MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT SEPTEMBER 3, 2002 8D JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION APPROVING AN AMENDMENT TO THE CREEKSIDE ESTATES PUD TO REVISE THE NUMBER OF APPROVED UNDERGROUND PARKING SPACES FOR THE 54-UNIT BUILDING History: The Creekside Estates Planned Unit Development (PUD) was approved by the City Council in December, 2000. The approved PUD Plan included 102 units in three buildings (2, 24-unit senior condominium buildings and 1, 54-unit congregate care facility). On November 5, 2001, the City Council approved Resolution 01-126, approving an amendment to the interior floor plan of the 54-unit building. This amendment included rearranging the mechanical rooms to enlarge the community and lobby area on the first floor, the addition of a card room and an activity room on the second floor, and the removal of a beauty salon and the addition of a guest room on the third floor. At that time, the City Council determined the amendment did not affect the required parking. Current Circumstances: Eagle Creek Development, LLC, the developer of Creekside Estates, has submitted a request for a minor amendment to the approved PUD development plan. The proposed amendment would reduce the number of parking stalls in the interior lower level parking area from 57 stalls to 55 stalls. The attached drawing shows the approved and the proposed floor plan. Section 1106.607 of the Zoning Ordinance allows the City Council to approve minor amendments to an approved PUD Plan by resolution following notification of all owners of property within the PUD. A minor amendment includes "changes that increase conformity with Ordinance requirements; decreases in residential density, leasable floor area, building height, impervious surface and/or required parking provided such decreases have a minimal impact on the overall character of the approved Final PUD Plan as determined by the Zoning Administrator; minor building additions and floor plan modifications that do not increase parking requirements or reduce useable open space; and changes that are specified as minor amendments in the approved Development Contract. " The Issues: The major issue is whether or not the proposed amendment will change the character ofthe PUD. The amendment also does not affect the exterior appearance of the building. The major change is the elimination of 2 parking spaces. However, the POO currently provides at least one parking space per unit, which exceeds the Zoning Ordinance requirement of 0.5 spaces per unit for elderly housing. Conclusion: The proposed amendment is minor, and will not alter the character of the POO. BudJ!et Impact: There is no immediate budget impact as a result of this request. The construction of the new building will provide additional tax base to the City. The City Council has three alternatives: 1. Adopt a resolution approving the minor amendment to Creekside Estates POO Plan as proposed. 2. Deny the proposed amendment. In this case, the Council should direct the staff to prepare a resolution with findings of fact for the denial of these requests. 3. Defer consideration of this item for specific reasons. Staff recommends alternative # 1. A motion and second adopting a resolution approving the minor amendment to the Creekside Estates POO Plan is appropriate. 1:\02files\02puds\creekside estates 02-92\cc report. doc Page 2 RESOLUTION 02-XX RESOLUTION APPROVING A MINOR AMENDMENT TO THE CREEKSIDE ESTATES PLANNED UNIT DEVELOPMENT TO REVISE THE NUMBER OF APPROVED UNDERGROUND PARKING SPACES FOR THE 54-UNIT BUILDING MOTION BY: _~AiNyth./ SECOND BY: ~~ ();..J WHEREAS: The Prior Lake City Council considered the proposed minor amendment to the approved development plan for the Creekside Estates on September 3, 2002; and WHEREAS: Owners of property within the Creekside Estates POO have been notified of the proposed minor amendment in accordance with Section 1106.607 (2) b of the Zoning Ordinance; and WHEREAS: The City Council finds the minor amendment to the Creekside Estates POO consistent with certain elements of the Comprehensive Plan and the Zoning Ordinance; and WHEREAS: The City Council finds the minor amendment is in harmony with both existing and proposed development in the area; and WHEREAS: The City Council finds the minor amendment is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance; and WHEREAS: The City Council finds the proposed minor amendment adequately provides for internal organization, uses, circulation, public facilities, recreation areas and open space. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The Creekside Estates PUD Final Plan is amended to revise the number of approved underground parking spaces from 57 to 55 for the 54-unit building as shown on Exhibit A to this resolution.
