History
The area known as Frog Town underwent infrastructure
improvements as part of the City's 2001 Capital Improvement
Program. The project area is located between Credit River Road
on the south, C.R. 44 on the north, T.H. 13 on the west and Jordan
Avenue on the east. Barbarossa & Sons was awarded the contract
in the amount of $1,644,448.55. Change order #1 in the amount of
$4,250.00 was approved on July 2,2001.
Runoff from the project area flows west into a land-locked basin,
MnDNR Wetland #169 located in Lakefront Park. An outlet for
the wetland was constructed in conjunction with the Frog Town
project. Change order #1 approved construction of an outlet
structure on the outlet pipe in order to meet Prior Lake Spring Lake
Watershed District requirements.
Current Circumstances
The outlet pipe was installed using directional drilling methods by
Earth Burners, Inc. (EBI), a subcontractor to Barbarossa & Sons.
EBI is requesting a change order due to a change in conditions. As
their September 14, 2001 letter states, during the drilling
operations, they encountered rocky, gravelly and sandy soils versus
the lean clay that was indicated in the soil boring that was provided
with the specification. Due to the change in conditions, additional
drilling additives as well as additional labor was required in the
amount of$7,552.84.
Council was originally notified on December 27, 2001 that EBI
had requested an additional $8,757.77, but through negotiations
staff was able to reduce the request to $7,552.84.

Conclusion
The staff believes it is appropriate for the City Council to approve
the change order based on the change in conditions.
The original contract was $1,644,448.55. Change Order No.1 and
Change Order No.2 increase the contract to $1,656,251.39. This is
less than 1 % above the original contract amount. Funding for this
change order is proposed to be from the Trunk Reserve fund due to
the fact the extra work was required in conjunction with trunk
storm sewer installation.
The alternatives are as follows:
1. Adopt a resolution approving Change Order No.2.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

WHEREAS, Barbarossa & Sons, Inc. was awarded the contract for construction of 2001
Improvements, City Project 01-11, and
WHEREAS, During installation of the storm sewer outlet in Lakefront Park, the subcontractor
encountered a change in conditions due to subsurface soil types, and
WHEREAS, The change in conditions required additional materials and labor to be used to
complete the work, and
WHEREAS, The contractor has requested $7,552.84 for the additional work over and above the
original awarded contract amount, and
WHEREAS, The City Engineer recommends approval of Change Order No 2.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. Change Order No. 2 is hereby authorized to be made to Barbarossa & Sons, Inc. in the
amount of $7,552.84 to be paid from the Trunk Reserve Fund, for the contract to construct
2001 Improvements, City Project 01-11.

EBI is requesting a change order to cover to costs incurred due to the substantially different drilling
condiri"ons encountered on work for the above referenced project. The rocky, gravelly and sandy

JOINT POWERS AGREEMENT REGARDING THE REGULATION OF
TELECOMMUNICATION FACILITIES IN COUNTY ROAD RIGHT-OF-WAY
WITHIN THE CITY LIMITS OF PRIOR LAKE
PURPOSE
The purpose of this Agreement is to establish the authority of the County of Scott, State
of Minnesota, to regulate the placement and operation of telecommunications facilities
within the various rights-of-way of County roads located within the City of Prior Lake,
Minnesota.
RECITALS
Whereas; Minnesota Statutes 471.59 provides that two governmental units may, by
agreement, cooperatively exercise any power common to both parties and further, that
one governmental unit may exercise such power on behalf of the other governmental unit,
and
Whereas; Minnesota Statutes 471.59, Subd. 8 specifically provides that any County may
enter into agreements with any other governmental unit to perform on behalf of that unit
any service or function which that unit would be authorized to provide for itself, and
Whereas; Scott County and the City of Prior Lake each have zoning authority under
Minnesota Statutes 394.21 and 462.357, respectively, and
Whereas; both the County and City have adopted ordinances regulating the location of
telecommunication facilities, and
Whereas; because the County is the road authority for County and County State-Aid
highways pursuant to Minnesota Statutes 160.02 and the City believes it is inappropriate
for the City to have approval authority for construction of structures in the County right-
of-way, and
Therefore, it is agreed as follows:
1. The recitals set forth above are incorporated herein.
2. The City agrees that Scott County may exercise its' zoning authority within the
public rights-of-way of County State -Aid roads and County roads within the City

limits of Prior Lake solely with regard to the regulation and permitting of
telecommunications right-of-way users as the terms public right-of-way and
telecommunications right-of-way user are defined in Minnesota Statutes 237.162
Subd. 3 and SubdA.
3. This Agreement may be rescinded upon mutual agreement of the parties. In the
event the County adopts an ordinance regulating the use of County right-of-way
that is significantly different from the City Right-Of-Way Management Ordinance
(City Code Section 701.700), the City reserves the right to unilaterally rescind this
Agreement.
