CONSIDER APPROVAL OF REQUEST TO EXTEND THE
DEADLINE FOR RECORDING THE FINAL PLAT FOR
DEERFIELD 6TH ADDITION
History: On April 1, 2002, the Council approved Resolution 02-46,
approving the final plat known as Deerfield 6th Addition. This
property is located on the south side of Fish Point Road, west of
Deerfield Drive, at 17252, 17254, 17256 and 17258 Deerfield Drive.
The final plat will add 5' of property to the existing townhouse lots,
described as Lots 5-8, Block 1, Deerfield 2nd, which will allow the
construction of a deck on the townhouse units.
The Subdivision Ordinance requires that the final plat be recorded
within 90 days of approval, or in this case by July 1, 2002. Failure to
do so renders the approved final plat void, unless a written request for
an extension has been submitted and approved by the City Council.
On June 17, 2002, the Planning staff received a letter from Paul L.
Hellickson, representing the developer, D.R. Horton, requesting an
extension of this deadline. In his letter, Mr. Hellickson indicates the
reason for the extensiolJ. is to assemble the proper consents to sign the
final plat documents.
Current Circumstances: Mr. Hellickson has indicated he is in the
process of obtaining the necessary documents for the final plat. The
townhomes on these lots are in place, and no additional work is
required for the final plat.
The Issues: The purpose of the deadline is to keep the plat process
moving forward. Limiting the time also ensures that a subdivision
must keep pace with the newest design requirements for public
improvements. The final plat is relatively simple and does not require
the installation of any new public improvements.

to proceed with this project. The stafftherefore recommends approval
of this extension. The extension, however, should be limited in
duration to ensure the plat moves forward. Staff suggests the
extension be approved for no more than 90 days.

The City Council has two alternatives:
1. Adopt a resolution approving the request to extend the application
.. deadline until October 1, 2002, as requested.
2. Deny this request.
The staff recommends Alternative # 1.
A motion and second adopting a resolution approving the request to
extend the application deadline to October 1, 2002 is required.

RECORDING THE FINAL PLAT FOR DEERFlELD 6TH ADDITION
MOTION BY: SECOND BY:
WHEREAS: the Prior Lake City Council adopted Resolution #02-46 on April I, 2002,
approving the Final Plat known as Deerfield 6th Addition; and
WHEREAS: the City Subdivision Ordinance requires a Final plat be recorded within 90 days
of approval, in this case by July I, 2002; and
WHEREAS: the Developer has submitted a request to further extend the application
deadline to October 1,2002; and
WHEREAS: the City Council finds the extension of this deadline is consistent with the
intent of the provisions of the Subdivision Ordinance.
NOW, THEREFORE, BE IT HEREBY RESOL YED BY THE CITY COUNCIL OF
PRIOR LAKE, MINNESOTA, that it hereby approves the extension of the deadline for
recording the Final Plat known as Deerfield 6th Addition until October I, 2002.
Passed and adopted this 24th day of June, 2002.

RE: "DEERFIELD 6TH ADDITION" - TIME EXTENSION REQUEST
Dear Ms. Kansier:
On behalf of my client, D.R. Horton, Inc. - Minnesota Division, an extension of time is
being formally requested for the final plat (Resolution #02-46, approved July 1, 2002)
referenced above.
As we discussed today, I am meeting with the City Attorneys on Tuesday, June 18 to get
the proper amendment and consent forms created. The delay in not getting this
accomplished earlier was due to confusion as to the correct number of consents necessary
and from the proper parties.
It may be possible to have all the consents signed by July I, but depending on the
number, and locations of the mortgage holders for the coachhome units, it is necessary to
request an extension of time of the final plat.
