(Franklin Trail) rather than the required setback of 85 feet from the centerline.

JULY 13, 1998
1. Call to Order:
The July 13, 1998, Planning Commission meeting was called to order by Vice Chair
Vonhof at 6:30 p.m. Those present were Commissioners Cramer, Criego, Kuykendall
and Vonhof, Planning Director Don Rye, Planning Coordinator Jane Kansier, Planner
Jenni Tovar, Assistant City Engineer Sue McDermott, Zoning Administrator Steve
Horsman and Recording Secretary Connie Carlson.

3. Approval of Minutes:
Cramer submitted corrections on page 8 and page 17.
The Minutes from the June 22, 1998 Planning Commission meeting were approved as
amended.
4. Public Hearings:
Vice Chair Vonhofread the public hearing guidelines and instructions.
A. Case #98-081 Wensmann Realty requesting a variance to allow a cul-de-sac
longer than 500 feet and variance to vary the standard design of the cul-de-sac to
allow a hammerhead turnaround for the development known as Glynwater.
Planning Coordinator Jane Kansier presented the Planning Report dated July 13, 1998 on
file in the office of the City Planner.
Staff recommended approval of the variance subject to the following conditions.
1. Increase the hammerhead width to 24' in order to accommodate snowplow
equipment.
2. Provide an easement at the hammerhead location.
3. Add a 20' by 32 'paved area behind the curb at the end of Bay Knolls Drive to allow
for snow storage.
4. Designate Bay Knolls Drive as a "No Parking" area.

Questions from Commissioners:
Kuykendall: Would there be a need for some kind of a semi-permanent barrier on Bay
Knolls Drive? Kansier explained the sidewalk grade and curbing.
Criego: Thought there was going to be a trail. Kansier explained the sidewalk route.
The developer has permission from the County to put the sidewalk in their right-of-way.
Comments from the public:
Tom Finn, 15672 Fremont Avenue, said the neighbors were all in favor of the
hammerhead design for the cul-de-sac. Questioned what would happen if the variance
was not granted. Vonhofresponded the applicant would have to come back with a
different design.
The heating was closed to the public.
Comments from the Commissioners:
Kuykendall:
· This is a good compromise. The right-of-way does go through to Fremont Avenue.
Criego:
· This resolves the issue of our last meeting in regard to safety.
· In favor of the change. It meets the hardship criteria.
Cramer:
In favor of the variance. It addresses all issues brought up by the staff, public and the
developer at the last meeting.
Vonhof:
· Read meeting minutes and was at the original meeting.
· Where are the fire plugs? Kansier pointed out the locations and said the fire chief saw
the plans.
· Suggest the parking be extended across the area of the hammerhead. There should be
a "No parking zone" about 25 feet on either side, so cars are not parking and turning
in the area.
· The four hardship criteria have been met.
MOTION BY CRAMER, SECOND BY KUYKENDALL, APPROVE THE
VARIANCE TO ALLOW THE CUL-DE-SAC GREATER THAN 500 FEET AND
VARY THE CUL-DE-SAC DESIGN INTO A HAMMERHEAD SHAPE WITH THE
PROVISIONS STATED 1N THE STAFF REPORT INCLUDING THE CONDITION
OF "NO PARKING" IN THE HAMMERHEAD CUL-DE-SAC AND 25 FEET ON
EITHER SIDE OF THE STREET.

Vote taken signified ayes by all. MOTION CARRIED.
Kansier stated the final plat would go before City Council on July 20, 1998.
The applicants for the next item were delayed and a brief recess was called.
Rye introduced the new zoning administrator, Steve Horsman.
Cramer questioned the City Council's outcome with the noise level regarding the
recreational vehicle moratorium. Rye explained their decision.
Vonhof explained Lakeville's noise ordinance adopted from Minneapolis.
There was a brief discussion on noise enforcement. Kuykendall requested staff to look
into intergovernmental action between the Scott County Sheriff's Department and the
Prior Lake Police regarding noise enforcement equipment.
The meeting was called to order and continued.
B. Case #98-076 Michael and Mary Prekker are reqnesting variances for a 3.1
foot variance to permit a 21.9 foot front yard setback instead of the reqnired 25 feet;
and a 21.0 foot variance to permit a 64.0 foot setback from the centerline of a
Connty Road (Franklin Trail) rather than the reqnired setback of 85 feet from the
centerline.
Planner Jenni Tovar presented the Staff Report dated July 13, 1998, on file in the office
of the City Planner.
Staff has concluded the variance request meets one of the four hardship criteria. Upon
adoption of the revised Zoning Ordinance, the property owner can construct a 6.9 foot
wide front porch without any variances.
Comments from the pnblic:
Michael Prekker, 16511 Franklin Trail, said they need a front porch. When the original
deck was put on, the builder did not use treated lumber and now the siding and deck is
rotting away and has to be replaced. They would like a 10 foot deck with an overhang,
but would take anything.
The public hearing was closed.
Comments from the Commissioners:
Criego:
· There is enough area to build on, but not to the front of your house.

· There is no hardship to justify expanding. The existing deck needs to be repaired but
not increased in size.
Cramer:
· Does not see hardships. There is a buildable area.
· Can not support.
Kuykendall:
· Questioned the fight-of-way widths for Franklin Trail. Tovar said 66 feet.
· Agreed with other Commissioners. Can be built. There is no legal hardship.
Vonhof:
· Questioned the existing width front and clarification.
Michael Prekker, 16511 Franklin Trail, questioned if they could lengthen the deck. Tovar
explained it was a non-conforming deck and would have to be replaced exactly as it
exists.
Vonhof:
· Concurred with the Commissioners.
MOTION BY KUYKENDALL, SECOND BY CRAMER, TO APPROVE
RESOLUTION 98-17PC DENYING A 6.6 FOOT VARIANCE TO PERMIT AN 18.4
FOOT VARIANCE FRONT YARD SETBACK INSTEAD OF THE REQUIRED 25
FOOT SETBACK AND A 24.5 FOOT VARIANCE TO PERMIT A 60.5 FOOT
SETBACK FROM THE CENTERLINE OF A COUNTY ROAD (FRANKLIN TRAIL)
INSTEAD OF THE REQUIRED 85 FOOT SETBACK.
Vote taken signified ayes by all. MOTION CARRIED.
5. Old Business:
Criego questioned the definition of slope/bluff and having Bret Anderson with the State
come in and give a presentation to the Commissioners. Tovar said the Zoning Ordinance
has to be wrapped up first.
Rye said the City Council has reviewed the Zoning Ordinance and staff is making
corrections and preparing for a new hearing for the City Council. Staff is anticipating
September at the earliest.
Criego requested Council's list of recommended changes in the Zoning Ordinance.

~ 6. New Business:
Criego questioned if there was any discussion by City Council on controlling the water
level. Rye said the Prior Lake/Spring Lake Watershed District is looking into alternatives
in trying to resolve some of the issues.
Suggested the Commissioners go out and tour the lake. A discussion followed on lake
levels and controls.
Criego and his neighbors have placed a number of complaints to the City and they feel
the process is not working. Rye explained there has been a process and in the future the
complainant will be followed up with some kind of contact. There is a process in place.
7. Announcements and Correspondence:
Rye shared a phone call he received from a Prior Lake resident concerned with Savage's
new development on County Road 42. The Commissioners discussed the affects of
traffic on Prior Lake's residents and businesses.
8. Adjournment:
MOTION BY KUYKENDALL/SECOND BY CRIEGO TO ADJOURN.
