Deerfield 2nd Addition, immediately adjacent to the properties at

Deerfield 2nd was originally platted in July, 2000. Lot 45 was platted
as common area for the townhouse development, and as such, was
covered by a drainage and utility easement. On April 1, 2002, the City
Council approved the final plat to be known as Deerfield 6th. The pIaL

The Planning Commission and staff recommend Alternative #1. A

A petition for the vacation of drainage and utility easements located on Lot 45, Block
1, Deerfield Second, and adjacent to Lots 5, 6, 7 & 8. Block 1, Deerfield Second, has
been duly presented to the City of Prior Lake, signed by the owners of the property
abutting the following described easement situated in the City of Prior Lake, Scott
County, Minnesota to wit:
LEGAL DESCRIPTION:
That part of Lot 45, Block 1, DEERFIELD SECOND, Scott County, Minnesota,
described as follows:
Beginning at the northwest comer of Lot 5, Block 1, DEERFIELD SECOND; thence
S 100051 '03" E, along the westerly line of said Lots 5, 6, 7 & 8, Block 1, a distance
of 138.00 feet; thence S 79008'57" W a distance of 5.00 feet; thence N 10051 '03" W
a distance of 138.00 feet; thence N 79008'57" E a distance of 5.00 feet to the point of
beginning.
Notice of the hearing has been duly published and posted in accordance with the
applicable Minnesota Statutes, and
A Public Hearing was held on said petition on Monday, May 6, 2002, at 7:30 p.m. in
the Council Chambers at the Prior Lake Fire Station #1; and
The City Council then proceeded to hear all persons interested in said petition and
persons interested afforded the opportunity to present their views and objections to
the granting of said petition; and
The drainage and utility easement is not necessary for the maintenance of public
utilities; and
The City Council of Prior Lake has determined that the vacation of said easement
would be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
