SUBJECT: CONSIDER APPROVAL OF RESOLUTIONS: (1) APPROVING tHE PLANS
AND SPECIFICATIONS FOR THE RING ROAD PHASE 2, CITY PROJECT
NO. 01 - 01, AND APPROVING A CHANGE ORDER FOR ENGINEERING
FEES; (2) AUTHORIZING THE PLACEMENT OF NO PARKING SIGNS ON
THE RING ROAD; (3) TO HOLD HARMLESS THE STATE OF MINNESOTA
FOR A VARIANCE FROM A STATE AID DESIGN STANDARD
DISCUSSION: HISTORY: The proposed Ring Road project includes the construction of a
new "backage road" between Franklin Trail and CSAH 23 as shown on the
attached drawing. The road is to be constructed in three segments. Franklin
Trail to Toronto is to be completed in 2002 together with the Park
Nicollet/Crystal Care project. Segment 2 is identified as City Project No. 01-
01 which is the central segment of the proposed Ring Road between Toronto
and Duluth Avenues. The third segment is proposed to be included with the
project which will realign CSAH 23 (Panama Ave.) at the intersection with TH
13, scheduled in our CIP for 2004.
The Feasibility Report for the proposed project was approved and the plans
and specifications were ordered on March 19,2001. On May 7,2001 the
City Council approved the incorporation of the regional pond design into the
Ring Road project. Most recently, the City Council took action to begin
eminent domain proceedings to acquire part of the necessary right of way for
the proposed street from one property owner, and approved the conveyance
of the property for the regional ponding site to the City.
The purpose of this agenda item is to consider three resolutions that must be
undertaken to proceed with the Ring Road project. The first resolution is to
approve the plans and specifications so that they can be sent to MnDOT
State Aid for review. This resolution also authorizes a change order to the
consulting engineering contract necessitated by project design scope
changes. The second and third resolutions are required for State Aid
approval. The second resolution restricts parking on the proposed street and
the third resolution is to indemnify the State for the variance from State Aid
design rules.
CURRENT CIRCUMSTANCES:
Plan Approval: The plans for the project are complete and a set of plans will
be available at the meeting. The plan includes the street alignment
previously discussed that creates a new parcel on the south side of the Ring

Road adjacent to Toronto Avenue, which is part of the Priordale Mall
property. City Manager Boyles and I met with the property managers of the
Priordale Mall, which is in receivership. The property managers were not
aware of the City's offer for the right of way, or that the City had begun
eminent domain proceedings. They will study the offer and will get back to
us in early March on whether or not they would accept our offer of $229,000
for the right of way.
The design also includes the revised alignment intended to significantly
reduce the impact on the Borka property, which was discussed at the City
Council workshop on January 22. This alignment puts the roadway as far
from the Borka building as possible, and maximizes their parking area. We
have arranged a meeting with the Borkas on the 20th to discuss the design
changes and our proposal.
Engineering Fees: This project has had many design changes and has
required many additional drawings for parking lots for various property
owners affected by the proposed roadway. The engineering consultant,
WSB & Associates has also assisted staff on the State Aid variance request,
the Watershed District's requests (infiltration and the regional pond), and
meeting with various property owners to try to acquire the right of way. In
short, they have gone well beyond the scope of the original proposal. WSB
has therefore requested a change to their fees for the project as outlined in
the attached letter, from $64,000 to $82,600. A design fee of 10% is not
unrealistic for a project of this type. The total estimated construction cost of
the project is $816,000; at 10% the design fee would amount to $81,600.
Additionally, WSB has included in their fees all of the easement legal
descriptions for land acquisitions, which are normally done on an hourly basis
outside of the design fees. There are sufficient funds in the project account
for this purpose. Therefore, staff is recommending that the Council approve
the increase in fees.
Parking and Indemnification: The City Council took action on December 4,
2000 to request a variance from State Aid Design standards that require a 30
mph design for the entire alignment. This variance request for 25 mph
curves at the Duluth Avenue intersection and the Tower Street intersection
minimized the property required for ROW from the bank, hardware store, the
proposed post office and a private home. The State granted our request with
conditions including the parking restriction and indemnification resolutions
(letter attached). To allow parking on the street would have required that the
street be 20 feet wider, which would expand the right of way an additional
twenty feet, and made property acquisition even more expensive. The two
resolutions are required for State Aid approval and to allow the City to use
Municipal State Aid (MSA) funds to construct this road.
CONCLUSION: We will continue to negotiate with the property owners for
the right of way needed for the project. The action required tonight is just
one more step needed to move forward with the project.

attached hereto and made a part hereof, are hereby approved.
2. The City approves the increase in engineering fees for the project to a total not to exceed $82,600,
which is to come from the Trunk fund.

The City has planned the improvement of S.A.P. 201-113-02, the Ring Road
from 200 feet east of Toronto Avenue to 200 feet west of the intersection of
the Ring Road and Tower street; and
WHEREAS,
The City will be expending Municipal State Aid Funds on the improvement
of this street; and
WHEREAS,
This improvement does not provide adequate width for parking from station
56+50 to station 71+29 on either side of the Ring Road.
NOW THEREFORE, BE IT RESOLVED ~Y THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the City shall ban the parking of motor vehicles on both sides on MSAS 113
Ring Road at all times within the limits, as described above.

Road from 200 feet east of Toronto Avenue to 200 feet west of the
intersection of the Ring Road and Tower street; and
WHEREAS,
The City will be expending Municipal State Aid Funds on the improvement
of this street; and
WHEREAS,
The City applied for and received a variance from the Minnesota Rule
8820.9936 requiring a horizontal design speed of 30 mph subject to the City
indemnifying the State of Minnesota from any claims arising out of the
granting of the variance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the City indemnifies, saves, and holds harmless the State of Minnesota and
its agents and employees of and from any and all claims, demands, actions or causes of action
arising out of or by reason of, the construction project on Ring Road in the City of Prior Lake in
any manner other than in accordance with Minnesota Rules 8820.9936 and further agrees to
defend at their sole cost and expense any action or proceeding commenced for the purpose of
asserting any claim of whatsoever character arising as a result of the granting of this variance.

The purpose of this letter is to request additional compensation for engineering services related
to the Ring Road project due to changes in scope or additional services requested.
Currently, the total contract with WSB consists of the following items:

There are a couple of items that have been added or modified that have increased our cost and

1. Revising the Ring Road alignment at the City's request:
An alternative alignment was developed that brought the Ring Road closer to the
Priordale Mall to create a 1.0-acre buildable parcel on the south. This alternative
resulted in changing the final alignment, layout and drawings, and also revising the
easement drawings.

Dear Mr. Osmundson:
Based upon the recommendation of a Variance Advisory Committee appointed
expressly for the purpose of recommending to me the validity of the City's request
for a variance from Minnesota Rules 8820.9936, adopted pursuant to Minnesota
Statutes, Chapters 161 and 162, as they apply to a construction project on Ring
Road, so as to permit a horizontal design speed of 25 mph in lieu of the required 30
mph design speed where Ring Road intersects with both Tower Street and Duluth
Avenue in the City of Prior Lake, Minnesota; I hereby GRANT the variance.
Approval of this variance is conditional upon:
~ restriction of parking as necessary to allow sight distance appropriate for 30 mph
through the curves;
~ providing a center turn lane throughout the length of the curves;
~ providing right turn lanes where needed and feasible;
~ providing appropriate signage in accordance with the MMUTCD;
>- submittal of a resolution passed by the City Council that indemnifies, saves, and
holds harmless the State of Minnesota and its agents and employees of and
from any and all claims, demands, actions, or causes of action arising out of or
