HomeMy WebLinkAbout05 09 2011 PC Meeting MinutesPlanning Commission Meeting Minutes May 9, 2011 PLANNING COMMISSION MINUTES MONDAY, MAY 9, 2011 Call to Order: Chairman Fleming called the May 9, 2011, Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Fleming, Roszak, Perez, Billington, and Howley, Community Development & Natural Resources Director Danette Parr, Planner Jeff Matzke, Assistant City Engineer Larry Poppler and Development Services Assistant Joe Sortland. 2. Approval of Agenda: MOTION BY BILLINGTON, SECONDED BY HOWLEY TO APPROVE THE MAY 9, 2011 MEETING AGENDA AS PRESENTED. VOTE: Ayes by Fleming, Howley, Billington, Perez and Roszak. The motion carried. 3. Consider Approval of April 25, 2011 Meeting Minutes: MOTION BY HOWLEY, SECONDED BY BILLINGTON TO APPROVE THE APRIL 25, 2011 MEETING MINUTES AS PRESENTED. VOTE: Ayes by Fleming, Howley, Billington, Perez and Roszak. The motion carried. 4. Public Hearings A. #EP 11 -111. Ryland Homes submitted an application for a preliminary plat to be known as The Pointe in the Jeffers Pond subdivision. The preliminary plat consists of approximately 13.58 acres to be subdivided into 38 single detached family lots. The site is located east of Wild Ridge and west of Eagle Creek Ave NE. Planner Matzke presented the request for a preliminary plat to be known as The Pointe in the Jeffers Pond 4 th Addition. Jeffers Pond was originally approved in 2005. 693 residential units were originally approved for the overall Jeffers Pond development. Jeffers Pond was originally approved as a Planned Unit Development (PUD). The applicant is requesting a PUD Amendment to change the originally approved 56 attached townhome lots to 38 detached single family home lots. The Pointe would be completed in two phases, the first consisting of the lots adjacent to the already constructed road within The Pointe. The street was originally planned as a private street, but the developer is requesting that the lone road within The Pointe be added to the City of Prior Lake street system as a public street. Home sizes are expected to be 2,100 to 3,300 square foot homes, ranging from $289,000 to $349,000 in price. Impervious surface will be reduced from 38% to 24% for The Pointe, and 35.5% to 24.5 for the overall Jeffers Pond development. The developer anticipates beginning phase one in late 2011 and phase two in 2012 or 2013. Minimum building standards will be required to ensure the approved development will not be altered if the developer changes. Questions from the Commissioners: Howley asked if the rain garden will be maintained by the City. Matzke answered that the rain garden will be an outlot that will be dedicated to the City. Because it is draining from a public street the City has preferred maintain rain gardens in the past. Howley asked who would be responsible for the maintenance of the rain garden. A MOTION WAS MADE BY BILLINGTON AND SECONDED BY HOWLEY TO OPEN THE PUBLIC HEARING. VOTE: Ayes by Fleming, Billington, Perez, Roszak and Howley. The motion carried. The Public Hearing began at 6:16 p.m. Comments from the Public: Michael Ramme, 7599 Anagram Drive, Eden Prairie, presented himself and members of Ryland Homes. The Pointe will be the second development within Prior Lake for Ryland Homes, the first development being Stonebriar. The first phase will consist of 18 homes. There could potentially be a model home constructed by September, 2011. The second phase will start the spring of 2012 with a build out by 2013. The lots will be 70 to 75 feet wide. Ryland Homes approves the engineer memorandum attached with the Planning Commission report. Ramme said the Home Owners Association (HOA) would be acceptable with maintaining the plantings within the rain garden. Billington asked if elevations of the proposed homes could be presented. Ramme presented side elevations of the proposed homes. Billington asked if the presented elevations would be the primary designs. Ramme answered that the presented elevations would be the primary designs. Billington asked if the maximum floor plan would be 3,300 square feet. Ramme confirmed that 3,300 square feet is the expected maximum size. Billington asked if all designs would be two levels. Ramme answered that Ryland Homes is in the process of developing a rambler style elevation. Billington asked what the proposed square footage would be for the rambler. Ramme answered that they expected the rambler to be 1,900 square feet. Fleming asked if minimum design standards for the homes would be included in the HOA covenants. Ramme answered that any design standards would be included in the covenants and would be made clear to future homeowners. Design standards would include plantings, square footages and maintenance. Fleming asked about the aesthetically pleasing architecture and what measures would be taken to ensure the architectural style would be guaranteed. Mark Sonstegard, 7599 Anagram Drive, Eden Prairie, Land Developer for Ryland homes, answered that he would be involved with writing the HOA documents, which would include minimum building material standards such as: brick and stone, along with other design standards presented in the L: \11 FILES \11 PLANNING COMMISSION\11 MINUTES\MN050911.doc 2 Planning Commission Meeting Minutes May 9, 2011 proposed home elevations. Three car garages would have windows and panels and landscaping of the lots would also be required. The square footage requirements would also be included within the HOA documents. Fleming asked if the proposed design standards in the covenants would allow homeowners a variety of housing designs. Sonstegard answered that there are three different elevations for each of the five proposed homes and that the rambler would bring it to six home designs. Billington asked what Ryland Homes saw in The Pointe at Jeffers pond. Ramme answered that Ryland Homes studied the community, market and location when making their decision for The Pointe. They thought the community, access and amenities made it an appealing site. Tom Paske, 3574 Wilds Ridge NW, asked if the homes proposed were going to be in the Jeffers Pond HOA. The original proposed homes had a minimum home price of $500,000. He said the Jeffers Pond HOA has only one meeting a year, which has not been held in 2011, and they have not had an opportunity to discuss The Pointe. Billington said it would be appropriate for the Jeffers Pond HOA to meet with the representatives from Ryland Homes to discuss their concerns. Paske thought that Ryland Homes is proposing smaller homes and smaller lots than what was originally proposed. He asked about the right of way that had been platted. Perez answered that Pointe Pass NW appears to dead end because The Pointe road has not been platted for the second phase. Fleming asked if the current market value for the home Paske purchased in The Ridge remains valued at $500,000. Paske answered his home likely is not. Fleming said that the Planning Commission has to be fluid and responsive to changes in the market conditions. Fleming noted that the project should not be hamstringed because the HOA has not met with the developers. Paske asked about the differences between the originally proposed The Pointe home sizes and what is now being proposed. Fleming recommended the Jeffers Pond meet with the developer prior to City Council meeting. Matzke added that The Pointe proposal will go before the City Council on June 6 th Paske asked who their contact with the City would be. Matzke answered that Paske could contact himself for the Community Development Department and that there would not be a public hearing at the City Council meeting. He added that the Planning Commission meeting is the opportunity for public input. Matzke said that the final plat for The Pointe would also be going before the Planning Commission and the City Council, which would take place in approximately a month and a half. L: \11 FILES \11 PLANNING COMMISSION\11 MINUTES\MN050911.doc 3 Planning Commission Meeting Minutes May 9, 2011 Matzke said that because The Pointe was originally planned as townhomes, which would have different covenants and square footage requirements than The Ridge, it likely was never part of the same covenants or HOA as The Ridge. Paske said that The Ridge has larger lot frontage and asked if the City is making an exception for The Pointe. Matzke answered that the density for The Pointe is decreasing from 56 attached townhomes to 48 detached single family homes. Matzke added that The Pointe homes would have wider lot widths than what was originally approved for The Pointe. Paske asked if The Pointe lot designs would have to be the same as what was approved for The Ridge. Matzke answered that because The Pointe is a separate phase of Jeffers Pond, it does not have to have the same lot width as The Ridge. Paske asked about the impervious surface coverage for The Pointe. Matzke answered that the proposed impervious surface coverage is less than what was originally approved for The Pointe. Fleming added that the proposed detached single family homes for The Pointe could be considered more appealing for residential sales within Jeffers Pond. A MOTION WAS MADE BY PEREZ AND SECONDED BY BILLINGTON TO CLOSE THE PUBLIC HEARING. VOTE: Ayes by Fleming, Perez, Billington, Roszak and Howley. The motion carried. The public hearing closed at 6:48 p.m. Commissioner Comments and Questions: Howley asked if The Pointe had the only townhomes approved for Jeffers pond. Matzke answered that Jeffers Waterfront, which will have two story townhomes containing four to six units, anticipates construction this summer. There are also a couple other areas within Jeffers Pond which offer housing alternatives other than detached residential homes. Howley stated his support for The Pointe, and that it should not have to meet any covenants approved for The Ridge. Billington said that the previously approved townhomes for The Pointe have been found to not be viable with the current market conditions and that the project will serve the City well. Billington stated his support for the project. Perez said that the improvements in density and the impervious surface percentage will be a benefit to the City. Perez acknowledged that market conditions can change and that the new developer for the project has been helpful. Poppler answered that existing conditions of the street are adequate. Perez asked if there should be a bond for the street. Poppler answered that due to the City taking ownership of the street, there would be an added cost for sealcoating or cracking. Perez asked if staff had any recommendation for addressing the street maintenance. Matzke answered that they can recommend a condition of approval which would be addressed when the City Council hears the request. Perez stated his support for the project. Roszak believes that the rain garden and the transition from townhome to detached are favorable. Roszak stated his support for the project. Fleming asked about the condition of the street. Poppler answered that the condition of the street is decent and that any additional work or funds for future repairs would be addressed at the developer contract phase of the project. Fleming stated that it is important for the street be in an acceptable condition to ensure the sale of future homes in The Pointe. Fleming asked how many homes have been completed within Jeffers Pond. Matzke said 119 single family homes and 101 townhomes were planned for. 50% of the platted homes have been completed within Jeffers Pond. Fleming encouraged Ryland Homes to meet with the adjacent neighborhood within Jeffers Pond. A MOTION WAS MADE BY BILLINGTON SECONDED BY ROSZAK TO APPROVE THE PRELIMINARY PLAT KNOWN AS THE POINTE. Perez requested to add a 4 th condition stating that "street maintenance dollars as recommended by the engineering department'. VOTE: Ayes by Fleming, Perez, Billington, Roszak and Howley. Announcements and Correspondence: L: \11 FILES \11 PLANNING COMMISSION\11 MINUTES\MN050911.doc 5 Planning Commission Meeting Minutes May 9, 2011 A. 2030 Vision and Strategic Plan Update Meeting will be held on Saturday, May 21, 2011 from 8 a.m. to 4 p.m. at Club Prior. Parr said that on Saturday, May 21, the City will be holding a meeting on the 2030 Vision and Strategic Plan from 8:00 AM - 4:30 PM in Club Prior. On May 31, in the City Hall Chamber, there will be a Town Hall meeting regarding to the County Road 21 project. Consultants from the three different firms will present their findings and proposed plans, followed by public input. Matzke said the May 9 th will be Danette Parr's last Planning Commission meeting before she begins employment at the City of Cottage Grove. Fleming thanks Parr for her diligence and her hard work. He wished her well on behalf of the Planning Commission. Billington thanked Parr for everything that she has taught the Planning Commission. Parr stated she has had a wonderful experience with the Planning Commission. 8.
