The lot was given to the public via warranty deed about 30 years ago. Glenn Kessel has reviewed this situation and has determined that all the lot owners in Grainwood West - aOO the Rep1at of Outlot A of Grainwood West have Undivided rights to this lot. The City has never accepted this lot nor maintained it aOO therefore share nor have artj rights. The total n1.JDber of lots having an undivided interest totals 29. The Kennedy's who live on Lot 2 adjacent to the east have encroached on Lot 1. Their crushed rock driveway encroaches by about 9 feet. In the spring of this year they 1aOOscaped the front of the lot with tinbers and plant material. A deck extema into the lot by about 5 feet. ~ deck was built by Lar~ Gensner without proper- pemdts prior to the Kennedy's acquisition of the prqlerty. A ntlllber of backlot owners have been using the subject site for lake access aOO dOCking of boats. If appears to me that the landscaping triggered their desire for city involvement. All of a sudden the parking area and deck are being resurrec:t~ to build a stronger case. The Kennedy's - are not willing to C<>q)erate. in their efforts to resolve matters. To seek help the backlot amers are turrrl.ngto city. GleIm has stated that the encroachment is a private matter between the backlot owners and Kemedys. On the other hand he believes we could take action against the Kenndy's to correct the encroachment in accordance to Section 7.11 of the Zoning Ordinance. Otijer General ~ervations and Facts: 1. The backlot owners are frustrated and WlOrganized and probably not willing to expend furXis for legal CoUncil to litigate the matter. 2. RarXJy ~horst is the leader of the group that appears to total 8-12 meuters. 3. Other lakeshore owners in the circle side with the backlot amers. 4. The backlot owners fear adverse possession. 5. I denied a building pemdt to Randy :t.aBJhorst for a picnic shelter.. The reason for denial was that he must ootain all signatures of amers in the two plats or represent a formal haneowners group. 6. There have been sane unpleasant confrontations between Langhorst and Jeff Kennedy. 7. There is a stonn sewer in this lot. Christine E. Hannen, unmarried, Grantor, and "to the Publiq" , Grantee, of Lot 1 of Grainwood Park. It is also our understanding that the City of Prior Lake has never laid any claim to Lot 1 of Grainwood Park nor made any improvements to it nor maintained said real property and as such has not accepted the property on behalf of the public. Based upon a review of those documents and our understanding of the facts, it is our opinion that the fee owners of the lots located within the Plat of Grainwood Park and the Subdivision of Outlot A, Grainwood Park, are the benefited property owners of Lot 1, Grainwood Park which has been deeded "to the Public". The public, until accepted for use of the general public at large by the City of Prior Lake, are the lot owners of the lots in the Subdivision of Grainwood Park and Outlot A, Grainwood Park_ As such lot owners, they have the right to the beneficial use and enjoyment of Lot 1. Presumably the lot was dedicated to the public for lakeshore access by all the lot owners within the platted subdivision. - ~ /0 ........--- ( '- (: Mr. Horst Graser -2- November 12, 1987 It is our understanding that a lot owner adjacent to Lot 1 has constructed improvements encroaching upon Lot 1, Grainwood Park, and has been using part of Lot 1, Grainwood Park, for his own use and enjoyment without obtaining 'a City building permit. An additional question has been raised by you as to whether or not that lot owner can with the passage of time acquire fee title by adverse possession to Lot I, Grainwood Park. Title to real estate dedicated or appropriated to public use cannot be acquired by adverse possession. Minnesota statute ~541.01, Fischer v, City of Sauk Rapids, 325 N.W.2d 816 (Minn. 1982). However, this absolute rule does not preclude recovery in some rare cases where because of nonuse and an unequivocal act of abandonment over a long period of time, the equitable doctrine of estoppel could be used against the City. See City of Rochester v. North Side Corporation, 1 N.W.2d 361 (1961); Fischer v. City of Sauk Rapids, supra. To preclude the above assertion, we would recommend that the City enforce the criminal penalties for violation(s) of the Prior Lake City Code by the adjacent property owner. This would satisfy the subdivision lot owners"concerns as well as keeping the City's options open as to possible future general public use of Lot I, Grainwood Park. Depending upon the outcome of the criminal pro- ceedings, the City may also seek an injunction to enjoin the eqcroachments and adverse use of the lot, Otherwise, there is a risk of an estoppel argument being made against the City for abandonment or nonuse at some time in the future by said land- owner. If the Council, after consideration of the property, believes that there is no general future public interest or use in said lot, then the only decision to be made is to enforce the building permit and other ordinance violations against the adjacent lot owner. Any damages sustained to the lot owners of the Subdivision of Grainwood Park and Outlot A, Grainwood Park, and remedies available to them, would be a private civil matter to be dealt with by those owners. In short, the proposal would. allow my property located at Lot 2, Grainwood Park, a sufficient. amount of property to place a single car garage on said property that would extend to a point somewhere near where my present deck is on the westerly portion of said- property. I then would proceed to maintain an action in District:tourt, Scott County First Judicial District to either Quiet Title or to register the property in compliance with Minnesota Statutes to allow my property extension, as well as registering and placing title in the Grainwood Park residents to the remaining 40 feet of Lot 1, Grainwood Park, for their continuing use and enjoyment forever. I hope to effectuate these legal proceedings within the upcoming months. Along with this letter, I am accompanying a statement of Mr. Randy Langhorst confirming these negotiations and indicating to the City of Prior Lake that Mr. Randy Langhorst shall withdraw his complaint regarding my deck being an encroachment on Lot 1, Grainwood Park. It is my understanding that Lot 1, Grainwood Park, is dedicated to a number of property owners of the plat, both on and off the lake, 1 further understand that there is a dedicated "walkway" immediately. west of Lot 1. Under existing DNR public waters permit rules, the issue of docks and marinas art addressed in MR 6115.0200. In panicular, Minnesota RuI~ part 611 S ,0210. subp_ 4. A states that no permit is required to consl~t or install a seasonal dock provided the structure will not constitute a hazard to navigation or public health, safety. or welfare. does not include fua! handlins facilities, the structure aJlOWll n\:C lluw of water beneath it, and the strUCture is not intended to be used as a manna_ A marina is defined as the concentrated mooring of seven or more watercraft:. A sea..qonal dock III Lot 1, with. maximum mooring capability of six wa.t.ercraft is allowable without a DNR permit. Any more mooring than six would require a pennit from this office, Lot 1 lacks the width and area needed to consider any additional mooring beyond the six allowable without A permit. In other words. a DNR pennit for a marina. at. Lot 1 would not be approved. The walk.way shown on the drawings you provided do not constitute an outlot or other parcel dedicated to docking.
