CONTINUING CITY PARTICIPATION IN THE LIVABLE
COMMUNITIES PROGRAM
History: In 1995, the state legislature adopted the Metropolitan
Livable Communities Act. The Act provided three sources of funding
that would be available to communities that elected to negotiate
housing goals with the Metropolitan Council. The Act specifies that
communities must adopt a resolution each year to indicate their intent
to continue in the program for the following calendar year.
Current Circumstances: The City has participated in the Livable
Communities program for the past four years. The Act requires that a
dollar figure be established for each community for the year in which it
participates. This figure is to be spent in the community for low and
moderate income housing. The Affordable and Life Style Housing
Opportunities Amount (ALHOA) for Prior Lake in 2002 is zero. In
2001, the ALHOA was also zero. Because the ALHOA for next year
is zero and because the Scott County HRA spends approximately
$400,000 a year in Prior Lake on programs which qualify for the
ALHOA, we do not anticipate the City will be required to make any
additional payments.
The Issues: Continuation of City participation will maintain the
City's eligibility for participation in the funding programs, which are
available. The Council needs to determine if continued participation is
necessary or desirable. At present, there are no commitments the City
must meet and, in the event the City wishes, there are funds available
through Metropolitan Council programs for various housing-related
activities.
Previous staff reports have indicated that several things might happen
if the City failed to participate, including the following:

. The Metropolitan Council will consider the lack of participation in
any decision regarding the City and which involves a regional
investment, an impact on a metropolitan system or a MUSA
expanSIOn.
· The City would not be eligible to receive any of the money
available through the program.
. The Metropolitan Council will report to the Legislature on the
status of the program and will likely highlight those communities
that elect not to participate.
Conclusion: Participation in the program does not commit the City to
specific actions, but only continues the City's eligibility to participate
in the Livable Communities Program. Participation can be a benefit to
the City in terms of eligibility for Metropolitan Council funding
programs. The staff recommends the Council adopt the attached
resolution continuing City participation in this program. The Livable
Communities Act requires the City Council adopt a resolution by
November 15th.
Budflet Impact: There is no budget impact as a consequence of
participation in this program. The City is not obligated to provide any
payments or financial commitments as a result of participation in the
Livable Cities Program.
The City Council has two alternatives:
1. Adopt Resolution 01-XX as part of the Consent Agenda
confirming continued participation in the Livable Communities
Program for 2002.
2. Elect to terminate participation in this program.
Alternative #1. A motion and second as part of the Consent Agenda
adopting Resolution Ol-XX confirming continued participation in the
Livable Communities Program for 2002.

RESOLUTION ELECTING TO CONTINUE PARTICIPATING IN THE LOCAL
HOUSING INCENTIVES ACCOUNT PROGRAM UNDER THE METROPOLITAN
LIVABLE COMMUNITIES ACT
CALENDAR YEAR 2002

WHEREAS, the Metropolitan Livable Communities Act (Minnesota Statues Section 473.25
to 473.254) establishes a Metropolitan Livable Communities Fund which is
intended to address housing and other development issues facing the
metropolitan area defined by Minnesota Statutes section 473.121; and
WHEREAS, the Metropolitan Livable Communities Fund, comprising the Tax Base
Revitalization Account, the Livable Communities Demonstration Account and
the Local Housing Incentive Account, is intended to provide certain funding
and other assistance to metropolitan area .municipalities; and
WHEREAS, a metropolitan area municipality is not eligible to receive grants or loans under
the Metropolitan Livable Communities Fund or eligible to receive certain
polluted sites cleanup funding from the Minnesota Department of Trade and
Economic Development unless the municipality is participating in the Local
Housing Incentives Account Program under the Minnesota Statutes section
473.254; and
WHEREAS, the Metropolitan Livable Communities Act requires the Metropolitan Council
to negotiate with each municipality to establish affordable and life-cycle
housing goals for that municipality that are consistent with and promote the
policies of the Metropolitan Council as provided in the adopted Metropolitan
Development Guide; and
WHEREAS, each municipality must identify to the Metropolitan Council the actions the
municipality plans to take to meet the established housing goals through
preparation of the Housing Action Plan; and
WHEREAS, the Metropolitan Council adopted, by resolution after a public hearing,
negotiated affordable and life-cycle housing goals for each participating
municipality; and

WHEREAS, a metropolitan area municipality which elects to partIcIpate in the Local
Housing Incentives Account Program must do so by November 15 of each year;
and
WHEREAS, for calendar year 2002, a metropolitan area municipality that participated in the
Local Housing Incentive Account Program during the calendar year 1997, can
continue to participate under Minnesota Statues section 473.254 if : (a) the
municipality elects to participate in the Local Housing Incentives Account
Program by November 15, 2000; and (b) the Metropolitan Council and the
municipality have successfully negotiated affordable and life-cycle housing
goals for the municipality:
NOW, THEREFORE, BE IT RESOLVED THAT the City of Prior Lake hereby elects to
participate in the Local Housing Incentives Program under the Metropolitan Livable
Communities Act during the calendar year 2002.
