HomeMy WebLinkAbout9C - Wilds North MEETING DATE: AGENDA #: PREP ARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JUNE 3, 2002 9C JANE KANSIER, PLANNING COORDINATOR DON RYE, COMMUNITY DEVELOPMENT DIRECTOR CONSIDER APPROVAL OF A RESOLUTION AMENDING THE COMPREHENSIVE PLAN FOR THE WILDS NORTH PROPERTY LOCATED IN SECTION 28, TOWNSHIP 115, RANGE 22 (Case File #02-045) History: Shamrock Development has filed an application for a Comprehensive Plan Amendment for the property located on the south side of CSAH 42, east of CSAH 83 and north of The Wilds. The proposal is to amend the 2020 Comprehensive Plan Land Use Map from the current C-CC (Community Retail Shopping) designation to the R-HD (High Density Residential) designation on approximately 20 acres of vacant land. This property is presently zoned R-1 (Low Density Residential) and C- 4 (General Business) and is designated as C-CC (Community Retail Shopping) on the 2020 Comprehensive Plan Land Use Map. Although not part of this application, the applicant is planning to develop this 20 acres as part of the entire 77 acre property to the east and the west of this site. The proposed development would include single family lots to the east, commercial lots to the west, and a townhouse style development on the area in question. The Planning Commission reviewed this request at a public hearing on May 13,2002. The Commission voted to recommend approval of this Comprehensive Plan amendment on the basis that the proposed designation is consistent with the Comprehensive Plan goals and objectives. A copy of the draft minutes of the Planning Commission meeting of May 13,2002, is attached to this report. Current Circumstances: The total site consists of approximately 20 acres. Minnesota 55372-1714 / Ph. (952) 447-4230 / Fax (952) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER Most of the site drains west and north towards the wetland at the southeast comer ofCSAH 42 and CSAH 83. A portion of the site also drains to the wetland to the east. The site is subject to the provisions of the State Wetland Conservation Act. A specific delineation will be required as part of the development application. Access to this property is presently from CSAH 83. The site will be developed in conjunction with the property to the west and the east. The access roads will be a part of this development. To the north and west of this property is vacant land, currently zoned C-2 and designated for Community Retail Shopping uses. To the south is The Wilds, presently zoned C-4 and R-1 PUD, and designated as C-CC and R-L/MD. To the east is vacant land, zoned R-1 and designated as R-L/MD. The Issues: The applicant is proposing to develop approximately 70 acres ofland located south ofCSAH 42 and east ofCSAH 83. The proposed development includes single family homes, commercial uses, and some townhouse style or higher density residential development. The request to amend the Comprehensive Plan would accommodate the higher density development. The R-HD area would serve as a sort of buffer between the commercial areas and the single family area. The Comprehensive Plan goals and objectives, which are applicable to this request, are as follows: GOAL: SUITABLE HOUSING AND ENVIRONMENT: Encourage the development of suitable housing in a desirable environment. OBJECTIVE No, 1: Provide opportunities for a variety of affordable high quality housing. OBJECTIVE No, 2: Maintain a choice of and encourage development of quality residential environments. OBJECTIVE No, 3: Provide suitable passive open space for the preservation of the natural environment and the enjoyment of residents. The proposed R-HD designation is consistent with the above stated goals and objectives in that it offers a variety of housing and it provides open space and the preservation of the natural elements of the site. Furthermore, the designation is consistent with the City's Livable Community Goal to provide affordable and life-cycle housing. The question here is whether the supply of land planned for future commercial uses should be reduced. There are several large tracts of I:\02fiIes\02compam\02-045 the wilds north\cc report. doc Page 2 FISCAL IMPACT: AL TERNA TIVES: RECOMMENDED MOTION: REVIEWED BY: undeveloped land located both north and south of CSAH 42 planned for commercial and office park. The elimination of this area will not significantly reduce that supply. This site still retains the commercial areas adjacent to the major roads. rnnr/m;dnn' The proposed Comprehensive Plan designation is consistent with the goals and objectives ofthe Comprehensive Plan. The change in designation of this area from a commercial designation to a residential designation will not significantly reduce the supply of commercial land. Therefore, the Planning Commission and the staff recommend approval of this request. RIIIlgpf Tmpnrf' There is no direct budget impact involved in this request. The City Council has three alternatives: 1. Adopt a resolution amending the Comprehensive Plan to include this area and designate it as R-HD. 2. Continue the review for specific information or reasons per City Council discussion. 3. Find the Comprehensive Plan amendment inconsistent with the purpose and intent of the Comprehensive Plan and deny the request. In this case staff should be directed to prepare a resolution with findings of fact. The staff recommends Alternative # 1. The following motion is required: 1. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are herein fully incorporated herein as set forth above. 2. Anoth'az concern is the drainage runoff. The area alreadY' has several existing wet areas. She que tioned who will take responsibility for the /oblems. Mangan pointed out the drai ge from this project running into their king lot. Safety is an issue with the busy co er and heavy traffic. Walter Hriber, 4818 Fran lin Trail, said a big issue is e existing water problems. Case #02-045: Shamrock Development is requesting an Amendment to the Comprehensive Plan to change the designation from Community Retail Shopping (C-CC) to Residential- High Density (RHD) for the vacant land located on the west side of CSAH 83, south of CSAH 42 and north of The Wilds, Planning Coordinator Jane Kansier presented the Planning Report dated May l3, 2002, on file in the office of the City Planning Department. Shamrock Development has filed an application for a Comprehensive Plan Amendment for the property located on the south side of CSAH 42, east of CSAH 83 and north of The Wilds. The proposal is to amend the 2020 Comprehensive Plan Land Use Map from the current C-CC (Community Retail Shopping) designation to the R-HD (High Density Residential) designation on approximately 20 acres of vacant land. At this time, the applicant is planning to develop this entire 70 acre property to the east and the west of this site. The proposed development would include single family lots to the east, commercial lots to the west, and a townhouse style development on the area in question. Staff recommended approval of the Comprehensive Plan as requested. Comments from the public: Nick Polta, Engineer for Pioneer Engineering represented Shamrock, presented the preliminary development plan. The idea was to get the land use changed to know how to proceed in platting future development. Criego questioned what plans for high density. Polta responded maybe a variety of mix. The public hearing was closed at 7:11 p.m. Comments from the Commissioners: Criego: . This use is appropriate for the property. It should be changed to High Density. . Recommended the City look at other areas for commercial property. Lemke: . Agreed with Criego, it is a good use of the property. Atwood: . Questioned the difference between neighborhood retail and community retail. Kansier explained the uses and limitations. . Concerned community retail is on the outside perimeters of County Roads 42 and 83 with the surrounding residential area. . Stamson said the remaining strip of property would be a buffer between the districts. Ringstad: . Agreed, this change makes sense. Stamson: . Concurred with the Commissioners. Looking at the applicant's diagram, they took into account they would be able to develop commercially under the balance of the property. . Supported request.
