Call to Order: The June 28, 1999, Planning Commission meeting was called to order by Chairman Stamson at 6:32 p.m. Those present were Commissioners Criego, Stamson and Vonhof, Planning Director Don Rye, Planner Jenni Tovar and Recording Secretary Connie Carlson. 2. Roll Call: Vonhof Present Kuykendall Absent Criego Present Cramer Absent Stamson Present 3. Approval of Minutes: The Minutes from the June 14, 1999 Planning Commission meeting were approved as presented. 4. Public Hearings: There were no public hearings. 5. Old Business: Case File #99-027 Robert Jader - Consider approval of Resolution 99-09PC approving a bluff setback variance for the property located at 14962 Pixie Point Circle. Planner Jenni Tovar presented the staff report dated June 28, 1999, on file in the office of the City Planner. MOTION BY CRIEGO, SECOND BY VONHOF, TO ADOPT RESOLUTION 99-09PC APPROVING A 33.00 FOOT VARIANCE TO PERMIT A SETBACK FROM TOP OF BLUFF OF 24.00 FEET INSTEAD OF THE REQUIRED SETBACK OF 57.00 FEET. Vote taken signified ayes by all. MOTION CARRIED. MOTION BY CRIEGO, SECOND BY STAMSON, TO ADOPT RESOLUTION 99- 07PC DENYING A 40.00 FOOT VARIANCE TO PERMIT A SETBACK FROM TOP OF BLUFF OF 17.00 FEET INSTEAD OF THE REQUIRED SETBACK OF 57.00 FEET. l:\99files\99plcomm\pcmin\mn062899.doc 1 Vote taken signified ayes by Criego and Stamson. Nay by Vonhof. MOTION CARRIED. 6. New Business: A. Discussion of Off-Road Recreation Vehicles Planning Director Don Rye, gave a brief update of the research and information collected regarding this matter. Staff discovered there are Federal Noise Standards applied to motorcycles and recreational vehicles. The intent is to define these in terms of the Federal Noise Standards and impose a condition on their operation in proximity to residential uses. It then becomes a simple matter of enforcement. The identification on the bikes will dictate where they can be operated. The ordinance will come back for a public meeting in the near future. The next workshop for the downtown redevelopment is tentatively set for the first week of August. Criego expressed concern regarding two of the new ordinances and commented as follows: 1) Reference to side yard setbacks. The ordinance says if your house (side wall) is longer than 40 feet from back to front then the side yard setback has to be increased 2 inches for every foot beyond the 40 feet. Why is 40 feet the magic number? Could the side wall be broken up within the 40 feet? Is the intent correct? Tovar responded. Criego was concerned with the difficulty of building on a substandard lot with the increased setback. 2) If a neighbor has put his home closer than 5 feet to the lot line, then you as a neighbor are responsible for picking up any additional footage to remain at 15 feet of building separation. This is an undue hardship to the neighboring resident. The property owner building is penalized for trying to improve his property when the difficulty was created by the neighbor. Tovar explained the reasons and intent for the nonconforming lot ordinance. Rye also responded. Criego requested the Commissioners and staff review these ordinances. Vonhof commented on the building separation and riparian lots. He felt there is an unintended impact on some of the issues and should be brought back. Stamson said his initial reaction was okay but the setback back issue can be a concern.
