PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION
ORDERING THE 2002 IMPROVEMENT PROJECT AND PREPARATION OF
PLANS AND SPECIFICATIONS.
HISTORY
On June 18, 2001, Council adopted Resolution 01-75 ordering the preparation of
a feasibility report for those projects in the 2002 Capital Improvement Program
(CIP) required to follow the Minnesota Statutes Chapter 429 process. The
projects studied in the report includes Pixie Point Circle, Green Oaks Trail, Lori
Road and Estate Avenue. The recommendation of the feasibility report was to
proceed with this project. On February 19, 2002, Council adopted Resolution
02-27 accepting the feasibility report and calling for a public hearing on March
18, 2002 for the 2002 improvement project.
CURRENT CIRCUMSTANCES
The purpose of the Public Hearing is to determine if plans and specifications
should be prepared for Council consideration. The Public Hearing will cover the
reconstruction of Pixie Point Circle, Green Oaks Trail, Lori Road and Estate
Avenue including sanitary sewer, water main, storm sewer, aggregate base,
concrete curb and gutter, bituminous surfacing, and appurtenant work.
Details of the project and proposed financing will be presented to the public at
the hearing.
Financing of the improvements is recommended as follows:
Assessments $366,565.00
Tax Levy $549,848.00
Utility Fund $272,097.00
Project Total Cost $1,188,510.00
The properties abutting the streets located in the project area are subject ~o
assessment. Each of the affected property owners has been notified in
accordance with the statute prior to the Public Hearing.
ISSUES
A Public Informational Meeting was held on February 5, 2002 to provide the
property owners an opportunity to discuss the project in an informal setting prior
to the Public Hearing. Thirty (30) residents representing twenty-three (23)
properties attended the meeting. Councilmembers Petersen and Zieska were

also present. Staff presented the proposed improvements, project costs,
estimated assessments and answered questions. In general, the need for the
project appears to be understood by the residents. Concerns that were brought
up both at the meeting and subsequent conversations are as follows:
. Parking on Pixie Point Circle - Attached is a petition signed by 28
residents representing a possible 18 out of the 29 properties that are
proposed to be assessed (62% of Pixie Point residents) who wish to have
the no parking signs removed from both sides of the street. Staff has also
contacted by 6 residents who are opposed to the petition and want the
"no parking" restrictions to remain.
. Storm sewer easement on Estate Avenue - Staff has contacted several
property owners but has had no success to date to obtain an easement
for the storm sewer outlet.
. Road realignment resulting in loss of trees and landscaping - Staff 'is
proposing to construct all of the roads to the same width and alignment
as the existing roadways.
The City staff will be prepared to discuss each of these concerns at the hearing.
If, in the council's judgment, the issues should be addressed in the plans and
specifications, direction could be given to staff.
The purpose of this public hearing is to determine whether the project should
move forward to the next step, which is preparation of plans and specifications
which will provide greater information about expected project cost and, therefore,
the assessments associated with these improvements. Once the plans and
specifications are completed, they are submitted to the City Council for approval.
At the same time approval is sought to advertise for bids, the Council could
decide not to continue with the project upon receipt of bids. A separate
assessment hearing will be conducted following review of the proposed
assessments by the City Council's Special Assessment Committee.
CONCLUSION
The project is feasible from an engineering and economic standpoint. If the
preparation of plans and specifications is approved, the work will be completed
by City staff.
There are three alternatives for the City Council to consider:
1. Conduct the Public Hearing and approve a resolution that orders the 2002
Improvements and authorizes City staff to prepare plans and specifications.
2. Deny this item for a specific reason and provide staff with direction.
3. Table this item until some date in the future.
A motion and second to adopt a resolution ordering the 2002 Improvements and

WHEREAS, on February 19, 2002, the City Council adopted Resolution 02-27 accepting the
Feasibility Report and calling for a Public Hearing to be held on the 2002 Improvement
Project which includes the reconstruction of Pixie Point Circle, Lori Road, Estate
avenue, and Green Oaks Trail sanitary sewer, water main, storm sewer, aggregate
base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and
the hearing was held on the 18th day of March, 2002, at which time all persons
desiring to be heard were given an opportunity to be heard thereon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements
delineated in City Council Resolution 02-27 adopted February 19, 2002.
3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer
shall prepare plans and specifications for the making of such improvements.

TO THE CITY COUNCIL:
Attached is a petition from the majority of the people living on Pixie Point
Road in regards to PARKING ON THE STREET.
The majority of us would like to see parking ALLOWED on Pixie point for the
following reasons.
1) There was never a majority polled about the parking issue when a past council
decided to put up "No parking" signs. This was done due to a complaint of a
neighbor who was parking his landscape truck continually on the street. Neither
this said neighbor nor the complainer lives any longer on the street.
2) Since that time the city says it's for safety reasons but we don't believe that is true.
Although the street is only 24 ft wide there should still be room to park at least on
ONE SIDE OF THE STREET. It is common sense that one wouldn't park on the
curves but if the city would like they could designate these as no parking areas as
well as designating which side can have parking. The majority does not care but
we do feel that parking should be available. We cannot expect visitors to park on
l50th and walk when the street is in a "U" shape, especially when many of us have
elderly people in our lives.
3) We are not a THROUGH street! Therefore we believe that the only traffic would
be our fellow neighbors and lor their guests or service people. So parking on the
street would NOT be constant. We have all gone through a number of summers
with major house construction on this block. Many trucks and construction
workers cars were parked all over the street even in NO PARKING
Areas and we all managed to drive around them without incident, therefore we
believe that parking can occur without undue peril.
4 ) We are the ones who are paying for this street wi th much tax dollars and feel that
. we should have the right to park on a street that w~ have paid for. It is
inconceivable to some of us that others would make a decision that affects our
lives without our input, especially when they don't even live on the street!
5) We were willing to work with the city planners. We don't have to have ovemight
parking if you feel it would be dangerous. Again, one side of the street could be
designated parking if the city wants that. We were also willing to have some
DESIGNA TED SPOTS, but we were told the city would have to buy up some
property. Also with the "U" shaped road, ifparking was designated on one side of
the U, then the other side would be disadvantaged.
6) We originally came up with the idea of having it ONE WAY (preferably east to
west) and started the pebtion with that in mind. But in talking to neighbors, some
were animate about taking the signs down, so we devised a second petition on
that issue and brought both around the neighborhood as options. (6 people signed
the ONE WAY petition and 28 signed the one to take the signs down totally.
7) Only 4 people were opposed to taking the signs down, and one of those people
wanted it a ONE WAY and then would be ok with parking. One was afraid that
snowmobilers would park on the street, which we don't think would happen. Two
had enough space in their driveway so they didn't want to get involved or had
other more pressing issues about the street.
8) There were 5 residents who were not home any of the 3 times we walked the
petition around. Some are out of town for a while.Unfortunately, due to a time
frame we had to get this petition in we could not get a hold of them.

RE: Pixie Point Circle Improvements
Sue,
I would like the council to consider a safety issue near our home, while working
on the improvements to Pixie Point Circle. I have sent a map to aid in
understanding.
Currently, you will see the waterflow from the higher areas of Pixie Point follows
a path between 14891 and 14873 Pixie Point South then East onto 150th St.
The flow of water is such a volume that it creates a river of water and the current
grade of Pixie Point does not allow it to drain well. With freezing and thawing,
this creates a treacherous area at the intersection of Pixie Point and 150thSt, as
well as on 150th( a hill at that area).
The school bus picks up near this comer also.( scares me with so many kids
around).
Ideas I would like you to consider:

2. Add a storm drain on Pixie point between 14873 and 14891 Pixie Point to
accommodate -the run off without flooding the intersection. .

sewer system. .
