MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: DECEMBER 19, 2011 AGENDA #: 1013 PREPARED BY: JERILYN ERICKSON, FINANCE DIRECTOR PRESENTED BY: JERILYN ERICKSON AGENDA ITEM: CONSIDER APPROVAL OF THE 2012 OFFICIAL CITY FEE SCHEDULE DISCUSSION: Introduction The purpose of this agenda item is to consider approval of the 2012 Official City Fee Schedule in accordance with the City Council's bylaws. The fee schedule identifies those types of service charges and license fees charged on a user basis to recover City- associated costs as directed by the City Council in an effort to reduce reliance upon the property tax. The intent is that the user who benefits should pay the ultimate cost of the service provided. Histo Staff reviews the fee schedule as a part of the annual budget process and makes recommendations for changes or additions as needed. Then, at the City Council's annual meeting, a new fee schedule for the year is adopted. In the past there has been some confusion because the City charges last year's fees until the new schedule is adopted. This year, we checked the bylaws and to reduce confusion have placed this item on the agenda the last meeting of the year so the new fees will be in force for all of 2012. Current Circumstances Attached is the proposed 2012 Official City Fee Schedule that lists fees, service charges, escrows and securities. I Explanation of Changes 1. Administration Fee on Development Agreements (4 %) is an existing fee and should be added to the Fee Schedule. 2. Construction Observation Fee on Development Agreements (5 %) is an existing fee and should be added to the Fee Schedule. 3. Administrative Charge for No Notice to Commence Construction for Utility Connections is an existing fee and should be added to the Fee Schedule. 4 -7. Water Rates, Met Council Sewer Rate and Storm Water Charge increases are based on Staff recommendations made in conjunction with the approval of the Capital Improvement Program (2012- 2016). These rates are charged each billing cycle. Each of these fees was announced at the Truth in Taxation Hearing. 8. Minimum Charges for Water and Sewer are existing fees and should be added to the Fee Schedule. These minimums are charged each billing cycle if there is no consumption. These charges will be considered further in conjunction with the Capital Improvement Program annual update. 9. Sewer Rate for Users Not Connected to the Municipal Water System is an existing fee and should be added to the Fee Schedule. This rate is charged each billing cycle. This fee will be considered further in conjunction with the Capital Improvement Program annual update. 10. Odd -Even Sprinkling Ban Violation is an existing fee and should be added to the Fee Schedule. 11. Bulk Water Meter Rental includes an administrative fee for issuing and tracking the rental of bulk water meters and a deposit to ensure that the meter is returned in working condition. 12. On -Sale 3.2 Malt Liquor reflects the 2 nd of 3 increases phased in over the period 2011 -2013. This schedule was adopted on 03/07/2011. 13. On Sale Wine License reflects the 2 nd of 3 increases phased in over the period 2011 -2013. This schedule was adopted on 03/07/2011. 14. The MCES SAC (sewer availability charge) increase of $135 from $2,230 to $2,365 is a Metropolitan Council Environmental Services fee which the City is required to collect and remit. The fee helps pay the capital costs of construction of the Metropolitan sewer interceptor system. This rate has increased incrementally by $50 -150 each year since its inception and will continue to increase over the next few years according to the Metropolitan Council. 15. Picnic Table Moves. Staff is recommending that the language be modified to reflect a minimum of four tables in order to be the most cost - efficient regarding use of staff time and equipment. 16. Beach Groups (Over 25 People). Staff is recommending a change in how the beach groups are charged from a per person basis to a per bus basis. 17. Barricades. Staff is recommending that the language be modified to reflect a minimum of two barricades in order to be the most cost - efficient regarding use of staff time and equipment. 18. Garbage Barrels. Staff is recommending that the language be modified to reflect a minimum of two garbage barrels in order to be the most cost - efficient regarding use of staff time and equipment. 19. Meter Tamper Charge is an existing fee and should be added to the Fee Schedule. The current ordinance provides for a $100.00 penalty when the seal that is affixed to a water meter during installation is either broken or removed. This charge will be considered further in conjunction with the review and update of the Water and Sewer ordinances. 20. Picnic Shelter /Band Shell /Gazebo Rental (Community Parks). Staff is recommending that the language be modified to reflect that School District #719, youth organizations, non - profit civic groups, churches and government agencies that utilize these facilities Monday through Thursday are currently not charged a fee. 21. Community Garden (05/01 — 10/31). Staff is recommending that the $20.00 deposit is eliminated and the rental fees be based on the agreement established at the beginning of the season which takes the plot size configurations into account. Conclusion The changes approved by the City Council will be incorporated into the 2012 Official City Fee Schedule with an effective date of January 1, 2012. ISSUES: Prior Lake has a history of charging fees in proportion to city expenses for services for which a discrete benefactor can be identified. FINANCIAL The fee schedule identifies those types of service charges and license fees IMPACT: charged on a user basis to recover City- associated costs. ALTERNATIVES: The following alternatives are available to the City Council: 1. Approve the 2012 Official City Fee Schedule as presented 2. Approve the 2012 Official City Fee Schedule subject to specific Council amendments 3. Delay action if the Council requires additional information.
