HomeMy WebLinkAbout11-097 Eastwood 3rd Addition Plat 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 11 - 097 A RESOLUTION APPROVING THE COMBINED PRELIMINARY AND FINAL PLAT OF “ EASTWOOD 3 RD ADDITION ” AND SETTING FORTH CONDITIONS TO BE MET PRIOR TO RELEASE OF THE FINAL PLAT Motion By: Erickson Second By: Hedberg WHEREAS, The Prior Lake Planni ng Commission c onducted a public hearing on June 13 , 20 11 , to consider an application from Cygnus Construction for the combined preliminary and final plat of “ Eastwood 3 Addition ”; and rd WHEREAS, Notice of the public hearing on said combined preliminary and final plat has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS, All persons interested in this issue were afforded the opportunity to present their views and objections relate d to the combined preliminary and final plat of “ Eastwood 3 Addition ” for the rd record at the public hearing conducted by the Planning Commission; and WHEREAS, The Planning Commission and City Council have reviewed the combined preliminary and final pla t according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said combined preliminary and final plat to be consistent with the provisions of said ordinances; and WHEREAS, The Prior Lake City Council considered a n application for combined preliminary and final plat approval of “ Eastwood 3 Addition ” on August 1 5 , 2011 ; and rd WHEREAS, The City Council has the authority to impose reasonable conditions on a combined preliminary and final plat. NOW THEREFORE , BE I T HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOT A as follows: 1. The recitals set forth above are incorporated herein. 2. The preliminary plat of “ Eastwood 3 Addition ” is approved subject to the conditions set forth in this resolution : rd 3. The final p lat of “ Eastwood 3 Addition ” is subject to the following conditions, which shall be met prior to rd release of and recording of the final plat: a) The applicant shall address all engineering comments as outlined in the Engineering Dep artment Memorandum dated A ugust 10 , 2011. b) The applicant shall enter into a development contract with the City and pay all applicable development fees. c) The applicant shall obtain required permits from all applicable governmental agencies prior to final plat approval. d) The final plat shall be recorded at Scott County within 60 days of approval by the City Council.
