AGENDA ITEM: CONSIDER APPROVAL OF AN ORDINANCE AMENDING SECTION 901 OF
THE PRIOR LAKE CITY CODE (TRAFFIC CODE).
DISCUSSION: History: The City staff and City Attorney are engaged in an on-going effort to
update the City Code. The Traffic Code chapter of the ordinance is the most
recent example.
Current Circumstances: The revisions to the ordinance proposed in this agenda
item will improve the Code's consistency with state statute, as well as assist the
Police Department in administering the provisions of the ordinance.
ISSUES:
The following issues should be considered by the Council in determining whether
to adopt the revised traffic ordinance:

1. The revised code removes specific reference of a fine amount upon conviction;
the maximum amount of which is often changed by the state legislature. These
changes throughout the ordinance simply specify the violation category, i.e.
misdemeanor, thereby allowing for a fine within those changing statutory
thresholds.
2. Extends the effective dates for no parking on City streets between 2:00 a.m. and
6:00 a.m., November 15th until March 15th, for snow removal, to between
November 1st and March 31st.
3. Deletes and unused subsection, 901.307, which year-round, prohibited parking
on Main Avenue between 2:00 a.m. and 6:00 a.m., as well as an even/odd day
prohibition on north-south or east-west streets between those same hours.
4. Prohibits parallel parking in any area marked or signed for angle parking.
5. Extends the prohibition of parking for camping purposes and to display for sale
on public property and on public right-of-way.
The proposed revisions improve consistency with the associated regulatory
provisions and definitions found in the Minnesota Traffic Statutes and regulations.
The changes will help in the enforcement of the provisions of the ordinance by
the Police Department. Furthermore, the revisions should add clarity regarding
traffic regulations within the City of Prior Lake to our citizens and visitors.
FINANCIAL
IMPACT:
Other than the cost of replacing existing informational signs regarding the snow
plowing parking restrictions, there is no fiscal impact associated with these
revisions.

STATE STATUTES ADOPTED BY REFERENCE:
Minnesota Traffic Regulations: The regulatory provisions and
definitions of the Minnesota Traffic Regulations, Minnesota Statutes.
Chapter 169. are hereby adopted as a traffic ordinance of the City
regulating the use of highways, streets and alleys within the City and are
hereby Incorporated in and made a part of this Section as completely as
if set out i'n full herein.
Driver's License Act: The regulatory provisions and definitions of
Minnesota Statutes, Chapter 171, are hereby adopted as a driver's
license ordinance of the City, regulating the driving of motor vehicles on
the highways, streets and alleys within the City and are hereby
incorporated in and made a part of this Section as if set out in full
herein.
Definitions: The definitions of Minnesota State Statute ~~ 168.011,.
169.01 and 171.01 are hereby adopted and are hereby incorporated in
and made a part of this Section as completely as if set out in full herein.
Variance: A variance for any provision of this Section 901 may be
granted by the Chief of Police for a one day period with advance
notification from any individual residing within the City.
Penalty: Any Violation of the Statutes adopted by reference in Section
901.100 is a violation of this Section if it occurs within the City. Any
Person violating any provision of this Section shall, upon conviction
thereof, be guilty of a misdemeanor.
PARKING REGULATIONS:
Angle Parking: Upon those streets which have been marked or signed
for angle parking, Vehicles shall be parked at the angle to the curb
indicated by such marks or signs, with the right front tire within 12
inches of the curb or curb line. There shall be no parallel parking in any
area marked or signed for angle parking.
Prohibited Parking: No Vehicle, except Authorized Emergency Vehicles
or Vehicles parked temporarily for the delivery of merchandise, shall
stop, stand, or park at any place where prohibited by permanent or
temporary signs placed by the City Police Department or City PubliC
Works Department, or where the curbing adjacent to the roadway IS

Public Parking Lots: It shall be unlawful to park or leave a vehicle
within a public parking lot except at a designated parking area or
contrary to the restrictions or regulations imposed for parking on such
property.
Display for Sale No Person shall stop, stand or park a Vehicle on any
public property, Street or within a public right.of-way for the purpose of
displaying it for sale or exchange. A Vehicle shall be deemed to be in
violation of this Section when found stopped, standing or parked upon a
Street bearing a sign Indicating that it is for sale or exchange.
General Time Limit for Parking: No Person shall park a Vehicle or
permit it to stand upon any Street in anyone place for a longer
continuous period than forty eight (48) hours.
Washing, Greasing, Repairing: No Person shall wash, grease or repair
a Vehicle upon a Street, except such repairs that are necessitated by an
emergency.
Winter Parking Restrictions: In order to expedite the prompt and
efficient removal of snow from the Streets of the City, it is unlawful for
any Person to stop, stand or park any Vehicle or permit it to stand on
any Street within the City between the hours of two o'clock (2:00) A.M.
and six o'clock (6:00) A.M. from November 1 until March 31 of the
following year. At all other times of the year it is unlawful for any
Person to stop, stand or park any Vehicle or permit it to stand on any
public Street within the City between the hours of two o'clock (2:00)
A.M. and six o'clock (6:00) A.M. after a continuous or intermittent
snowfall during which there has been an accumulation of two inches
(2") or more of snow on any Street, until the snow has been plowed or
removed to the full Width of the Street. Any Vehicle parked in violation
of this subsection may be towed pursuant to Minnesota Statutes section
169.041. A violation of thiS subsection shall be a petty misdemeanor.
Parking of Commercial Motor Vehicles:
(1) Parking on Residential Street: It shall be unlawful for any Person to
park any Commercial Motor Vehicle or Trailer on any residential
street or within any right-of-way in the City, except temporarily while
loadl ng, u nloadi ng, or render! ng a service.
(2) Penalty: Any Person violating the terms of this subsection shall.

(1) Parking of Unattached Trailers, House Trailers Prohibited: No
Person shall stop, stand or park a Trailer which is not attached to a
properly licensed and Insured Vehicle on any Street or highway
except as otherwise specifically exempted by Prior Lake City
Ordinances or state law. For the purposes of this section, "not
attached" means a Trailer that is not attached to a Vehicle in such a
manner that the Vehicle and Trailer can immediately be operated In
a safe and legal manner without further attachment.
(2) Parking for Camping Purposes: No Person shall, for camping
purposes, leave, park, occupy or otherwise reside in a Recreational
Vehicle or Travel Trailer on any public property, Street or the Right-
of-Way thereof.
Duty to Lock Ignition, Remove Key: Every Person parking a passenger
automobile on a Street in the City shall lock the ignition, remove the
key, and take the same with him/her.
Rule of Evidence: The presence of any Vehicle on any Street or other
public area when standing, stopping or parking is in violation of the
Section is prima facie evidence that the Owner of the Vehicle committed
or authorized the commission of the violation,
Violation, Penalty: Any Person who violates 901,200, except as
otherWise specified herein, shall be guilty of a petty misdemeanor.
PARKING RESTRICTED, PUBLIC LAUNCH SITES:
In General: The City Council has determined that separate parking
restriction and penalty provisions are necessary in the vicinity of public
launch sites of public bodies of water in the City due to Increased traffic
congestion and public health and safety hazards associated with the
launching and retrieval of boats, moving of ice houses and other
activities associated with the public launch sites. The City Council has
determined that extraordinary hazards exist with respect to added
pedestrian traffic, Vehicle traffic with obstructed views associated with
ice houses, boats and trailers and general increased risks of such
facilities. Therefore, the City Council has determined that increased
restriction and penalties are necessary in order to enforce the
regulations for publiC health and safety reasons, to deter prohibited
conduct and to decrease such hazards and risks to the public safety
and welfare In the vIcinity of publiC launch facilities.
No Parking, Stopping or Standing Zones in the Vicinity of Public
Launch Sites: The City Council may, by resolution, designate certain

Streets or portions of Streets as no parking or no stopping zones Within
two thousand five hundred (2,500) feet of public launch sites in the City
of Prior Lake. The City Council shall approve by resolution the amount
of fines for violation of this subsection. The City Engineer shall mark by
appropriate signs each zone so designed and such sign shall indicate
the amount of the fine that shall be imposed upon the violator. The sign
shall Indicate that violator's vehicle shall be subject to impoundment
and/or towing.
ACCELERATION OF VEHICLES: It shall be unlawful for any Person to start or
accelerate any Vehicle With an unnecessary exhibition of speed on any
publiC or private way, road or parking lot within the corporate limits of
the City. Prima facie evidence of such unnecessary exhibition of speed
shall be fishtailing and/or unreasonable squealing or screeching sounds
emitted by the tires and/or the unreasonable throwing of sand or gravel
by the tlr-es of said Vehicle. With respect to two (2) or three (3) wheeled
motorized vehicles. In addition to the above listed items of prima facie
eVidence of such unnecessary exhibition of speed shall also include the
unnecessary removal of the front tire with ground or road contact by the
operator of said Vehicle.
Penalty: Any Person violating the terms of this section shall, upon
conviction thereof, be guilty of a misdemeanor.
TRAFFIC SIGNAL PREEMPTION SYSTEM (TSPS)
Definitions: The follOWing phrase shall have the meaning ascribed to it
for the purposes of this Section:
Traffic Signal Preemption System (TSPS) shall mean a traffic control
system designed to aid emergency vehicles by controlling traffic
movements through signalized Intersections. The TSPS uses pulsating
light to control traffiC signals. When activated, the TSPS either holds a
green light for the approaching emergency vehicle or changes the lights
to provide a green light to the emergency vehicle.
Operation Generally: Except as otherWise specifically permitted and
authorized, no Person may operate or attempt to operate a TSPS by any
means whatsoever, No Person as owner or operator of a Vehicle shall
permit the installation or possession of any TSPS equipment or
equipment capable of operating the TSPS In or upon a Vehicle.
Permitted Operation: Operation of the TSPS is permitted by
Emergency Vehicles while responding to emergencies and by State,
Scott County, and City of Prior Lake maintenance workers while

repairing or testing the TSPS. All repairs and tests shall be coordinated
and pre-approved by the Chief of Police.
Penalty: Any Person who violates the terms of this Section shall, upon
conviction thereof, be guilty of a misdemeanor.

(21)_-Parking on Residential Street: It shall be unlawful for any
pcrsonperson to park any Commercial Motor vehicle Vehicle or
Trailer defined in subsection ~01.208 (1) on any residential street or
within any right-of-way in the City, except in accordunce "'v'ith the
provision of this subsection. It shall be unlawful for any person to
purl< any vehicle defined in subsection ~O1.208 (1) except
temporarily while loading, unloading, or rendering a service. School
buscs arc exempted from this section in the daylight hours.
(3) Penalty: Any person Person violating the terms of this subsection
shall, upon conviction thereof, be found guilty of a misdemeanor.

purposes of this section, "not attached" means a truiler Trailer that
is not attached to a motor vehicle Vehicle in such a manner that the
motor vehicle Vehicle and trailer Trailer can immediately be
operated in a safe and legal manner without further attachment.

The City Council of the City of Prior Lake does hereby ordain that:

repairs that are necessitated by an emergency.
901.207 Winter Parking Restrictions: In order to expedite the prompt and
efficient removal of snow from the streets Streets of the City, it is

unlawful for any person Person to stop, stand or park any '..ehicle Vehicle
or permit it to stand on any public street Street within the City between
the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. from
November 15 until March J15 of the following year. At all other times
of the year it is unlawful for any person Person to stop, stand or park
any vehicle Vehicle or permit it to stand on any public strcct Street
within the City between the hours of two o'clock (2:00) A.M. and six
o'clock (6:00) A.M. after a continuous or intermittent snowfall during
which there has been an accumulation of two inches (2") or more of
snow on any streetStreet, aft6-until the snow has been plowed or
removed to the full width of the streetStreet. Any motor vehiclc Vehicle
parked in violation of this subsection may be towed pursuant to
Minnesota Statutes section 169.041. A violation of this subsection shall
be a petty misdemeanor.
Parking of Commercial Motor Vehicles:
(1) Definition: "Commerci;J1 motor vehicle" and lor "trailer" shall be
defined as a '..chicle with motor po.....er, and/or trailcr, commercially
licensed, designed prim;Jri Iy for thc tr;Jnsportation of peoplc or
property, or designed for carrying a trailer as pre'v'iously defined.
(21)_-Parking on Residential Street: It shall be unlawful for any

Trailer defined in subsection 901.208 (1) on any residential street or
within any right-of-way in the City, except in aecordancc VJith the

parl< ;Jny vehicle defined in subsection 901.208 (1) except
temporarily while loading, unloading, or rendering a service. School
buses arc exempted from this section in the daylight hours.
(32,) Penalty: Any person Person violating the terms of this subsection
shall, upon conviction thereof, be found guilty of a misdemeanor.

person Person shall stop, stand or park a Itrailer which is not
attached to a properly licensed and insured motor vyehicle on any
Street or highway except as otherwise specifically exempted by Prior
Lake City Ordinances or state law. A "trailcr" for the purpose of this

persons or property ;Jnd for being drawn by a motor vchiclc. For the
purposes of this section, "not attached" means a trailer Trailer that
is not attached to a motor vehicle Vehicle in such a manner that the
motor vehicle Vehicle and trailer Trailer can immediately be
operated in a safe and legal manner without further attachment.
(2) Parking for Camping Purposes: No person Person shall, for
camping purposes, leave, park, occupy or otherwise reside in a
house tr~iler Recreational Vehicle or Travel Trailer on any public
property. street Street or the ftgftt-Right-e.f-of-wWay thereof.
901.210 Duty to Lock Ignition, Remove Key: Every person Person parking a
passenger automobile on a public street Street in the City shall lock the
ignition, remove the key, and take the same with him/her.

901.300 PARKING RESTRICTED, PUBLIC LAUNCH SITES:
901.301 In General: The City Council has determined that separate parking
restriction and penalty provisions are necessary in the vicinity of public
launch sites of public bodies Off water in the City due to increased
traffic congestion and public health and safety hazards associated with
the launching and retrieval of boats, moving of ice houses and other
activities associated with the public ucccss facilitylaunch sites. The City
Council has determined that extraordinary hazards exist with respect to
added pedestrian traffic-,- und motor vehicles Vehicle traffic with
obstructed views associated with ice houses, boats and trailers and
general increased risks of such facilities. Therefore, the City Council
has determined that increased restriction and penalties are necessary in
order to enforce the regulations for public health and safety reasons-,-
~to deter prohibited conduct and in order to decrease such hazards
and risks to the public safety and welfare in the vicinity of public launch
facilities.
901.302 No Parking, Stopping or Standing Zones in the Vicinity of Public
AccessesLaunch Sites: The City Council may, by resolution, designate
certain strcets Streets or portions of strccts Streets as no parking or no
stopping zones within two thousand five hundred (2.500) feet (2,500) of
public launch sites in the City of Prior Lake. The City Council shall

approve by resolution the amount of fines for violation of this subsection
to '"hich these parking restrictions apply. The City Engineer shall mark
by appropriate signs each zone so designed and such sign shall
indieatee the amount of the fine .....hich that shall be imposed upon the
violator. The sign shall indicate that violator~s!. vehicles shall be subject
to impoundment and/or towing.
ACCELERATION OF VEHICLES: It shall be unlawful for any person Person to
start or accelerate any motor vehicle Vehicle with an unnecessary
exhibition of speed on any public or private way, road or parking lot
within the corporate limits of the City. Prima facie evidence of such
unnecessary exhibition of speed shall be fishtailing, and/or
unreasonable squealing or screeching sounds emitted by the tires
and/or the unreasonable throwing of sand or gravel by the tires of said
vehieleVehiele. With respect to two (2) or three (3) wheeled motorized
vehicles, in addition to the above listed items of prima facie evidence of
such unnecessary exhibition of speed, thereunnecessary exhibition of
speed shall also include the unnecessary removal of the front tire with
ground or road contact by the operator of said vehicleVehicle.
Penalty: Any person Person violating the terms of this section shall,
upon conviction thereof, be guilty of a misdemeanor.
TRAFFIC SIGNAL PREEMPTION SYSTEM (TSPS)
Definitions: The following "yords and phrases shall have the meaning
ascribed to thcm ltJor the purposes of this Section:
Traffic Signal Preemption System (TSPS) shall mean a traffic control
system designed to aid emergency vehicles by controlling traffic
movements through signalized intersections. The TSPS uses pulsating
light to control traffic signals. When activated, the TSPS either holds a
green light for the approaching emergency vehicle or changes the lights
to provide a green light to the emergency vehicle.
Opcrat-c shall mean to activate or attempt to activate thc TSPS by any
means.
Person shall mcan an indi'Jidual, partncrship, corporation, thc statc and
its agcncics and subdivision, and any body of pcrson, 'Nhcthcr
incorporated or not.
Operation Generally: Except as otherwise specifically permitted and
authorized, no pcrsonPerson may operate or attempt to operate a TSPS
by any means whatsoever. No person Person as owner or operator of a
motor vehicle Vehicle shall permit the installation or possession of any
TSPS equipment or equipment capable of operating the TSPS in or
upon a motor 'JehieleVehicle.

Permitted Operation: Operation of the TSPS is permitted as follows:.by
Emergency Vehicles while responding to emergencies and by
(1) The operators of Policc Dcpartment vehicles may operate the TSPS

(2) The operators of Fire Department vehicles may operatc thc TSPS
'.vhile responding to emergencies.
(3) The operators of Statc or County Emergency Vehicles may operate
