The 2001 Improvement Project (Project #01-11) is included
in the 2001 Capital Improvement Program and has received
numerous City Council approvals to date.
At the June 4, 2001 Council Meeting, the Council awarded
bids for the improvement projects. Project 01-11 includes
sanitary sewer, water main, storm sewer and street
reconstruction on Evanston Avenue, St. Paul Avenue,
Jordan Avenue, Minnesota Street, Dakota Street, Oak Street
and Memorial Trail. The City has executed a contract with
Barbarossa & Sons to construct the project. The project will
be substantially complete by October 31st.
The Assessment Review Committee met on February 22,
2001 to review the project and the proposed assessments.
In addition, the City Council held a neighborhood
informational meeting on March 19, 2001 to discuss several
concerns with residents including the method of
assessment. A memo summarizing the meeting is attached
to this report. Five issues were addressed at the meeting:
1. Assessment method: unit versus front footage
2. Sidewalks
3. Tree replacement
4. Alleys
5. Memorial Trail: one-way versus two way traffic
Items 2 through 5 have been resolved with the remaining
issue of assessment method to be addressed.

CURRENT CIRCUMSTANCES
During the course of the public hearing discussion took
place on both assessment methods. For the most part the
majority of the residents appeared to favor the front footage
method. The only exceptions were the two flag lots that
requested relief based on their actual front footage abutting
the street improvements. The position of the Assessment
Review Committee (ARC) was that the City's assessment
policy guide was equitable in dealing with flag lots. However,
the Council does have the latitude to adjust these few lots to
a lower applied frontage as the assessment policy provides
guidance as opposed to absolute policy.
The ARC recommends the front footage method of
assessment for the reasons listed on the attached memo. It
is necessary that the City Council make a determination on
which assessment method should be applied. Since the
special assessment hearing date is proposed for October
15th, individual property owner notices must be sent to the
residents by September 28, 2001. The amount to be
assessed is required to be included in the mailed notice.

The total project cost for Project 01-11 is ~ It is
proposed to be funded through tax levy, trunk reserve funds,
construction funds and special assessments. The proposed
amount to be assessed against the benefiting properties is
$518,397. There are 83 benefiting units in the project area
that are being assessed at a 40% rate and 8 units being
assessed at a 100% rate as a first time improvement (Oak
Street and a portion of Evanston Avenue). Based on the
foregoing, the proposed assessment is $53.24/front foot for
the 40% assessed and $181.73 for the 100% assessed
properties.
Staff recommends that the City Council declare the costs to
be assessed, order preparation of the assessment rolls, and
establish the Assessment Hearing date as October 15, 2001
for both projects and authorize the required notice of public
hearing to be published as per the attached resolutions.
These improvements will be financed through the issuance
of $1 ,035,000 of general obligation bonds.

WHEREAS,
a Contract has been let and costs have been determined for the improvement of Evanston
Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, Oak Street and
Memorial Trail, Project 01-11 and the contract price for such improvements is $1,568,000 and the
expenses incurred or to be incurred in the making of such improvements amount to $212,000 so
that the total cost of the improvements will be $1,780,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The portion of the cost of such improvements is to be paid by the City is hereby declared to be
$1,261,603, and the portion of the cost to be assessed against benefited property owne~ is ;j f

2. Assessments shall be payable on an equal principal installment method extending over a period of
10 years for street improvements. The first installment shall be the annual principal plus interest
calculated from the public hearing date to the end of this year plus twelve months of the next year
and shall bear interest at the rate of a minimum of 8% per annum from the date of the adoption of
the assessment resolution.
3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper
amount to be specially assessed for such improvements against every assessable lot, piece or
parcel of land within the district affected, without regard to cash valuation, as provided by law, and
he shall file a copy of such proposed assessment in his office for public inspection.
4. The City Manager shall upon the completion of such proposed assessment, notify the Council
thereof.

WHEREAS, by a resolution passed by the Council on September 17, 2001, the City Manager was
directed to prepare a proposed assessment of the cost of improvements for Project 01-11
Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, Oak
Street, and Memorial Trail Reconstruction; and
WHEREAS, the City Manager notifies the Council that such proposed assessment will be completed
and filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. A hearing shall be held on the 15th day of October, 2001, in City Council Chambers at 7:30 P.M. to
pass upon such proposed assessment and at such time and place all persons owning property affected
by such improvement will be given the opportunity to be heard with reference to such assessment.
2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to
be published once in the official newspaper at least two weeks prior to the hearing, and he shall also
cause mailed notice to be given to the owner of each parcel described in the assessment roll not less
than two weeks prior to the hearing.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City Finance Director, except that no interest will be charged if the entire assessment is
paid within 30 days from the adoption of the assessment. He may, at any time thereafter, pay to the
City Finance Director the entire amount of the assessment remaining unpaid, excepting the installment
portion appearing upon the current year's property tax statement.

2001 Public Improvement Project - Resident Concerns

1. Method of Assessment: Residents who attended the Public Hearing expressed concern
about of the front footage methodology. On the other side, persons with smaller lots believe
they overpay with the unit method. The recommendation of the special assessment committee
is to retain the front footage method for the following reasons:
. 45 of the 78 single-family residential units (nearly 60%) have front footages of 80 feet or
less, with 31 of these lots having frontages of 60 feet or less.
. The front footage method is the application that is most familiar to the residents as a
result of the informational meetings and the public hearing.
. The front footage application is the most equitable because the cost is directly
proportional for the most part to the size of the lot.
2. Sidewalks: There are no special assessments for sidewalks. All sidewalks are paid for from
other sources. Sidewalks are to be constructed beginning at CSAH 44 down Jordan Avenue to
Minnesota Street to Evanston Avenue to CSAH 21. The sidewalk will connect the County
Road, the Park and the School. A sidewalk cannot be constructed economically on the east
side of St. Paul Avenue because of lot grades and setbacks. A sidewalk is also proposed along
Memorial Trail in the park and will be located so as not to disturb existing trees.
3. Tree Replacement: As with any City reconstruction project, tree removal will be kept to a
minimum. By decreasing the width of Memorial Trail to 20 feet, only two pines on park
property will have to be relocated with a tree spade and the oaks will remain undisturbed. As
many as five trees on private property may be removed depending on storm sewer and
watermain final design. Several trees will be removed within the right of way including an area
along the north side of Oak Street. Three of the trees are approximately 20" in diameter. Staff
will continue to work with property owners to locate sewer and water services so that tree
removal is minimized. Trees on private property (not right-of-way or public property) that die
within twelve months of project completion, will be replaced with 2-3 caliper-inch trees from the
City's nursery stock if the City determines that the tree loss was related to the project.
4. Alley: The City will discuss installation of curb cuts or vacation of the alley with affected
residents.
5. Memorial Trail (east/west only): Memorial Trail will be built to a 20-foot width in accordance
with the City's past practice considering the State Uniform Fire Code. As previously mentioned,
narrowing the width of the street results in saving trees. The street can be striped and signed
for two-way or one-way traffic.

IN THE
CITY OF PRIOR LAKE, SCOTT COUNTY, MINNESOTA
Notice is hereby given that the City Council of the City of Prior Lake, Minnesota will meet in the
Council Chambers at Fire Station No.1, 16776 Fish Point Road, on Monday, the 15th of
October, 2001 at 7:30 P.M. to consider the assessment of the following street:
PROJECT DESCRIPTION
Reconstruction of Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota
Street, Oak Street and Memorial Trail including sanitary sewer, water main, storm sewer, street
reconstruction and appurtenant work.
The area proposed to be assessed is every lot, piece, and parcel benefiting from said
improvements, whether abutting or not, within the following described areas:
Evanston Avenue, St. Paul Avenue, Jordan Avenue, Minnesota Street, Dakota Street, Oak
Street and Memorial Trail
Specific property descriptions included in the above described area, but not inclusive, are
as follows:

The estimated total of the assessment roll is $518,397.00.
The Council proposes to proceed under the authority granted by Chapter 429 M.S.A.

The proposed assessment roll is on file in the City Manager's office and any written or oral
objections will be considered at the public hearing. No appeal may be taken as to the amount of
any assessment unless a signed, written objection is filed with the City Manager prior to the
hearing or presented to the presiding officer at the hearing. An appeal to district court may be
made by serving notice upon the Mayor or City Manager within 30 days after adoption of the
assessment roll and filing such notice with district court within 10 days after service upon the
Mayor or City Manager. The City also has adopted a deferred assessment ordinance whereby the
City Council may defer the payment of special assessments for those individuals who are
permanently disabled or have attained the age of 65 or older. Guideline criteria and applications
are available at City Hall. Applications must be made within 30 days following the adoption of
the assessment roll by the City Council.
