AND INTERESTS FOR THE PURPOSE OF THE CONSTRUCTION
3. DIRECTING WSB TO PROCEED WITH FINAL DESIGN
DISCUSSION: Introduction
The purpose of this agenda item is to seek approval from the City Council
to execute the City's Standardized Professional Services Contract for
required geotechnical services and to begin final design and discussions
with property owners regarding land acquisition for the CR 21 / Arcadia
Avenue Improvement Project.
Hi story
In 2005 Scott County and the City of Prior Lake adopted the CR 21
Corridor Study completed by Scott County. This study identified several
improvements necessary to maintain adequate access to the Prior Lake
downtown as traffic volumes are expected to increase from about 10,300 to
more than 27,000 by 2030. The study identified that at some point in the
future Main Avenue would become a right -in, right -out access only. A full
signalized access would be provided at Arcadia Avenue. Additionally a %
access would be provided at Pleasant Street from TH 13.
In 2008 the City of Prior Lake completed a feasibility study for improvement
of the Arcadia Intersection. The study identified a total estimated
construction cost of $2.1 million plus right of way and project costs. The
total project cost is estimated to be $3.05 million.
In 2009 Scott County began construction of the CR 21 extension between
CR 42 and TH 169. It is anticipated that the project will be completed by
the end of 2011.
The City of Prior Lake prioritized the Arcadia Avenue Intersection
improvements for design in 2010 and construction in 2011 as part of the
2010 -2014 Capital Improvement Program. This street improvement project
is necessary whether the base case or the realignment option is chosen
especially considering that traffic volumes will start growing once CR21 is
connected to TH169 this fall.
The City also made a funding request to Scott County for the project. The
County identified $750k of funding in 2011 for project construction. Based
on tax levy bonding concerns the City deferred the design and right -of -way
acquisition costs to 2011.
In the Summer of 2010 the City Council authorized completion of an
alternative alignment analysis for CR 21 through downtown Prior Lake.
On December 6, 2010 the City Council authorized the Mayor and City
Manager to execute a contract with WSB & Associates for the project
design services.
On February 7, 2011 the City Council authorized staff to direct WSB to
proceed with preliminary design work required to determine needed right of
way (ROW) and easements for the project including preliminarily contacting
property owners in an effort to begin the property /right of way acquisition
process.
On April 4, 2011, the City Council authorized staff to perform appraisals for
this project.
Current Circumstances
The preliminary design is now complete for the County Road 21 / Arcadia
project. WSB is now prepared to proceed with final design and begin
making offers to property owners. The preliminary design has identified
temporary easements, permanent easements and ROW needed from 9
parcels in order to construct the project. This project will be partially funded
by State Aid funds and may require condemnation of easements or ROW if
standard negotiations are not successful. Before offers are made, the City
will hold a neighborhood meeting sometime in July to discuss the project
with interested property owners and citizens.
Geotechnical Exploration
Staff has requested proposals from three firms for geotechnical exploration.
They include: American Engineering Testing, Braun Intertec, and Stork
Twin City Testing. Each of these firms has previously completed work for
the City of Prior Lake. The proposals received are tabulated below:

The proposals received were each analyzed and City Staff is
recommending that Braun Intertec be selected to perform the geotechnical
exploration for the City of Prior Lake.
Conclusion
Staff recommends award of the City's Standardized Professional Services
Contract to Braun Intertec in the amount of $4,400 for geotechnical
services. Staff recommends that WSB be authorized to begin final design
to begin the process of making offers to property owners.

ISSUES: The realignment options discussed by the City Council affect some final
design details including streetscaping and the type of signal system. WSB
will not proceed with design of these elements until the realignment option
decision is made later this summer.
Property acquisition can take six months or more if condemnation is
required. WSB needs to continue the right of way process for the project to
move forward.
FINANCIAL The project cost is estimated at $3,050,000. Right of Way /property
IMPACT: acquisition costs are estimated at $463,044. Funding for this project is
proposed to come from Tax Levy, Street Oversizing, State Aid, Water
Quality, Sewer Fund, Water Fund, and Scott County contributions.
Because right of way is acquired prior to bonding for construction purposes,
the City should consider bonding in 2011 for right of way acquisition to
have cash on hand to pay for land acquisition.
The City has previously executed a contract with WSB & Associates in the
amount of $263,411. Final design services and right of way acquisition are
included in the cost. These services were budgeted as part of the project
easement and ROW acquisition. The services as well as geotechnical
services will be funded from account #501- 48372 -502.
ALTERNATIVES: 1) Approve three resolutions related to the Arcadia and CR 21 Intersection
Improvement Project 1) Authorizing the Mayor and City Manager to
execute the City's Standardized Professional Services Contract for
Geotechnical Services. 2) Authorize and direct City representatives to
make offers or initiate eminent domain to acquire certain lands,
easements and other rights and interests for the purpose of
construction. 3) Direct WSB to proceed with final design.

A RESOLUTION AUTHORIZING BRAUN INTERTEC TO PROVIDE
GEOTECHNICAL SERVICES FOR THE ARCADIA AND COUNTY ROAD 21 IMPROVEMENT PROJECT

WHEREAS, Geotechnical exploration is a necessary service needed to properly install City
infrastructure; and,
WHEREAS, Geotechnical exploration is needed for the Arcadia and County Road 21 Improvement
Project; and
WHEREAS, The City does not have the equipment or expertise to provide these services; and
WHEREAS, The City solicited and evaluated proposals from qualified firms to provide geotechnical
exploration services for the Arcadia and County Road 21 Improvement Project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
The recitals set forth above are incorporated herein.
The Mayor and City Manager are authorized to execute the City's Standardized Professional Services
Agreement with Braun Intersect for an amount of $4,400.00 for geotechnical services for the Arcadia
and County Road 21 Improvement Project.
Funding for these engineering services will be drawn from the Construction Fund Account #501- 48372-
502.

A RESOLUTION AUTHORIZING AND DIRECTING CITY REPRESENTATIVES TO MAKE OFFERS AND
THE CITY MANAGER AND CITY ATTORNEY USE THE POWER OF EMINENT DOMAIN TO ACQUIRE
CERTAIN LANDS, EASEMENTS, AND OTHER RIGHTS AND INTERESTS FOR THE PURPOSE OF
THE CONSTRUCTION FOR THE ARCADIA AND COUNTY ROAD 21 IMPROVEMENT PROJECT

WHEREAS, The City Council of the City of Prior Lake, MN ( "City ") is the official governing body of the
City of Prior Lake, Scott County, Minnesota; and
WHEREAS, The City of Prior Lake, a Minnesota municipal corporation, acting by and through the City
Council, is authorized by law to acquire real estate which is needed for public use or
purpose; and
WHEREAS, The City of Prior Lake, acting cooperatively in conjunction with Scott County ( "County "),
intends to construct Arcadia Avenue from Colorado St to Dakota St and County Road 21
from Duluth Avenue to Main Avenue, together with associated improvements ('Project ");
and
WHEREAS, The County desires and supports the construction of the Project; and
WHEREAS, The construction of the Project will require the acquisition of various lands, easements,
and other rights and interests by the City; and
WHEREAS, The City and County will enter into an agreement pursuant to which the City will be
responsible for acquisition of the lands, easements, and other rights and interests
required for the Project from the properties denoted and described in Exhibit A, attached
hereto and incorporated herein, which is subject to minor changes; and
WHEREAS, City representatives have been in contact with or have met personally with
representatives of the Owners of each of the Parcels to explain the necessity to acquire
the property, easements or other rights and interests in the property for the Project; and
WHEREAS, The City will make a good faith attempt to negotiate with the owners of the property in
order to acquire the property by direct purchase instead of the use of eminent domain
proceedings; and
WHEREAS, The City has retained independent fee appraisers to determine the just compensation due
to each of the Owners; and
WHEREAS, The City will use the appraisal data to make offers to purchase the needed property,
easements and other rights and interests from each of the Owners; the offers to purchase
are based on the certified, appraised value of just compensation; and each Owner shall
receive a copy of the appraisal report used as the basis for the City's offer; and
WHEREAS, the Project construction schedule contemplates that work will begin in the spring of 2012;
and
WHEREAS, It is necessary that the City have title and possession to the necessary right of way
interest for the Project before the construction contracts may be let.
NOW THEREFORE, be it HEREBY resolved by the City Council of Prior Lake, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council finds that the construction of Arcadia Avenue from Colorado Street to Dakota
Street and County Road 21 from Duluth Avenue to Main Avenue will promote and facilitate traffic
flow through downtown Prior Lake and improve vehicular and pedestrian safety.
3. The City Council finds that it is reasonably necessary, proper, and convenient, and in the interest of
the public health, safety, and general welfare of the citizens of the City that title and possession of
the lands, easements, and other rights and interested described on the attached Exhibit A be
acquired for the purposes of the Project.
4. The City Council finds that the construction schedule for the Project makes it necessary to acquire
title and possession of the lands, easements, and other rights and interests described on the
attached Exhibit A prior to the filing of the final report of the condemnation commissioners to be
appointed by the district court.
5. It is the considered judgment of the City Council that title and possession of the lands, easements,
and other rights and interests described on the attached Exhibit A be acquired for the stated public
purpose for constructing the Project and that these rights and interests be acquired through a
negotiated purchase and, if necessary, through the exercise of the power of eminent domain and
the use of the quick -take procedure.
6. City representatives and the City Manager and the City Attorney are authorized and directed to
take all steps necessary to acquire the lands, easements, and other rights and interests described
on the attached Exhibit A by filing an action in eminent domain and by the use of the quick -take
procedure authorized pursuant to Minnesota Statutes, Section 117.042.

RESOLUTION AUTHORIZING WSB AND ASSOCIATES TO PROCEED WITH FINAL DESIGN FOR THE
ARCADIA AVENUE AND COUNTY ROAD 21 INTERSECTION IMPROVEMENTS

WHEREAS, the 2011 -2015 Capital Improvement Program identifies improvement of the County
Road 21 and Arcadia Avenue Intersection Improvement Project for Construction in
2011; and
WHEREAS, in order to allow for construction in 2011 it is necessary to begin certain phases of
design at this time; and
WHEREAS, The County Road 21 extension to TH 169 is expected to open late in 2011 and traffic
volumes on County Road 21 in downtown Prior Lake are expected nearly triple over the
next 20 -30 years impacting downtown accessibility; and
WHEREAS, The City does not have the in -house expertise or resources to design and oversee
construction of the improvements; and,
WHEREAS, On December 6, 2010 the City Council approved Resolution 10 -118 approving a
contract with WSB & Associates for design and construction services; and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. WSB and Associates are authorized to proceed with final design for the Arcadia and County Road 21
Intersection Improvement.
3. The original Professional Services Contract (Res. 10 -118) with WSB included final design services.
4. Funding for these engineering services will be drawn from the Account #501 - 48372 -502.
