AGENDA ITEM: CONSIDER APPROVAL OF AN ORDINANCE AMENDING SECTION 501 OF
THE CITY CODE RELATING TO THE PRIOR LAKE VOLUNTEER FIRE
DEPARTMENT.
DISCUSSION: History: Section 501 of the Prior Lake City Code establishes the Volunteer Fire
Department. That chapter has not been updated for at least eight years. As a
result, numerous of its provisions are out of date. As part of our continuing effort
to update the City Code, Chief Sames, Assistant City Manager Walsh, Assistant
City Attorney Schmitt and myself have proposed revisions to the document for
City Council consideration.
Current Circumstances: Revisions to Chapter 501 have been completed and
are shown in legislative format in the attached document. The key revisions and
the rationale for each are shown below:

1. 501.100 - The Fire Department presently has over 40 members. So that the
ordinance provides capacity for growth over time, the maximum has been
revised to 60 members. A provision has also been added to this paragraph which
authorizes the City Manager to approve Fire Department bylaws changes as long
as they are consistent with state, federal or local law and regulation, together
with the City Personnel Policy.
2. 501.200 - The City Manager rather than the City Council confirms the election
of officers. This is consistent with the Manager's responsibility to hire, fire and
discipline City employees pursuant to state statute. The fire officers are to be
elected for two rather than one year terms except that this year, in order to
achieve staggered terms, certain officers are to be elected for three year terms.
3. 501.300 - Firefighter qualifications are revised to be consistent with state
statute. Additional qualifications can be implemented provided they are
consistent with state and federal law.
4. 501.400 - The paragraph has been revised to address the specific fire call,
training and meeting attendance requirements which firefighters must meet to
remain in good standing. Certain deviations are possible to address special
circumstances.
5. 501.700 - This paragraph confirms that the City Council must approve Relief
Association bylaws since this document has fiscal implications for the City.
6. Subsection 502 and 503 Minor typographical revisions have been
incorporated into various paragraphs.
Conclusion. The proposed revisions are consistent with the practices the Fire
Department would like to follow. They also provide a basis for the completion of

Fire Department bylaws which the Fire Department executive committee has
completed.
ISSUES: The modifications proposed are consistent with the desire and practices of the
department. The revisions also assure that the bylaws conform with applicable
state, federal and local requirements. Upon approval of these ordinance
amendments, the department bylaws will be updated so the City Code,
Personnel Policy and Department bylaws are consistent and mutually reinforcing.
ALTERNATIVES: (1) Adopt the ordinance revisions as proposed.
(2) Adopt the ordinance revisions with amendments.
(3) Take no action.
RECOMMENDED
MOTION:
Alternative (1). Assistant City Manager Walsh has worked with the Fire Chief and
Assistant City Attorney on the proposed changes to assure that they are
appropriate. The Fire Chief has reviewed the proposed changes and concurs.
Following approval of the ordinance we will work with the Chief to complete the
Fire Department bylaws update previously completed by the Department's
executive committee.

VOLUNTEER FIRE DEPARTMENT ESTABLISHED: A Volunteer Fire Department
is hereby established in the City consisting of a Chief, a First Assistant Chief, a
Second Assistant Chief, and not less than thirty (30) firomen.~sixty (60)

be approved by the City Manaoer and must conform with state. federal and local
laws and reoulations and the City Personnel Policy.

PARTICIPATION REQUIREMENTS: All duly appointed firefiqhters shall meet all
fire call. traininq and meetinq attendance requirements as listed below. Failure to
meet minimum participation requirements shall be cause for discipline up to and
includinq termination. The FtireGhief may approve a deviation from the below
requirements if there are extenuatinq circumstances (family. work. personal
matters. past performance. etc.)

(1) Call Response Attendance Percentaqe: All firefiqhters shall maintain a
minimum call attendance of twenty-five (25) percent for a three (3) month period.
(2) Inside Traininq Attendance Percentaqe: All firefiqhters shall attend seventy-five
(75) percent of all inside traininq sessions within a six-month period.
(3) Outside Traininq Attendance: All firefiQhters are stronQly encouraQed to have a
minimum of 12 hours of traininq outside the department each year.
501.500: COMPENSATION: The members and officers of the Fire Department shall receive
compensation as is established by resolution of the City Council. In computi~~
compensation for fires, one hour shall be considered as a minimum to be paid to
any fiFemaA firefiqhter or officer for reporting to a call.
501.600: DUTIES OF OFFICERS:
501.601 Duties of the Fire Chief:

501.602 First Assistant and Second Assistant Chiefs: In the absence or disability of the
Chief, the First Assistant shall perform all of the functions and exercise all of the
duties of the Fire Chief. In absence or disability of the Chief and the First Assistant
Chief, the Second Assistant Chief shall perform all of the functions and exercise all
of the authority of the Chief.
501.700: RELIEF ASSOCIATION: The members and officers of the Fire Department may
organize themselves into a Firem3n's Firefiohters' Relief Association and the City
Council shall approve the Relief Association's Bvlaws or any chanoes or
amendments to said Bvlaws.";'

ESTABLISHMENT OF BUREAU: A Bureau of Fire Prevention in the Fire
Department of the City is hereby established, which Bureau shall be operated under
the supervision of the Chief of the Fire Department, who shall be designated as Fire
Marshall of the Fire Prevention Bureau.
The City Council shall designate a member of the Fire Department or such other
person as the Council determines, who shall have knowledge and familiarity with
the Fire Prevention matters and the Fire Codes of the City, and who shall be
approved by the Council, as the Deputy Fire Marshall of the Bureau of Fire
Prevention, who shall hold his office at the pleasure of the Council.
The Chief of the Fire Department may also designate such number of Assistant Fire
Marshalls as shall from time to time by authorized by the City Council.
POWERS AND DUTIES: In addition to the powers and duties as set forth in this
Chapter, all of the powers, duties, and rights vested in the State Fire Marshall, as
set forth in M.S.A Chapter 299F, are hereby conferred and vested in the Fire
Marshall of the City. Said powers, duties and rights are hereby granted to the Fire
Marshall the same as if said powers, duties and rights were specifically set forth in
this Section. It shall be the duty of the officers of the Bureau of Fire Prevention to
enforce all laws and ordinances of the State, County and City covering the
following:

~ The storage and use of explosives and flammable~;

~ The installation and maintenance of automatic and other fire alarm systems
and fire extinguishing equipment.
~ The maintenance and regulation of fire escapes;
~ The means and adequacy of exit in case of fire from factories, schools,
hotels, lodging houses, hospitals, churches, halls, theaters, amphitheaters
and all other places in which numbers of persons work, live or congregate,
from time to time, for any purpose;
~ The investigation of the cause, origin and circumstances of fires.
The officers of the Bureau of Fire Prevention shall have such other powers and
perform such other duties as are set forth in other Sections of this Chapter, and as
may be conferred and imposed from time to time by law. The Chief of the Fire
Department may delegate any of the powers or duties under this Section to the
Deputy Fire Marshall.
ADDITIONAL DUTIES OF CHIEF: It shall be the duty of the Chief of the Fire
Department to investigate and to recommend to the City Council such additional
ordinances, or amendments to existing ordinances, as Ae tle~l~Fli~f may deem
necessary for safeguarding life and property against fire.
FORMS: The Chi~! of the Fire Department shall prepare instruction~ for the Fire
Marshall. Deputy ~ Fire Marshall and Assistants, and forms for their use in the
report required by this Section.
INVESTIGATIONS: The Bureau of Fire Prevention shall investigate the cause,
origin and circumstances of every fire occurring in the City by which property has
been destroyed or damaged and, so far as possible, shall determine whether the
fire is the result of carelessness or design. Such investigation shall begin
immediately upon the occurrence of such a fire, by the Assistant in whose district
the fire occurs,,-- AM_ If it appears to the officer making such an investigation that
such fire is of suspicious origin, the Chief of the Fire Department shall be
immediately notified of the fact. Saki m:ne Chief shall take charge immediately of the
physical evidence, shall notify the proper authorities designated by law to pursue
the investigation of such matters, and shall further cooperate with the authorities in
the collection of evidence and in the prosecution of the case. Every fire shall be
reported in writing to the Bureau of Fire Prevention within two (2) days after
occurrence of the same by the officer in whose jurisdiction such fire has occurred.
Such report shall be in such form as shall be prescribed by the Chief of the Fire
Department, and shall contain a statement of all facts relating to the cause, origin
and circumstances of such fire, the extent of the damage thereof, and the insurance
upon such property, and such other information as may be required.
FIRE LANES: The Bureau of Fire Prevention is hereby authorized to order the
establishment of fire lanes on public or private property as may be necessary fA

be interfered with, and tRat the access to the fire hydrants or buildings may be not
blocked off. m3Y not be blocked off. When a fire lane has been ordered to be
established, it shall be marked by a sign bearing the words, "NO PARKING - FIRE
LANE" or a similar message. When the fire lane is on public property or public right
of way, the sign or signs shall be erected by the City, and when on private property,
such signs shall be erected by the owner at his own expense within thirty (30) days
after he has been notified of the order. Thereafter, no person shall park a vehicle or
otherwise occupy or obstruct a fire lane.
LICENSES: Before licenses may be issued for the keeping, storage, use, sale,
handling, transportation or other disposition of highly flammable materials and
rubbish, crude petroleum or any of its products, gun or blasting powder, dynamite or
explosives of any kind, including fireworks, firecrackers and signaling explosives,
the Chief of the Fire Department, the Deputy Fire Marshall or his assistants shall
inspect and approve the receptacles, vehicles, buildings or storage places to be
used for any such purposes.
INSPECTION:
Inspection Of Hazards: The Chief of the Fire Department, Deputy Assistant
specially designated thereto shall inspect, as often as may be necessary, but not
less than twice a year, all specially hazardous manufacturing processes, storage or
installation of acetylene or other gases, chemicals, oils, explosives and flammable
materials, all interior fire alarms and automatic sprinkler systems and such other
hazards or appliances as the Chief of the Fire Department shall designate, and
shall make such orders as may be necessary for the enforcement of the laws and
ordinances of the City governing the same for safeguarding of life and property from
fire.
Inspection Of Accumulations Of Hazardous Materials: It shall be the duty of the
Chief of the Fire Department to inspect or cause to be inspected by the Bureau of
Fire Prevention, or by the Fire Department officers and members, as often as may
be necessary but not less than twice a year, all buildings, premises and public
thoroughfares except the interior of private dwellings, for the purpose of
ascertaining and causing to be corrected, any condition liable to cause fire, or any
violation of the provisions or intent of any ordinance of the City affecting the fire
hazard.
Whenever any inspector, as defined above, shall find in any building or upon any
premises or other place, combustible or explosive matter or dangerous
accumulations of rubbish or unnecessary accumulations of waste paper, boxes,
shavings or any highly flammable materials especially liable to fire, and which is so
situated as to endanger property, or shall find obstruction to or on fire escapes,
stars, passageways, doors or windows, liable to interfere with the operations of the
Fire Department or egress of occupants in case of fire, or such officer shall find in
any building combustible or explosive matter or flammable conditions dangerous to

the safety of such building or the occupants of such premises or buildings, he shall
order the same to removed or remedied, and such order shall forthwith be complied
with by the owner or occupant of such premises or buildings, within twenty four (24)
hours thereof, unless the order prescribes a longer period of time within which said
order may be complied with. If said material is not removed within the time
prescribed by said order, said material may be removed or the dangerous condition
corrected at the expense of the owner of the building and the premises or the
person upon whom service is made or both, and the Fire Marshall may maintain all
necessary action for the recovery thereof.
The service of any such order may be made upon the occupant of the premises to
whom it is directed, either by delivering 3 copy of S3me to such occUp3nt person311y
whom it is directed, either by delivering a copy of same to such occupant personally
or by delivering the same and leaving it with any person in charge of the premises,
or in case no such person is found upon the premises, by affixing such order on
said premises. Whenever it may be necessary to serve such an order upon the
owner of the premises, such order may be served either by delivering to and leaving
with the said person a copy of the order, or, if such owner is absent from the
jurisdiction of the officer making the order, by mailing such copy to the owner's last
post office address.
Inspection Of Buildin~s: The Chief of the Fire Department or inspectors of the
Bureau of Fire Prevention, upon the complaint of any person or whenever he or
they shall deem it necessary, shall inspect all buildings and premises within their
jurisdiction. Whenever any of said officers shall find any building or other structure
which, for want of repairs, lack or of insufficient fire escapes, automatic or other fire
alarm apparatus or fire extinguishing equipment or by reason of age or dilapidation
or from any other cause, is especially liable to fire, and which is so situated as to
endanger other property or the occupants thereof, he or they shall order such
conditions to be corrected or improved. Such order shall forthwith be complied with
by the owner or the occupant of such premises or building. If such order made by
the Fire Marshall or any of the Assistant Fire Marshalls, such owner or occupant
may, within twenty four (24) hours, appeal to the Chief of the Fire Department, who
shall, within five (5) days, review such order and file his decision thereon, and
unless by his the authority the order is revoked or modified, it shall remain in full
force and be complied with within the time fixed in said order or decision of the
Chief of the Fire Department.
Provided, however, that any such owner or occupant may, within five (5) days after
the making or affirming of any such order by the Chief of the Fire Department, file
his petition with the County Court, praying a review of such order and it shall be the
duty of such Court to hear the same within not less than five (5) days nor more than
ten (10) days from the time the petition is filed, and to make such order in the
premises as right and justice may require and such decision shall be final. Such
parties so appealing to the County Court shall file with said Court, within two (2)
days, a bond in the amount to be fixed by the Court, to be approved by the Court,
conditioned to pay all costs of such appeal in case such appellant fails to sustain his
appeal or the same be dismissed for any cause.

The City Attorney may, upon request of the Bureau of Fire Prevention, assist the
Fire Marshalls in the investigation of any fire which, in their opinion, is of suspicious
origin.
502.1000: FIRE DRILLS: It shall be the duty of the City Chief of the Fire Department to
require teachers of public, parochial schools and educational institutions to have fire
drills. It shall be the responsibility of the school to keep all doors and exits unlocked
during school hours.
502.1100: RECORDS OF FILES: The Chief of the Fire Department shall keep in the office of
the Bureau of Fire Protection, a record of all fires and of all the facts concerning the
same, including statistics as to the extent of such losses were covered by such fires
and the damage caused thereby, and whether insured, and if so, in what amount.
Such record shall be made daily from the reports made by the Inspectors under the
provisions of this Section. All such records shall be open to authorized City officials
and the insurance carrier.
502.1200: REPORTS: The annual report of the Bureau of Fire Prevention shall be made on or
before January 1 and transmitted to the City Council. Such report shall contain all
proceedings under this Chapter, with such statistics as the Chief of the Fire
Department may wish to include therein. The Chief of the Fire Department shall
also recommend any amendments to this Section which, in his judgment, shall be
desirable.

PENAL TV: Any person violating any of the provisions of this Section, or neglecting
to comply with any order issued pursuant to any section hereof shall be guilty of a
misdemeanor. A separate offense shall be deemed committed for each day such
violation is permitted to exist.

FIRE PREVENTION CODE ADOPTED: The provisions of the National Fire Code,
as may be amended from time to time, are hereby adopted by reference. The
provisions of the Minnesota Uniform Fire Code are hereby adopted by reference.
FALSE ALARM OF FIRE: It shall be unlawful for any person to give, make or
cause to be given or made an alarm of fire without probable cause, or to neglect to
or refuse to obey any reasonable order of the Chief or any fireman designated to
control traffic or restrict an area, or to interfere with the Fire Department in the
discharge of its duties.
PENAL TV: Any person in violation of this Section shall be guilty of a misdemeanor
and shall be fined not to exceed the sum of five hundred dollars ($500.00), or by
imprisonment for a period of not exceeding ninety (90) days, or both.
