CONSIDER APPROVAL OF A RESOLUTION APPROVING
THE PUBLIC WORKS DESIGN MANUAL
DISCUSSION:
HISTORY
On February 26, 1996, the City Council passed Resolution
96-21 approving the Public Works Design Manual. Since
that time, the City has adopted a new subdivision ordinance.
The Staff has prepared a revised Development Contract,
which is currently under consideration. Both actions require
several sections of the manual to be updated. In addition,
there have been changes to the technical specifications due
to updates in industry standards.
The Public Works Design Manual is a technical reference for
developers and their engineering consultants for the design
and construction of subdivisions in the City of Prior Lake.
The manual, which incorporates standards similar to those
used by other cities, has been refined by the Engineering
Department staff over the past five years. The manual is
referenced as a standard in both the subdivision ordinance
and the standard development contract.
CURRENT CIRCUMSTANCES
The Public Works Design Manual contains the following
information:
. Permitting requirements
. Grading, drainage and erosion control standards
. Design standards for utilities, streets and site restoration
. Construction Plan requirements
. Construction inspection and testing
. Detail plates showing construction standards
A copy of the manual is included with this agenda package.

This manual will be subject to change from time to time as
technology changes. Many of our standards are based on
technical documents researched by the Minnesota
Department of Transportation. As better construction
techniques are developed, we will want to take advantage of
improvements and apply them to our standards. Therefore, it
is requested that the City Engineer and Public Works
Director be granted the authority to make changes to the
manual as deemed necessary during the year. All changes
to the manual will be submitted at least biannually to the
Council for approval.
ISSUES
The majority of the reVISions to the design manual were
removal of procedural information, which is covered in the
subdivision ordinance and/or the standard development
contract. Design standards were revised to correspond to
the subdivision ordinance. For example, buffer strip
requirements were added to the manual. Standard plates
were added for street and traffic signs. In addition, standard
details and specifications were revised to reflect the latest
industry standards.
There are three alternatives for the City Council to consider:
1. Approve a resolution approving the Public Works Design
Manual.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.
A motion and second to approve a resolution approving the
Public Works Design Manual.

keep up with changing technology, and

periodically.

requirements as well as technological changes, and
FURTHER, the Public Works Director and the City Engineer are directed to schedule
periodic review and approval of the document at least bi-annually.

CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE INITIATION OF
EMINENT DOMAIN PROCEEDINGS FOR THE PROPERTY REQUIRED FOR
RIGHT OF WAY FOR THE RING ROAD, CITY PROJECT NO. 01 - 01, LOCATED
AT 16760 TORONTO AVENUE, PID NO. 25 - 902 - 021 - O.
HISTORY: The proposed Ring Road project includes the construction of a new
"backage road" between Franklin Trail and CSAH 23 as shown on the attached
drawing. The road is to be constructed in three segments. Franklin Trail to Toronto
is to be completed next year together with the Crystal Care project. Segment 2 is
identified as City Project No. 01-01 which is the central segment of the proposed
street between Toronto and Duluth Avenues.
The construction of the central segment requires the acquisition of five properties.
We are in the process of discussing property acquisitions with each party. The
purpose of this item is to have the Council consider the initiation of eminent domain
(condemnation) proceedings for the acquisition of required right-of-way from the
property located at 16760 Toronto Avenue, PID No. 25-902-021-0, which we
believe cannot be reasonably acquired in any other manner.
CURRENT CIRCUMSTANCES: The plans for the project are about 90 % complete
and will be brought to the Council for approval next month. The plan includes the
street alignment previously discussed that creates a new parcel on the south side of
the Ring Road adjacent to Toronto Avenue, which is part of the Priordale Mall
property. The right of way needed for the Ring Road consists of 25,810 square feet,
plus a temporary construction easement of 5 feet on each side. The newly created
developable parcel is 47,115 square feet (1.08 acre), which meets our minimum lot
size for the zoning district.
We had an appraisal completed on the right-of-way parcel and the valuation is
$134,000 for the 25,810 square feet (sf) of right of way and $95,000 for
damages/severance, for a total of $229,000, exclusive of the newly created
developable parcel. Staff has made two written offers to the owner of the property,
TEP Systems, contingent on City Council approval, for $229,000 for the needed
right of way, the first on September 6 based on the preliminary design, and the
second on December 6 based on the final design. We received a counter offer of
$818,000 from TEP Systems on September 20, based on the City purchasing the
right of way at $7.50 per sf, plus the newly created developable parcel at $7.00 per
sJ., and $300,000 in damages. On December 10th, Mr. Boderman sent a second
letter saying essentially the same thing (attached).

If the value of $330,000 for the newly created developable parcel is taken out of the
counter offer, the total counter offer for the right of way and damages is $488,000,
which is a difference of $259,000 ($488,000 - $229,000). This is a difference of
113% from the value of the land and damages appraised by the City's appraiser. At
this point, it would appear that the City and TEP Systems are significantly apart on
the value of the land and the damages to the property.
CONCLUSION: We could continue to negotiate with TEP Systems for the property,
but I am sure that there will continue to be significant differences in opinion of the
value of the property needed for the project to continue. Therefore, we are
recommending that we move forward with eminent domain proceedings to acquire
the property in question.
For over 20 years, City Councils in Prior Lake have discussed creation of the ring
road. Little meaningful progress has been made until only recently when the Council
authorized design of this segment of the roadway, authorized completion of
appraisals and directed the staff to acquire the needed right-of-way.
Minnesota Statutes provide cities with the authority to acquire property for public
purposes such as roadway construction. One form of property acquisition is quick-
take eminent domain. This form of acquisition requires the city Council to adopt a
resolution which is filed in Court. The City is required to deposit a cash amount with
the Court equal to the appraised value of the property. Ninety days after the
resolution is filed and the deposit made, the title to the property becomes the City's.
A Court proceeding is subsequently conducted to determine the value of the
property acquired by the City.
The benefit of "quick-take" is that the City receives title to the property in 90 days.
This allows the City to proceed with road construction in 2002 as programmed in the
CIP and as anticipated by the developers of Crystal Care and the Post Office. The
disadvantage of "quick-take" is that the City cannot back out without paying the
Attorney and appraisal fees for itself and the other party.
It is apparent from the property owner's response that we will not reach a mutually
acceptable purchase price. The ring road will relieve traffic pressure from Highway
13 and provide immediate access to parcels within this commercial district. The ring
road will facilitate development and redevelopment of this commercial/retail area. If
the Council wishes to proceed with development this ring road in 2002, prompt
acquisition of this parcel is a must.
The acquisition of the parcel does not negatively impact the Priordale Mall parcel.
The subject property has remained vacant and unused as parking space. The
parking area is in need of significant repair and reflects years of neglect. This
acquisition will actually create a new developable partel for the property owner
abutting the ring road and Toronto Avenue.
ALTERNATIVES: The alternatives are as follows:
1. Approve a Resolution authorizing the initiation of eminent domain proceedings for
the property required for right of way for the Ring Road, City Project No. 01 - 01,
located at 16760 Toronto Avenue SE, PIO No. 25 - 902 - 021 - O.
2. Table the resolution for a specific reason.
3. Deny the Resolution.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA
that:
1. The recitals set forth above are incorporated herein.
2. The City Attorney is authorized to commence "quick-take" eminent domain proceedings pursuant to
Minnesota Statutes Chapter 117 to acquire the property described in the attached Exhibit "A".
3. The Mayor and City Manager are hereby authorized to execute all documents necessary in the
opinion of the City Attorney to effect the' acquisition of the necessary property interests.

Dear Mr. Osmundson:
Pursuant to your letter of December 6,2001, which contained an offer of $229,000 to acquire 25,810
square feet ofland located at 16760 Toronto Avenue (property ID# 25-902-021-0) plus a 5 foot right
of way on each side, please be advised that the Priordale Mall Limited Partnership has no interest
in selling the land at the above stated price. There must be further consideration for the peripheral
damages to the property.
As the General Partner of the Priordale Mall Limited Partners, I have discussed your offer with our
lenders and the Limited Partners of Priordale Mall. Though we have not done an appraisal of the
land and the shopping center, I have discussed valuations with various appraisers familiar with our
site. Priordale Mall is the largest zoned commercial shopping center in Prior Lake. The taking of
the proposed parcel would seriously restrict the future potential for redevelopment of the site, as well
as the leasing of space on the adjacent side of the center and the small separated freestanding parcel,
of 47,115 square feet realistically is unusable for retail.
We still believe that the land being taken at 25,810 square feet is worth between $7.00 and $8.00 per
foot.
The 47,115 square feet that would remain as a pad site on the other side of the road is not viable for
use. The collateral damage to the shopping center as it exists and the inability to redevelop the site
correctly, represents a reduction in the center's value of a minimum of$300,000.
Priorda1e Mall Limited Partnership suggests that the city acquire the 47,115 square feet at $7.00 per
foot, acquire the 25,810 square feet for the road at $7.50 per foot and award Priordale Mall $300,000
for the collateral damages the shopping center will sustain.

CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING STAFF TO
PREPARE PLANS AND SPECIFICATIONS FOR ATHLETIC FIELD LIGHTING
AT THE PONDS ATHLETIC COMPLEX.
History: The purpose of this agenda item is to authorize staff to prepare plans
and specifications for athletic field lighting at The Ponds Athletic Complex as
identified in the 2002 Capital Improvement Program (CIP).
Each year, the City Council adopts the CIP which includes funding for various
park improvement projects. To assure that the Council is aware of and supportive
of our major park improvement efforts, we are seeking approval to prepare plans
and specifications for the installation of athletic field lighting on field #7.
In addition, staff is requesting approval to include a light design for the
softball/youth baseball fields at The Ponds Athletic fields #1 and #2 in anticipation
of a possible future project (perhaps with the assistance of PLA Y funds).
To increase the utilization of filed #7 and fields #1 and #2, PLAY has made a
commitment to assist in funding the installation of lights on these fields. With
Council approval during the 2002 CIP budgeting process, fields #1 and #2 could
be lit in 2003. As a cost-saving measure, it makes sense to design fields #1 and
#2 at the same time as field #7.
Current Circumstances: The CIP identifies $75,000 for lighting field #7. Prior
Lake Athletics for Youth (PLAY) has committed to match or fund one-half of the
project. The total estimated cost to light field #7 including electrical design and
engineering is $138,000. This estimate would also include the design fees for
fields #1 and #2.
Conclusion: Staff is requesting that the Council approve the attached resolution
authorizing preparation of plans and specifications for lighting field #7, and
authorizing preparation of the design for lighting fields #1 and #2 at The Ponds
Athletic Complex. The plans and specifications will be presented to and
discussed in detail with the City Council for approval prior to bidding the project.
Staff intends to prepare plans and specifications similar to those prepared on the
existing lights that were installed at The Ponds in 1997. As with the past lighting
project, a commitment will be made that the field lights will be designed so that

the light is directed onto the fields to minimize the amount of light that would spill
into back yards of surrounding homes, or into the sky.
The other concern which preparing plans and specifications is to make sure we
are directing as much light as possible onto the fields and reducing the amount of
glare that players look into. This factor improves play and player safety.
FINANCIAL
IMPACT:
The funds for the lights will be drawn from the Parks portion of the CIP. The
project costs estimate for the lighting project is $138,000. The costs for
preparation of the plans and specifications will be drawn from the Park
Maintenance budget.
ALTERNATIVES:
(1) Approve Resolution 01-XX authorizing preparation of plans and
specifications to light field #7 and design lighting for fields #1 and #2 for
future construction.
(2) Table this item for a specific reason.

AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE PURCHASE
OF ONE (1) EIGHT-FOOT (8') FRONT-MOUNT SNOW BLOWER.
DISCUSSION: History: The purpose of this agenda item is to request the purchase of one (1)
new eight-foot (8') front-mount snow blower for $8931.09. There is $10,605
identified in the 2001 Equipment Fund and Matrix for the purchase of this piece
of equipment. The funding source will be drawn from the Public Works and Parks
portion of the Capital Improvement Program (CIP).
ISSUES:
Current Circumstances: Currently, to perform snow removal operations on City
trails and sidewalks, staff utilizes three one-ton trucks with plows, two Toros with
a broom and blower, one Holder sidewalk plow and one rear-mount blower on a
tractor. The blower we are requesting authorization to purchase is designed to
mount on the front of an existing City tractor and will be utilized to clear snow
from City trails that are adjacent to County roads and collector streets. During
heavy snow events in these areas, storage for snow becomes minimal. With the
aid of this blower, City crews can move snow effectively versus trying to push it
with pickups. This equipment would also be utilized on our City streets where
heavy drifting of snow occurs; and possibly for the downtown area where the
snow is piled into the center of the streets.
Conclusion: As the miles of trails and sidewalks increase in the community, the
purchase of this piece of equipment will help to improve our winter operations.
We currently plow approximately 26 miles of sidewalks and trails.
There is $10,650 (tax not included) identified for the purchase of one (1) 8' front-
mount blower in the Equipment Fund and Matrix. There is not trade-in on this
purchase.
After each snowfall, City and County streets and roads are plowed onto
boulevards and in many areas the trails and sidewalks are covered with as much
as 2 to 4 feet of snow. At times, removing this amount of snow becomes an
impossibility with pickup trucks. With the aide of a blower mounted on a tractor,
staff will be able to remove heavy, deep snow and direct it to desired places. The
blower will be especially effective wherever limited snow storage is available.

IMPACT:
Cost-Benefit Analysis: The City Council has set some guidelines for purchasing
equipment. The criteria and how this purchase addresses each is shown below.
Use Minimum Requirement Specifications, Not Listed Wants: The amount of
snow needed to be removed from City trails and streets and the size of the
tractor that it will be attached to dictates the type and size of the snow blower
needed to efficiently perform snow removal operations. The Erskine blower is
sized appropriately for the City's tractor.
Use Functional Requirements, Not An Individual Manufacturer's Specifications:
The specifications for this piece of equipment were prepared by the
manufacturer. Because of the simplicity of the blower, the specifications were not
deviated from. Snocrete submitted an alternate bid, but because of price, the
equipment is not recommended.
Receive Where PoSsible, Three Real Bids: Three quotes were received. There is
a $7318.68 difference from high to low.
Time for the City Council to Act: If the City Council desires additional information,
this item could be deferred. If possible, staff would like to take delivery as soon
as possible.

LABOR AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND
AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL
EMPLOYEES (AFSCME), COUNCIL 14, LOCAL 3884, FOR CLERICAL,
TECHNICAL AND MAINTENANCE EMPLOYEES
DISCUSSION: History: The AFSCME bargaining unit representing secretarial, clerical,
maintenance and technical employees of the City of Prior Lake was formed in
1993. At 41 members, they constitute the largest single union for City
employees. The existing labor agreement was a three-year agreement covering
the years 1999-2001. The negotiation process for 2002 and beyond began in
July. Six negotiation sessions and two mediation meetings were held to address
wages and conditions of employment in accordance with the Public Employees
Labor Relations Act (PELRA).
Current Circumstances: The principle objective in the negotiations has been
twofold: (1) to develop a long term agreement which will provide some level of
ongoing labor stability; and (2) to achieve an agreement which is reasonable
economically and prudent from a language perspective. The labor agreement for
which Council ratification is requested under this agenda item meets both criteria.
Proposed Amendments to the Agreement:

Holiday Pay

Sick Leave Buyout

practice that once an employee elects to
buy back his/her sick leave balance, this
election will continue until the employee
leaves the city.
Advancement through Steps
This is new language in the contract that
allows the Employer to advance
employees more than one step if
approved by the City Manager.
ISSUES:
With regards to wages, the City of Prior Lake has historically paid around the
average for similar sized cities within the metro area. This proposed agreement
is consistent with that philosophy. A 3% wage adjustment for each of the next
three years would place the City at the average wage paid by Stanton Group Six
cities. Market adjustments to the six positions listed above would align these
positions to salary ranges paid by cities comparable in size to Prior Lake.
Employees in the positions of Maintenance V and Accounting Clerk will move to
a higher grade and salary range. Employees in these two positions will be placed
into the new ranges by moving to the next highest step after receiving their 3%
annual adjustment and by moving an additional step on their position anniversary
date.
The $50 monthly increase or $520 a month city contribution for health insurance
is the same insurance contribution the Council has approved for the three other
unions. We are anticipating about a 10% premium increase for 2003 and 2004.

The proposed monthly increases of $25 ($545) for 2003 and $40 ($585) for 2004
are equitable and economically feasible for the City and the employees.
FINANCIAL IMPACT:
The two items of the proposed contract that will have the most fiscal impact are
wages and employer contributions towards health insurance. The total package
percentage increase for the proposed changes for 2002 is 6.11 % more than
wages and insurance paid as of December 31, 2001. The 6.11 % increase
includes the 3% annual adjustment, employee steps, market adjustments and the
$50 increase for health insurance. The 2002 operating budget has adequate
. funds to administer the contract including both wage increases as well as the
health insurance contribution.
CONCLUSION:
Labor agreements typically do not provide complete satisfaction to either party.
However, this agreement represents an equitable conclusion of bargaining as a
result of good faith efforts by both groups to reach an agreement that meets the
needs of both parties and allows us the opportunity to focus upon the issues at
hand for the next three years. If Council would like to review the Labor
Agreement with the proposed amendments, a copy is available in my office.

the Public Employees Labor Relations Act as amended requires that the City negotiate
with the exclusive bargaining representative for groups of essential and non-essential
employees; and
WHEREAS,
the American Federation of State, County and Municipal Employees Union represents
the Prior Lake maintenance, office and technical employees; and
WHEREAS,
negotiations have taken place which have resulted in an Agreement for 2002, 2003 and
2004; and
WHEREAS,
the employees who make up the this bargaining unit have ratified said Agreement; and
WHEREAS,
the Agreement becomes effective on January 1, 2002.
Now THEREFORE, be it resolved by the City Council of the City of Prior Lake that it hereby ratifies the

ADJUSTMENTS FOR UNREPRESENTED EMPLOYEES FOR 2002.
DISCUSSION: Historv: As the Council is aware, we have completed negotiations for all
bargaining units for the calendar year 2002. Historically, once union negotiations
have been completed and labor agreements approved, past City Councils have
deemed it appropriate to take action on salary adjustments and benefits for
nonunion employees. The positions included in this group are finance director,
accounting supervisor, executive secretary and assistant city manager.
Current Circumstances: The City's pay plan for unrepresented employees
consists of three parts: (1) Salary ranges (2) Performance base wage
adjustments, and (3) benefits. The proposed adjustments to each and rationale
are shown below:
1. Salary Ranqe Adjustments:
a) The finance director and assistant city manager salary ranges need to be
adjusted the same percentage amount as the City Council approved for
supervisory positions for 2002 since these two positions fall into the same
pay grades. Therefore, the salary ranges should be increased by 2.75% for
2002.
b) The accounting supervisor and executive secretary salary ranges should be
adjusted by the same amount that the Council approved for the AFSCME
union positions of the same pay grade. Therefore, the salary ranges should
be adjusted by 3 percent. Please note that adjustments to the salary range
do not normally affect actual wages.
2. 2002 Waqes: Nonunion employees would receive an actual wage increase of
0% to 7% based on the employee's performance for the past twelve months. The
increases would be effective January 1, 2002.
3. 2002 Benefits: I would also recommend that the City's contribution for health
insurance be consistent with those approved for union employees for 2002 or
$520 a month.
