MN 55372 SPECIAL CITY COUNCIL MEETING MINUTES July 12, 2011 CALL TO ORDER The meeting was called to order at 4:30 p.m. Present were Mayor Myser, Council members Erickson, Hed- berg, Keeney and Soukup, City Manager Boyles, City Attorney Pace, Finance Director Erickson, Building and Transportation Services Director Kansier, Public Works and Natural Resources Director Gehler, WSB Representative Hansen, Parks and Fleet Supervisor Friedges, Assistant City Manager Meyer and Adminis- trative Assistant Green. NEW BUSINESS Consider Approval of an Ordinance Relating to Electrical Inspection City Manager Boyles explained that the City has contracted with the State for many years to provide needed electrical inspections; but the recent State shut -down has prevented fulfillment of the contract. This proposed ordinance would allow contingencies for the City to provide electrical inspections any way we see fit. Comments: Erickson: Noted that Minneapolis started its own electrical inspection service. Boyles: Stated that staff has checked with several other municipalities and counties to learn how each is handling its electrical inspection needs. Myser: Asked if electrical inspection requests are getting backed up. Kansier: Replied that calls have been received requesting inspections. She has been in contact with an electrical inspector in this area. Stated that approval of proposed ordinance will allow electrical inspections to begin on Monday. Keeney: Asked if a property owner would be able to contract with their own inspector. Boyles: Affirmed they would be able to choose from a City- approved list of inspectors. Myser: Asked if any other services have been impacted by the State shutdown. Boyles: Replied that liquor licenses are not being completed. Hedberg: Understands that some municipalities are adopting ordinances regarding electrical inspections with a sunset clause that voids the ordinance when the State is back to providing the service. Boyles: Responded that the proposed ordinance is based on a League of Minnesota Cities draft which had a sunset clause. The City chose to remove the sunset clause so that the choice of how to manage electrical inspections can be retained. Hedberg: Commented that he does not see an advantage to electrical inspections being a State program. Kansier: Responded that it does provide the service without a municipality having to staff an electrician. Staff can provide contact information for electrical inspections and not have to do anything further. MOTION BY HEDBERG, SECOND BY SOUKUP TO APPROVE ORDINANCE 111.07 RELATING TO ELECTRICAL INSPECTION VOTE: Ayes by Myser, Erickson, Hedberg, Keeney and Soukup. The motion carried. Consider Approval of a Resolution Declaring the Prior Lake Rotary Second Annual Lakefront jazz and Blues Festival a Community Festival Under Minnesota Statutes 340A.404. City Manager Boyles stated that even though the City Council approved a liquor license for the jazz fes- tival, it was not forwarded in a timeframe to allow subsequent State approvals before the State shut down. State Statute 340A.404 allows a license holder to supply liquor to community festivals with City approval of appropriate event licensure. Comments: Keeney: Clarified that the proposed resolution does not authorize a specific license holder to provide the liquor. Boyles: Affirmed, adding that the license holder would have to be current. Keeney: Asked who violations would be cited against in the event any occurred. Boyles: The license holder rather than the host of the festival. Keeney: Asked if the temporary permit for the festival would be utilized. Boyles: Replied that it would not. Keeney: Asked if multiple license holders would want this opportunity. Boyles: Does not believe so and identified that The Cove would provide the liquor for this- festival. Myser: Asked if there would be any downside to having this be a community festival. Boyles: Replied there is no definition of a community festival and this event meets the criteria set out in Statute. Erickson: Asked who would be liable in the event of any damages to the park. Boyles: Replied there is a separate agreement for use of the park. The Rotary has planned well and will be offering training for those who are serving liquor. MOTION BY KEENEY, SECOND BY HEDBERG TO APPROVE RESOLUTION 11.081 DECLARING THE PRIOR LAKE ROTARY SECOND ANNUAL LAKEFRONT JAll AND BLUES FESTIVAL A COMMUNITY FESTIVAL PURSUANT TO M.S. 340A.404 Subd. 4(b). VOTE: Ayes by Myser, Erickson, Hedberg, Keeney and Soukup. The motion carried. ADJOURNMENT With no further comments from Council members, a motion to adjourn was made by Keeney and seconded by Hedberg.
