Cigarette license renewal applications are due annually in December.
Attached to this agenda report is a list of the thirteen establishments
requesting renewal of their cigarette licenses. The annual fee for
cigarette licenses, as stated in the current fee schedule, is $250.00.
The Issues
All applicants have provided completed applications and paid the
$250.00 license fee. The city has on file a copy of the educational
materials required by the city ordinance for each applicant. The Prior
Lake Police Department has reported no problems over the last six
years for eight of the thirteen applicants. Of the remainder:
· Dakota Liquor and The Wilds Golf Club were each fined
$150.00 in 1997 for selling cigarettes to minors.
· Express Gas & Groceries was fined in 1997 and 2000 for
selling cigarettes to minors; and
· Prior Lake Marathon, Express Gas & Groceries and Junction
Liquor were all cited in 2003 for selling cigarettes to minors.
Under city code, licensees with one violation within thirty six months
pay between $150.00 and $500.00 as a civil penalty. For a licensee
with two violations within thirty-six months, the civil penalty is
$700.00 and a license suspension of seven to twenty days. If a licensee
receives a third or subsequent violation within thirty-six months the
license is revoked. Any license so revoked may not be renewed for
two years.
One of the licensees (Express Gas & Groceries) had two violations
within thirty-six months. The clerk pled guilty to the offense and the
city's administrative penalty, which includes the fine and suspension,
will be imposed. The licensee may choose to appeal these penalties to
the City Council at some time in the future. The staff does not

recommend denial of the renewal request at this point but will work
with the licensee to eliminate future violations.
The City Council has the following alternatives:
1. Adopt a motion as part of the consent agenda approving the
cigarette licenses for 2004.
2. Deny one or more of the license requests.
Staff recommends Council approve the 2004 cigarette license renewals
as part of the consent agenda.
