(612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER PLANNING COMMISSION IVIINUTES January 19,1995 The January 19, 1995, Planning Commission Meeting was called to order by Chairman Vonhof at 7:01 p.m. Those present were Commissioners Roseth, Loftus, and Vonhof, Planning Director Don Rye, Assistant City Planner Deb Garross, Associate Planner Gina Mitchell, and Secretary Connie Carlson. Commissioner Amold arrived at 7:10 p.m. Commissioner Kuykendall arrived at 8:07 p.m. REVIEW MINUTF~ OF PREVIOUS MEETING MOTION BY ROSETH, SECOND BY LOFI'US, TO APPROVE THE MIN[YI'F~ AS WR1TI'EN. Vote taken signified ayes by Roseth, Loftus, and Vonhof. MOTION CARRIED. ITEM I - VARIANCE APPLICATION FOR CARTER NARVESON The Planning Department received a variance application from Carter Narveson of 3845 Green Heights Trail SW. The applicant requested the following variances: 4.26' west side yard variance from the 10' side yard setback requirement (from the west comer of the proposed deck). 4.43' east side yard variance from the 10' side yard setback requirement (from the east comer of the proposed deck). 8.35' north front yard variance from the 25' front yard setback requirement (from the northwest comer of the proposed deck). The applicant is requesting that the Planning Commission approve the following "post facto" variances to validate the existing structure's setbacks, impervious surface coverage (the applicant is also proposing to roof the deck on the east side of the home), and the size of the accessory buildings:. 2' east side yard variance from the 10' side yard setback requirement (from the existing eastem carport). 7' west side yard variance from the 10' side yard setback requirement (from the existing westem carport). 23% impervious surface variance from the 30% impervious surface maximum. A 197.75 square foot accessory structure area variance from the 832 square foot accessory structure maximum. Attomey Frank Muelken, 15685 Fish Point Road, Prior Lake, spoke on behalf of the applicant, Carter Narveson. Mr. Muelken stated it was his understanding from Mc. Narveson the deck was built at the same time as the home. The carport was added after he bought the property with instructions from the City to put cover or screening over property he owned. 1Vh: Narveson asked the City if he could put it under a flat structure to meet the requirements. Going one step further, ~ Narveson put a wooden cover on the PLANNING COMMISSION January 19,1995 Page 1 carports. A concrete slab was put in the same month he acquired the property and was told by the City it was permissible and essential. Mr. Narveson had no documentation regarding a building permit for the carports. Mr. Muelken asked whether Mr Narveson would be in violation of any conditions if he owned the adjacent lot. Associate Planner Gina Mitchell stated Staff would not be able to address what variance would be necessary if Mr. Narveson owned the adjacent lot since this information was not part of the application. Mr. Muelken stated Mr Narveson had a signed Purchase Agreement to buy the adjacent property and would possibly solve the neighborhood interest in this matter. Mr. Muelken requested we continue the application. Planning Director Don Rye said he was reluctant to do any kind of analysis without information from the adjacent parcel. Staff would need bone fide information and would be willing to look at it and make a determination as to how it would affect the variances applied for. Building Inspector, Pard Baumgarmer stated the Building Department would not enforce any dead lines on complaints until the variance proceedings were completed. If a variance was not granted then they would have to enforce an action. Staff's recornraendation is based on the submitted application. Notices would be republished and a sign-up sheet available for anyone who did not receive a Notice. Don Rye recommend the matter be tabled to the next meeting so Staff and Mr Narveson can make some determination on the issues. Mitchell stated the City does not have any records of building permits for the existing deck and carports which may or may not have any influence on the approval of the variances. MOTION BY ROSETH, SECOND BY LOFFUS TO TABLE THE MATI'ER UNTIL THE NEXT AVAILABLE PLANNING COMMISSION MEETING, FEBRUARY 13, 1995. Commissioner Vonhof recommended re-notifying everyone who attended the meeting by letter. Mitch Frank, 3857 Roosevelt Street, Prior Lake, expressed concem for the record of a statement made by Staff of something illegal being built on the property. He felt an accusation was made without any substance. Commissioner Vonhof explained the meetings were tape recorded and the matter was tabled. There would be an opportunity for everyone to comment at the next meeting. A recess was called at 7:24 p.m. ITEMII - PUBLIC I-IEARING- CONSIDERPIPEIJNEAMEND~ The Public Hearing was called to order at 7:35 p.m. Assistant Planner Deb Garross presented the Planning Report dated January 19, 1995. The purpose of these amendments are to consider adoption of definitions, setbacks and other regulations related to pipelines. On December 2, 1994, the City was notified by the State of Minnesota, Deparlment of Public Safety, that pipeline regulations must be adopted in order to be consistent with Minnesota Statutes. The proposal is to amend the City Code, Zoning and Subdivision Ordinances to bring them into compliance with the Minnesota Model Pipeline Setback Ordinance. The City Attomey has reviewed the draft documents and it is Staff's recommendation to adopt the Ordinance as written. There were no conments from the audience. PLANNING COMMISSION January 19, 1995 Page 2 The Planning Commissioners were supportive of the recornn~ndations. MOTION BY ARNOLD, SECOND BY LOFI'US TO APPROVE PIPFIINE ORDINANCE AS PRESENTED. Vote taken signified ayes by Amold, Loftus, Roseth and Vonhof. MOTION CARRIED. MOTION BY LOFrUS, SECOND B Y ARNOLD TO CLOSE PUBLIC HEARING. Vote taken signified ayes by Loftus, Arnold, Roseth and Vonhof. MOTION CARRIED. ITEM llI- 1995 GOALS AND OBJECTIVES Planning Director Don Rye presented the 1995 Planning Commission Goals and stated the City Council will be having a workshop January 21, 1995 and that they have a draft of the goals. Comn~nts from Commissioners included: Setting specific time lines for goals and projects; the possibility of getting together one Monday or Thursday a month to discuss the Comprehensive Plan; Bringing Planning Commission objectives/report to the City Council; the Tree Preservation Ordinance is on hold. Staff informed the Planning Commission of the amendments that the Wilds is proposing, including: 1) change in hotel; 2) shopping deleted to high density residential; 3) change street system; 4) change to corporate cabins. The PUD Amendment Application should be submitted in the middle of February. The February 13th, 1995 Planning Commission meeting will be held in the City Council Chambers. IV - JOINT WORKSHOP WlTI-I CITY COUNCIL The Planning Commission and City Council will meet on Monday, April 3, 1995. The agenda is not available at this time. The Planning Commissioners would like to review the City's Capital Improvement Program to help accomplish their goals. The Comprehensive Plan will address issues of road upgrades, sewers and zoning. The Planning Commissioners would also like copies of the City Council Minutes and Capital Improvement Program. MOTION BY ROSETH, SECOND BY ARNOLD, TO ADJOURN THE MEETING.
