PLANNING COMMISSION MINUTES
APRIL 12, 1999
1. Call to Order:
The April 12, 1999, Planning Commission meeting was called to order by Chairman
Stamson at 6:30 p.m. Those present were Commissioners Cramer, Criego, Kuykendall,
Stamson and Vonhof, Planning Coordinator Jane Kansier, Assistant City Engineer Sue
McDermott and Recording Secretary Connie Carlson.

3. Approval of Minutes:
Correction: Commissioner Vonhof arrived at 6:41 p.m.
The Minutes from the March 22, 1999 Planning Commission meeting were approved as
corrected.
4. Public Hearings:
Request for a Preliminary Plat for the project to be known as Fountain Hills
Addition consisting of a total of 41.4 acres to be subdivided into 6 lots for
commercial development. This property is located at the southwest quadrant of
County Road 42 and Pike Lake Trail.
Planning Coordinator Jane Kansier presented the Planning Report on file in the office of
the City Planner.
Wensmann Homes, Inc., has applied for a Preliminary Plat for the property located on the
south side of CSAH 42, west of Pike Lake Trail. The preliminary plat consists of 41.4
acres to be subdivided into 6 lots for commercial development. Staff recommended
approval of the Preliminary Plat subject to the 8 conditions of approval as stated in the
Planning Report.
The Commissioners briefly discussed the major and minor collector roads in the area.
The heating was open to the public.

Comments from the Public:
Herb Wensmann, the developer, said he plans to build an office or showroom this fall and
a client on the north side would like to construct a headquarters. They are nearly ready to
go. He also mentioned the area will have an association or covenants to maintain the
aesthetics.
Cramer said he had a concern with the storm damaged trees from last summer. Kelly
Murray of Wensmann Homes, said the last tree inventory was done approximately in
1995 or 1996 and will be updated. Murray also explained the purpose of the private
driveway.
Nick Polta, the engineer from Pioneer Engineering, explained the mitigation plans for the
wetland. They have not submitted the final plan but have talked to the City. Polta sees
no problems. None of the wetlands are DNR protected.
Commissioner Kuykendall had a concern with the narrower roads for tracks on Pike Lake
Trail. Kansier and McDermott responded explaining the designations and proposals.
There was a brief discussion on traffic issues.
Mike Vierling, 13985 Pike Lake Trail, said he farms some of the adjoining property.
Vierling received a call from Mr. Wensmann stating there was a property line
discrepancy. Vierling said the fence has been there for one hundred years and if you take
care of a fence for over 8 years it is actually your property. Vierlings have hired their
own surveyor who has not come back with the information. Wensmann claims it is
approximately 40 feet off in some areas. His other concern is for the drainage. Vierling
felt with his background in fanning that filling the pond as proposed will have other
drainage consequences. He stated he does not need his property flooded. Vierling said
the property line dispute has to be settled before the project starts. He is not against the
project and does not want to hold Wensmann up, but would like to get the fence line
straightened out.
Kelly Murray, said they will get together with the Vierlings and indicated she been trying
to contact Vierling's attorney. Ed Vierling told Wensmann last Fall they were hiring
their own surveyor and tonight was the first Wensmann's had heard about this. Both
parties would like to get the issue resolved.
The public heating was closed at 7:11 p.m.
Comments from the Commissioners:
Vonhof:
· This parcel has been revisited several times.
· Agreed with staff's recommendation with the private drive depended upon approval
by the County.

· Agreed with Kuykendall's assessment the City could have potential problems with
Pike Lake Trail being underdesigned. Recommend at this point, to check into
retrofitting the intersection and what would be an appropriate width.
· The developer and Vierlings should resolve their fence line dispute.
· Would like to see a drainage plan for the area.
· Noticed there are no bike paths/sidewalks or parking lots. Recommend at least a
sidewalk or bike path on one side to go with existing system on County Road 42.
· Regarding steep slopes - Question to staff: What leeway does the City have for
mitigation and disturbing the slopes? Is there any guidance in the Ordinance? This
issue should be addressed. Kansier said the Subdivision Ordinance is vague without
specific guidelines.
Kuykendall:
· Concern for the traffic problem.
· Sidewalks should be planned.
· Sensitive for the need of a drainage plan.
· Would like to see the fence line added to the drawing.
· Any other roadway designs considered for this plan? Nick Polta, the engineer,
pointed out the grading plan shows the fences as well as the drainage. Fountain Hills
Drive is the lowest point in the area. The additional street was added to stay away
from the steep slopes. This plan also preserves trees.
· McDermott explained the Engineering Design Manual requirements. This design fits
the criteria.
Stamson:
· Concurred with staff, approval by the County of the private drive as a condition.
· The fence line dispute is not the responsibility of the Planning Commission and
should be left with the property owners.
· Agreed with Vonhofwith a bike path along County Road 42. McDermott responded
there is a bike path.
· The Planning Commission tried to leave the properties in the City with the most
slopes in R1 where it can be handled better. When this property was rezoned
commercial the Commissioners looked at the slopes as a tradeoff. The developer has
done a great job to preserve the slopes and the road alignment.
· The traffic on Pike Lake Trail will not be a problem. It was not underbuilt to set
standards.
Criego:
· Agreed with Stamson's analysis with the slope issues and Vonhof's additional
conditions.
· Staff should look at Pike Lake Trail and come back with a recommendation.
· Good project and development.
Cramer:
· Very supportive of this development in Prior Lake.

· Staff should work with the developer and Vierlings to settle their land dispute.
· Urged staff to do a traffic count on Pike Lake Trail. The information will be helpful
to see if Pike Lake Trail and Fountain Hills need to be upgraded.
· Look into a right turn lane from Pike Lake Trail to Fountain Hills.
· The sidewalk issue should be addressed, at least on the west side.
· Very little concern with the steep slopes. We are willing to sacrifice the steep slopes
to have the office park area.
· Make sure the City gets a new tree survey and have staff validate.
· Supported the project with the conditions laid out.
Stamson pointed out the unnecessary concern for tracks. There are only 6 lots with the
developer currently looking at a day care and convenience store. The concern for heavy
truck traffic may not exist.
Cramer stated Pike Lake Trail already has a problem with speeding. There is a short
distance between County Road 42 and the turnoff. Suggested looking into a right turn
lane. A study should be done so if corrections have to be made, it can be done right from
the beginning.
Kuykendall was concerned for adequate right-of-way and questioned the width of Pike
Lake Trail. Polta responded it was 66 foot street.
MOTION BY VONHOF, SECOND BY CRIEGO, RECOMMENDING APPROVAL OF
THE PRELIMINARY PLAT SUBJECT TO 8 CONDITIONS OUTLINED IN THE
PLANNING REPORT ALONG WITH THE ADDITIONAL CONDITIONS: 9) BIKE
PATHS AND SIDEWALKS BE PLACED ALONG FOUNTAIN HILLS DRIVE
CONNECTING THE BIKE PATH ON COUNTY ROAD 42 TO FOUNTAIN HILLS
DRIVE; 10) PREPAR~ A SEPARATE DRAINAGE PLAN MAP; AND 11) STAFF
AND DEVELOPER REVIEW THE RIGHT-OF-WAY WIDTH FOR PIKE LAKE
TRAIL FROM COUNTY ROAD 42 SOUTH TO FOUNTAIN HILLS DRIVE.
Criego questioned the drainage plan. McDermott stated the City Water Resource
Coordinator has been working with Nick Polta on the drainage and grading. McDermott
also stated she believed the drainage plan is acceptable.
Kuykendall believes the street and cul-de-sac can be moved to the south and east.
Kansier explained the plat layout. Kuykendall agreed the plan was acceptable.
AMENDMENT: MOTION BY VONHOF, SECOND BY CRIEGO, TO REMOVE
CONDITION #10 OF THE MOTION.
Vote taken indicated ayes by all. MOTION CARRIED.
5. Old Business:
A recess was called at 7:46 p.m. The meeting reconvened at 7:55 p.m.

Planning Coordinator Jane Kansier gave an overview of some of the basic procedures and
Chapters of the Ordinance.
7. Announcements and Correspondence:
Cricgo brought up thc Vierling lake property and feels it an inappropriate place to have a
park. He feels thc property is more valuable as a residential district. Discussion followed
with thc suggestion to have the City Park Director speak to thc Planning Commission.
A. Planning Commission Workshop.
A joint meeting is being set up for thc end of May. Information will follow.
