CONSIDER APPROVAL OF A RESOLUTION ACCEPTING
FEASIBILITY REPORT AND SCHEDULING A PUBLIC HEARING TO
CONSIDER 2004 IMPROVEMENT PROJECT
HISTORY
Each year the City reconstructs street segments that are worn out. At the June 16,
2003, City Council meeting, Council adopted Resolution No. 03-105 authorizing
staff to prepare a Feasibility Report for the 2004 Improvement Project as
approved by the Council in the 2004-2008 Capital Improvement Program (CIP).
The project area considered in the report includes Rutledge Street, Red Oaks
Road, Breezy Point Road, Adrian Circle, Bianca Circle, Stefan Circle and
Lakeview Circle. A map of the project area is included as Exhibit 1 of the
Feasibility Report. The proposed project includes street reconstruction, storm
sewer, concrete curb and gutter and appurtenant work. Sanitary sewer
replacement is proposed for Red Oaks Road and Breezy Point Road. Watermain
replacement is proposed for Red Oaks Road. Sanitary sewer pipe lining is
proposed for Rutledge Street, Watzl's Point, and the section of pipe between Red
Oaks Road and Breezy Point Road under a separate contract.
CURRENT CIRCUMSTANCES
The attached report indicates the estimated costs for the project, along with
preliminary assessment estimates. At the end of the Feasibility Report, a project
financing summary is included to show project cost splits. The total estimated
cost of the project is $3,453,572.19.
Rutiedge Street, Red Oaks Road, Breezy Point Road, Adrian Circle, Bianca
Circle, Stefan Circle and Lakeview Circle have failing bituminous surfaces and
bituminous curb. The existing streets vary from 28 feet to 32 feet in width and
were originally paved in 1973 - 1977. All proposed street widths will be
approximately the same as the existing street widths. The street width is proposed
to be 28' for Breezy Point Road and Red Oaks Road. The street width is
proposed to be 30' for Adrian Circle, Stefan Circle, Bianca Circle, and Lakeview
Circle. The street width is proposed to be 32' for Rutledge Street and would
include a 5 foot sidewalk along the south side of Rutledge Street. All streets will
remain on a similar alignment and be constructed with B618 curb and gutter.

The water main system on Rutledge Street, Red Oaks Road, Breezy Point Road,
Adrian Circle, Bianca Circle, Stefan Circle and Lakeview Circle was installed
between 1973 - 1977. It consists of 6-inch cast iron pipe, 6-inch ductile iron pipe
and 20-inch ductile iron pipe. The 6-inch cast iron pipe on Red Oaks Road is
proposed to be replaced with 8-inch ductile iron pipe, because cast iron pipe
breaks more easily. The watermain on the rest of the project will remain in place.
The sanitary sewer system on Rutledge Street, Red Oaks Road, Breezy Point
Road, Adrian Circle, Bianca Circle, Stefan Circle and Lakeview Circle was
installed between 1973 - 1977 and consists of 8-inch vitrified clay pipe. The
sewer within the project area was televised in July of 2003. The televising report
shows offset joints, open fractures, infiltration, mineral deposits, and roots in
several sections of pipe. Sanitary sewer replacement is proposed for Breezy Point
Road and Red Oaks Road. Sanitary sewer pipe lining is proposed under a
separate contract for Rutledge Street, Watzl's Point, and the section of pipe
between Red Oaks Road and Breezy Point Road. Pipe lining is proposed in these
areas because it is less disruptive than the replacement of the sanitary sewer. The
areas proposed for pipe lining are backyard easements. Lining of Rutledge is
proposed because it is the only roadway leaving the area and would thus minimize
Rutledge Street closures.
Storm sewer improvements will include replacing existing pipe and catch basins
and adding additional storm sewer.
Staff has met with the Prior Lake Spring Lake Watershed District staff to discuss
permit requirements. The District staff indicated that "sediment trap" drainage
structures similar to those installed with the Hope Street, 150th Street, Mitchell
Circle, Estate Avenue, Frog Town, and Candy Cove Trail projects will be
necessary throughout the project.
An informational meeting is scheduled for January 13th, 2004. The proposed
improvements, project schedule and assessments will be presented.
The attached Feasibility Report outlines which portions of the cost for the above
project will be assessed to the benefiting properties.
If the Council approves the Feasibility Report, the Chapter 429 special assessment
statute requires a public hearing be conducted prior to proceeding with the project
to determine if it is to move forward.
ISSUES: The Special Assessment Committee met on December I st at which time the
following issues were discussed and recommendations made:
Street and Storm Sewer Reconstruction
· Pursuant to the assessment policy, the street and storm sewer reconstruction
should be assessed at up to 40% of the total project cost against the benefiting
pro}?erties, depending upon the special benefit created for each such property.
The remaining amounts should be recovered through the general ad valorem

property tax. A cap of the assessment rate at the Feasibility Report rate was
discussed and recommended.
Sewer and Water Main Replacement
· Sewer and water main replacement should be funded through the Enterprise Fund.
Sidewalk Construction
· Sidewalk construction should be funded through the Capital Park Fund.
Assessment Method
· The Special Assessment Committee recommends the unit method of assessment
for Rutledge Street, Red Oaks Road, Breezy Point Road, Adrian Circle, Bianca
Circle, Stefan Circle and Lakeview Circle due to the fact that lots in the project
area are of similar size and/or value. The estimated assessment rate is
$8,277.84/unit.
CONCLUSION
In summary, the project is feasible from an engineering and economic standpoint.
Approval of the Feasibility Report does not grant final approval of the project.
FINANCIAL
IMPACT:
The 2004 improvement project is proposed to be financed by special assessments,
tax levy, and trunk reserve. Funding sources and amounts are as shown below:

Trunk Reserve Fund $40,594.00
Water Quality Fund $80,000.00
Capital Park Fund $98,712.50
Project Total Cost $3,453,572.19
ALTERNATIVES:
The alternatives are as follows:
1. Approve Resolution 03-XX accepting the Feasibility Report and
establish a Public Hearing date as per the attached Resolution.
2. Table the resolution for a specific reason.
3. Deny the Resolution.
RECOMMENDED
MOTION:
A motion and a second to adopt a Resolution accepting the Feasibility
Report and calling for a Public Hearing for the 2004 Improvement
project.

RESOLUTION ACCEPTING FEASIBILITY REPORT AND
CALLING FOR A PUBLIC HEARING ON 2004 IMPROVEMENT PROJECTS

WHEREAS, pursuant to Resolution 03-105, the City Council, on June 16, 2003, ordered a
feasibility report to be prepared by the City's Engineering Department with
reference to the improvement of Rutledge Street, Red Oaks Road, Breezy Point
Road, Adrian Circle, Bianca Circle, Stefan Circle and lakeview Circle; and
WHEREAS, the report provides information regarding whether the proposed project is
necessary, cost-effective, and feasible.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The recitals set forth above are incorporated herein.
2. The City Council hereby accepts the Feasibility Report as submitted.
3. The Council will consider the improvement of such streets and areas in accordance
with the report and the assessment of property as described in the report for all or a
portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429
at an estimated total cost of the improvements of $3,453,572.19.
5. A Public Hearing shall be held on such proposed improvements on the 19th day of
January, 2003 at the Fire Station No.1, with the address of 16776 Fish Point Road,
City of Prior Lake, Minnesota at 7:00 p.m. Statutory notice and publication
requirements shall be followed.
Passed and adopted this 15th day of December, 2003.

BITUMINOUS SURFACING, SIDEWALKS, UTILITY IMPROVEMENTS,
AND APPURTENANT WORK
IN THE
CITY OF PRIOR LAKE, SCOTT COUNTY, MINNESOTA
Notice is hereby given that the City Council of the City of Prior Lake, Minnesota will meet in the
Council Chambers in Fire Station No.1, 16776 Fish Point Road, on Tuesday, the 19th day of
January, 2003 at 7:00 P.M. to consider the improvements for the following streets:
PROJECT DESCRIPTION
Reconstruction of Rutledge Street. Red Oaks Road. Breezy Point Road. Adrian Circle. Bianca
Circle. Stefan Circle and Lakeview Circle, including grading, storm sewer, aggregate base,
concrete curb and gutter, bituminous surfacing, sidewalks, utility improvements, and appurtenant
work.
The area proposed to be assessed is every lot, piece, and parcel benefiting from said
improvement, whether abutting or not, within the following described areas:
Portions of the northeast quarter of Section 35, Township 115 North, Range 22
West, Scott County, Minnesota.
Portions of the southeast quarter of Section 36, Township 115 North, and Range 22 West,

The Council proposes to proceed under the authority granted by Minnesota State Statutes
Chapter 429.
The total estimated cost of improvements is $3,453,572.19. A reasonable estimate of the impact
of the assessment will be available at the hearing.
All persons desiring to be heard with reference to the proposed improvements will be heard at
this meeting. Written or oral comments will be considered.
