MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: SEPTEMBER 6, 2011 AGENDA #: 5F PREPARED BY: JEFF MATZKE, PLANNER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION TO APPROVE A REGISTERED LAND SURVEY INVOLVING TWO SINGLE - FAMILY RESIDENTIAL PROPERTIES LOCATED ALONG 150 STREET NE DISCUSSION: Introduction David Coker & Carter Christie have applied for the approval of a Registered Land Survey on approximately 1.5 acres of land. The properties are located along the shores of Lower Prior Lake at 5994 & 6002 150 Street NE, west of Pixie Point Circle and east of Lori Road. Hi story The applicants are proposing to transfer a 7,464 square foot area of land from the property located at 5994 150 Street to the property located at 6002 150 Street. The proposed survey requires variances from the minimum lot width. These variances were approved by the Planning Commission on August 22, 2011. The Planning Commission held a public hearing to consider the registered land survey at their meeting on August 22, 2011. At that meeting the Planning Commission recommended approval of the registered land survey (minutes attached). Current Circumstances The applicants are proposing to transfer a 7,464 square foot area of land from the property located at 5994 150 Street to the property located at 6002 150 Street. Typically this process is handled through an Administrative Land Subdivision; however, at the request of the County Auditor's Department and due to the fact that the property has been segmented in the past and is Torren's property, a registered land survey request is being processed to handle the land transfer. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS: Total Site Area: The total site area consists of 1.5 acres. The current properties contain two single - family home structures. Wetlands: No wetlands are located on the properties. Phone 952.447.9800 / Fax 952.447.4245/www.cityofpriorlake.com Access: Access to the properties is currently from 150 Street NE 2030 Comprehensive Plan Desionation: The properties are designated R- LD for Urban Low Density Residential uses on the 2030 Comprehensive Plan Land Use Map. Zoning: The properties are located within the R -1 Zoning District (Low Density Residential). The R -1 district is consistent with the proposed R -LD designation. This district permits a maximum density of 4.0 units per acre. Shoreland: The properties are located within the Shoreland District of Prior Lake and are subject to the City's Shoreland Ordinance. PROPOSED PLAN Lots: The proposed registered land survey consists of 2 lots for single family dwellings. Tract A is 41,512 square feet, Tract B is 21,613 square feet. The minimum required lot width for a riparian lot is 15,000 square feet and 12,000 square feet for a non - riparian lot. Streets: The proposed lots have frontage on existing 150 Street NE. No new streets are proposed. Sanitary Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in place for both existing residential properties. Shoreland Ordinance: The proposed registered land survey is located within the Shoreland District for Prior Lake and therefore the properties are required to meet the requirements of the Shoreland Ordinance including but not limited to a maximum impervious surface area of no more than 30% of the total lot areas. The proposed lots will meet the Shoreland Ordinance requirements. Conclusion The applicant proposes to designate the two residential properties as a registered land survey. The registered land survey will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. ISSUES: The applicants are proposing to transfer a 7,464 square foot area of land from the property located at 5994 150 Street to the property located at 6002 150 Street. City Staff and the Planning Commission recommend that the City Council approve the registered land survey subject to the outlined conditions: 1. The registered land survey approval is subject to the recording of approved variances documents from the minimum lot width, which the Planning Commission approved on August 22, 2011. 2. The applicant must provide proof of installation of all subdivision monumentation within one (1) year from the date of recording the registered land survey, or prior to issuance of a building permit, whichever occurs first. 3. The applicant shall obtain any applicable required permits from all applicable governmental agencies. 4. The registered land survey shall be recorded at Scott County within 60 days of approval by the City Council. Failure to record the documents by November 6, 2011, will render the registered land survey null and void. FINANCIAL There is no budget impact as a result of this action. Approval of the project will IMPACT: allow for an area of land to be transferred from one property to the adjacent property. ALTERNATIVES: The City Council has the following alternatives: 1. Adopt a resolution approving the Registered Land Survey subject to the listed conditions, with the finding that the registered land survey is consistent with the intent and purpose of the Zoning and Subdivision Ordinances. 2. Deny the Registered Land Survey on the basis it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances and /or the Comprehensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of these requests. 3. Defer consideration of this item and provide staff with specific direction. The Planning Commission and staff recommend Alternative #1. RECOMMENDED 1. August 22, 2011 Planning Commission Minutes PR1p\ ti U trf �IMvESO'�/ 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 11 -XXX A RESOLUTION APPROVING A REGISTERED LAND SURVEY FOR TWO SINGLE FAMILY RESIDENTIAL PROPERTIES ALONG 150th STREET NE AND SETTING FORTH CONDITIONS TO BE MET PRIOR TO RELEASE OF THE REGISTERED LAND SURVEY Motion By: Second By: WHEREAS, The Prior Lake Planning Commission conducted a public hearing on August 22, 2011, to consider an application from David Coker and Carter Christie for registered land survey; and WHEREAS, Notice of the public hearing on said registered land survey has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS, All persons interested in this issue were afforded the opportunity to present their views and objections related to the registered land survey for the record at the public hearing conducted by the Planning Commission; and WHEREAS, The Planning Commission and City Council have reviewed the registered land survey according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said registered land survey to be consistent with the provisions of said ordinances; and WHEREAS, The Prior Lake City Council considered an application for such registered land survey on September 6, 2011; and WHEREAS, The City Council has the authority to impose reasonable conditions on a registered land survey. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The registered land survey is approved at properties located at 5994 150th Street NE and 6002 150th Street NE subject to the conditions set forth in this resolution. 3.
