HomeMy WebLinkAbout9C - FIG Well CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA # PREP ARED BY: May 20, 2002 9C Bud Osmundson, Public Works Director AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING FULL AND FINAL PAYMENT FOR THE DRILLING AND TESTING OF A FIG WELL DISCUSSION: Historv The purpose of this item is to consider full and final payment to Bergerson - Caswell, Inc. for their contract to drill and test pump a Franconia, Ironton, Galesville (FIG) test well. Backflround On January 22,2002, the City Council awarded a contract to Bergerson- Caswell, Inc. to drill and test pump a FIG well in the Brooksville Hills area. Progressive Consulting Engineers, Inc. (PCE) was the engineer hired to prepare the plans and specifications for the drilling and testing of the test FIG well. Bergerson - Caswell's low bid was $28,619. Their full and final request for payment is $37,876, a difference of$9,257. The reasons for the increase in the final cost are outlined in the attached letter from PCB. The major cost increase is due to the filling of the drilled and developed test well with neat grout. The Minnesota Department of Health requires that all wells that are abandoned must be sealed with neat grout. There were 7 cubic yards itemized on the bid, and Bergerson - Caswell's bid was $400 per cubic yard. There were actually 27 cubic yards used in filling the test well. This is not unusual because unforeseen geological conditions such as voids and fissures are naturally occurring, and are filled with the grout when grouting the well. Therefore, staff and PCE both recommend the final payment as requested. Normally, Staff would halt the work and bring the change order to the City Council's attention prior to proceeding. In this case the overage was unavoidable. The law requires the contractor to abandon a well per code or they could lose their well drilling license. The contractor did not know that it would take 27 cubic yards of grout to correctly abandon the well or he would have notified the engineer. Bergerson - Caswell performed the drilling and testing in a professional and cooperative manner. This is just an example of unusual circumstance that can happen when drilling into the earth. In the civil engineering field, it is common knowledge that most change orders occur due to unforeseen changes in conditions in the geology, or earth, that is expected. Therefore, staff recommends the payment be made as requested. BudJ!et Impact The payment of$37,876 is to come from the Trunk fund. The alternatives are as follows: 1. A motion to approve a resolution awarding full and final payment to Bergerson - Caswell, Inc. in the amount of$37,876.00. 2. Table this agenda item for a specific reason. 3. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, 1. The Mayor and City Manager are hereby authorized to make full and final payment to Bergerson - Caswell, Inc. of Maple Plain, Minnesota of$37,876.00. Passed and adopted this 20th day of May 2002. Note that the billed quantities exceed the estimated quantities" to any significance, under three items: 1. Drilling of the nominal 4" open hole was 30 feet more than estimated. I fmd this acceptable. The additional drilling was required to fmd the bottom of the FIG formation. 2. F & I Neat Cement Grout required 20 cubic yards more than estimated. I find this acceptable. The additional grout was necessary do to unforeseen geological conditions. 3. The test pump was operated for 7 hours longer than estimated. I find this acceptable due to our mutual authorization on 3/20/02. Bergerson - Caswell, Inc. has indicated that they will forward remaining water analysis results and additional information from the gamma log and flow tests when they receive it. PCE recommends payment of the attached invoice. I am submitting this invoice late through no fault of Bergerson - Caswell, Inc. I was away from work for two weeks and was not able to review the invoice. I apologize for the oversight and respectfully request that you process the payment as quickly as you can with no detriment to Bergerson - .Caswell, Inc.
