of the Prior Lake City Code, to allow a cul-de-sac, identified as Bay Knolls Drive on the preliminary plat of Glynwater, to exceed 500 feet in length; and Wensmann Realty, Inc., has applied for a variance to Section 6-6-2 (B) of the Prior Lake City Code to allow a cul-de-sac, identified as Bay Knolls Drive on the preliminary plat of Glynwater, to utilize a hammerhead design rather than the standard tear drop design; and the Planning Commission reviewed this variance request at a public hearing on July 13, 1998; and the Prior Lake City Council considered the application for a variance to Section 6-6-2 (E) and 6-6-2 (B) of the Prior Lake City Code on July 20, 1998, and the City Council has reviewed the variance request according to the applicable provisions of the Prior Lake Subdivision Ordinances and found said variance to be consistent with the provisions of said ordinances. NOW, TYIEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it hereby adopts the following Findings of Fact with respect to this request: 1. By reason of exceptional topography or any other physical conditions, strict compliance with these regulations would cause exceptional and undue hardship. The connection to Fremont Avenue would potentially increase the existing traffic problems on this street. The use of a standard cul-de-sac design would also increase the disturbance of the steep slopes on this site. The use of the hammerhead design provides the appropriate access and does not cause additional disturbance to the slopes. 2. Such relief may be granted without detriment to the public welfare and without impairing the intent and purpose of these regulations. ~r:\c~un~l\resqlut~pla n re,~\r~.988~cq.doc.. (612) 447-4230 / Fax (612)~447-4245 AN EQUAL OPPORTUNITY EMPLOYER As noted above, the use of the hammerhead design provides the appropriate access and does not cause additional disturbance to the slopes. e The Planning Commission may recommend variances from the requirements of this chapter in specific cases which, in its opinion, would not affect the intent of the Comprehensive Plan or this Chapter The proposed variance will not affect the intent of the Comprehensive Plan or the Subdivision Ordinance. The proposed hammerhead design provides the appropriate access to the townhouses. In addition, the plans provide a pedestrian connection to Fremont Avenue. BE IT FURTHER RESOLVED, that it hereby approves a variance to allow the cul-de-sac, identified as Bay Knolls Drive on the preliminary plat of Glynwater, to have a length approximately 620' and to utilized the hammerhead design as shown on Exhibit A, subject to the following conditions: 1. An easement for the turnaround must be recorded with the final plat. 2. Designate the hammerhead and the area within 25' on both sides of the hammerhead, and the east end of Bay Knolls Drive as a "No Parking" area.
