CONSIDER APPROVAL OF THE 2001 VARIANCE
SUMMARY REPORT
History: The purpose of this item is to review the 2001 variance
summary report. This report summarizes the variance activity in the
past year, and is intended to provide useful information when
reviewing the need for ordinance amendments or other variance
requests.
The following table is a summary of variance activity for 2001, and a
comparison of activity for the previous 4 years.

Note: If an applicant requested a variance and the Planning Commission approved a
reduction of the original request, then it is represented as one approved request and
one denied request in the tables.
Table 2 compares the specific types of variance requests in 2001 to the
requests for the four preceding years. It should be noted that a new
Zoning Ordinance was adopted in 1999, eliminating the need for some
variances and creating the need for others.

Attached to this report as Exhibit A is Table 3, which details the
specific variances requested in 2001.
In 2001, the majority of the requests were for variances to setback
requirements, including front yard, side yard and lakeshore setbacks.
Setback variances were followed by requests to exceed the maximum
allowed impervious surface. It is also noteworthy that in 2001, all but
two of the properties for which variances were requested were located
in the Shoreland District. Of these lots, only two were not adjacent to
the lake; all of the others were riparian lots. The conclusion that can
be drawn from these facts is that the majority of variances considered
by the City are for infill development or redevelopment of existing
lots.

In 2001, the City adopted 2 amendments to the zoning ordinance that
may affect variance requirements. These amendments are as follows:
1. Ordinance No. 01-06 amending Section 1104.309 to permit one
detached 240 square foot accessory structure per island lot on
general development lakes subject to the issuance of a building
permit.
2. Ordinance No. 01-07 amending Section 1107.816 raising the
monument sign height from 10' to 20' in commercial and
industrial subdivisions with frontage along TH 13, CSAH 42, or
CSAH 21.
The two ordinance amendments adopted in 2001 were intended to
address some specific issues. While the amendments may help to
reduce the total number of variance applications, it is unlikely these
amendments will have a broad effect.

summary report on February 25, 2002. The Planning Commission
concluded that the variances requested were site specific. At this time
there is no need to amend the Zoning Ordinance to address a recurring
Issue.

approval of this report.
The City Council has two alternatives:
1. Approve the variance summary report as part of the consent
agenda.
2. Provide the staff with additional direction.
The staff recommends Alternative # 1.
A motion and second to approve the variance summary report as part
of the consent agenda is required.
