(612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER PLANNING COMMISSION MINUTES JANUARY 5,1995 The January 5, 1995, Planning Commission Meeting was called to order by Chairman Vonhof at 7:05 p.m. Those present were Commissioners Amold, Loftus, Kuykendall and Vonhof, Planning Director Don Rye, Consultant Blair Tremere, Engineer Larry Anderson, Assistant City Planner Deb Garross, Associate Planner Gina Mitchell, and Secretary Connie Carlson. Commissioner Roseth arrived at 7:15 p.m. REVIEW MINIJI'~ OF PREVIOUS MEETING MOTION BY ARNOLD, SECOND BY KUYKENDAIL, TO APPROVE THE MINI.rYF~ AS WRITrEN. Vote taken signified ayes by Amold, Kuykendall, Loftus, and Vonhof. MOTION CARRIED. Consultant Blair Tremere introduced Don Rye as the new Planning Director. ITEM I - PUBLIC HEARING TO CONSIDER THE PRELIMINARY PLAT OF WINDSONG ON THE LAKE SECOND ADDITION The Public Heating was called to order at 7:07 p.m. The public was in attendance and a sign-up sheet was circulated. Associate Planner Gina Mitchell presented the Planning Report dated January 5, 1995. Staff outlined the history of the Windsong Planned Unit Development, existing site conditions, development constraints, and proposed County Road 21 upgrading. Staff recommends continuation of the Public Heating to Monday, February 13, 1995, at 7:00 p.m. so the applicant, Staff and the County can work together to tie in the proposed plat with the proposed County Road 21 improvements. Mr. Earl Elster of 4115 Windsong Circle, expressed concem over the possibility of accidents with the sharp curve on Windsong Circle and the proximity of Schroeder Circle. He felt that winter driving and speed around the blind comer make it dangerous at the present time. Dan Metzger of 4130 Windsong Circle, felt 12 lots were a fairly large number of homes for the area and the proposed ama would not maintain the initial image of Windsong. Mr. Metzger felt the current developers have not enforced all covenants and was concerned what the motives are for developing the new lots. Comments from the Commissioners were: concem for traffic safety at the intersection of Windsong Circle and Schroeder Circle; covenants associated with the original plat; an amendment was approved in 1988 for 12 single family lots and objection was not expressed at that time. Mr. Metzger and Mr Elster were invited back to the continued Public Hearing. MOTION BY ARNOLD, SECOND BY KUYKENDAII,, TO CONTINUE PUBHC HEARING TO MONDAY, FEBRUARY 13, 1995, AT 7:00 P.M. PLANNING COMMISSION January 5,1995 Page 1 ITEMII - PUBLIC HFARING TO CONSIDER AMENDMENT TO T~WILDS PIANNED UNIT DEVELOPMENT (PUD} FOR OUTLOT L; STERLING NORTH AND SOUTH The Public Hearing was called to order at 7:35 p.m. The public was in attendance and the sign-up sheet circulated. A recess was called for Staff to set up. The meeting reconvened at 7:40 p.m. Scott Clements from David Carlson Companies presented Armn~nt 1, regarding Sterling North and South. The proposal was to change the minimum building setback standards for single family attached Villa units. The Wilds PUD document did not contemplate the style of platting that Carlson Companies used to plat Sterling North and South. The amendment as proposed will be consistent with the intent of The Wilds PUD. Tim Jacobs, Project Manager for The Wilds, presented Arr~ndment 2. The proposal is to change the land use designations and the total number of units from 21, single family attached Villa units to a maximum of 9, single family detached units to reduce the number of trees that would be lost on the property legally described as: Outlot L, The Wilds. Assistant Planner Deb Garross presented Planning Report dated January 5, 1995 prepared by Blair Tremere. Draft Resolution 95-01PC was presented for the Commissioners' consideration. Associate Planner Gina Mitchell and Assistant Planner Deb Garross explained the history of the PUD, the proposed amendments for Sterling North and South and their impact on the PUD; and Exhibit A. There were no comments from the public. Comments from Commissioners were: adjustments in spacing; good presentation by Staff; 25' vs. 30' setback; 30' setback should apply to both sides of Wilds Lane so a sidewalk could be installed at a future date on the North side of Wilds Lane supports the amendment. A recess was called at 8:52 p.m. The meeting reconvened at 8:58 p.m. Assistant Planner Deb Garross presented the Staff report and Exhibit B for Outlot L, also referred to as "The Preserve". The request is to change the minimum front yard setback if abutting public/private streets from 25' to 20' and reduce the total number of units from 21 single family attached villa units to 9 single family detached villa units. The plan submitted with this application is only a concept and the developer will need to submit an application for preliminary plat. At that time the design of the plat will be evaluated. There were no cornramts from the public. Comments from Commissioners were: preserving more trees will be better for the site; all agree on the concept of the reduction in number of units and supports the Arren~t; design of the plat will be evaluated at the time of the preliminary plat. Assistant Planner Deb Garross presented the "Housekeeping" items identified in Exhibits D, E and F in Resolution 95-01 PC. There were no comments from the public or Commissioners. MOTION BY ARNOLD, SECOND BY ROSETH, TO APPROVE RESOLUTION 95-01PC W1TH EXHIBITS A THROUGH F ATTACHED HEREID. Director of Public Works, Larry Anderson explained the impact of the proposed 20' front yard setback vs. the required 25' setback. PLANNING COMMISSION January 5, 1995 Page 2 Nick Polta, Pioneer Engineering, stated the reduction of the setback would preserve the 8' strip of trees between the fairways and units. Votes taken signified ayes by Amold, Roseth, Kuykendall, Loftus and Vonhof. MOTION CARRIED. MOTION B Y LOFTUS, SECONDED BY KUYKENDAI I, TO CLOSE PUBLIC HEARING. Vote taken signified ayes by Loftus, Kuykendall, Amold, Roseth and Vonhof. MOTION CARRIED. OTHER BUSINESS: Consultant Blair Tremere advised the Planning Commissioners they will be receiving a draft of the schedule of the 2010 Comprehensive Plan workshops at a future meeting. Planning Commission meetings will be changed to the second and fourth Monday of the month beginning in February. Staff will advise the Commissioners on the specific meeting location.
