The February 13, 1995, Planning Commission Meeting was called to order by Chairman Vonhof at 7:00
p.m. Those present were Commissioners Roseth, Arnold, Loftus, Kuykendall and Vonhof, Planning
Director Don Rye, Assistant City Planner Deb Garross, and Secretary Connie Carlson.

ITEM I - WINDSONG ON THE LAKE PLAT II, CONTINUED PUBLIC HEARING
The Public Heating was called to order at 7:01 p.m. The public was in attendance and a sign-up sheet was
circulated.
Planning Director, Don Rye presented the Planning Commission Supplemental Report dated February 13,
1995. Developer, Ralph Heuschele was available to answer questions from the public. Mr. Earl Elster of
4115 W'mdsong Circle, stated his concem for traffic safety. Greg Kopischke of Westwood Professional
Services addressed Mi: Elster's concem and felt the best alternative for the development were the grades
presented. The grade line would give approximately 140 feet of sight line. Mr. Kopischke also said they
could add height berms without any problems.
Comments from the Commissioners: low traffic for safety; agreed the plat was acceptable.

ITEMH - FAIRVIEW CLINIC - CONDITIONAL USE PERNHT
Planning Director, Don Rye presented the Planning Report dated February 13, 1995 to consider the
application of Fairview Hospital and Health Care Services for Conditional Use Permit to operate a medical
clinic in the R1 Residential Zoning district.

Dave Salonen, 3884 Cross Street, stated his concems as residents were told by the Westbury Ponds
developer this would be a single family development and construction of a business would not be
appropriate; applicant could look for property in the Business Park; notification of hearing was less than 2
weeks; and residents on Willow Lane should be notified.
Planning Director, Don Rye responded to the above concerns.
Don Ramm, 16811 Willow Lane, wanted to know why Willow Lane residents were not notified. He stated
Phase 1 of Westbury Ponds promised traffic lights that are still not up and there is still heavy construction
and regular traffic on Willow Lane.
Mark LaFrankie, 3862 Willowwood Street, would like to know the construction time frame and what sort of
activity is planned.
Planning Director, Don Rye responded to Mr. Ramm and Mr. LaFrankie.
Brett Strayer, 16877 Westbury Avenue, main concem was for traffic safety. He is not against applicant but
thinks there are other business property available in Prior Lake. Mr. Strayer would like Fairview to do a
market study of the site.
The applicant, Fairview Clinic, had no representation at the hearing.

Commissioner Vonhof requested extra traffic patrol by the police department for Willow Lane and
Willowwood Street.
ITEM III - CARTER NARVESON - VARIANCE CONTINUATION
The Public Heating was called to order at 8:28 p.m. and a sign-up sheet was circulated.
Planning Director, Don Rye presented the Supplemental Report for the Carter Narveson variance request.
Mr. Narveson met with lVlz Rye to discuss the new information presented at the January 19, 1995 hearing.
Based on this new information Mr. Narveson was told staff's recommendation would be the same.
Planning Director, Don Rye read a letter submitted by Robert R. Herr supporting the variance requests.
Carter Narveson, 3845 Green Heights Trail, stated he had no documentation to verify his conversations with
the City directing him to build the carports or the document signing off approval.
Building Inspector/Code Enforcement Officer, Jay Scherer stated on June 8, 1990 he did an inspection on
the property and found 5 junk vehicles, car parts, tires, 55 gallon barrels, miscellaneous refuse and weeds.
A letter was sent to 1VIz Narveson to correct the violations on or before Jtme 25, 1990. The City does not
have any records of the documents 1Viz Narveson is referring to. lVh: Scherer remembers telling Mr.
Narveson certain things can be screened from the public view and therefore be in compliance with the Code
but does not recall telling Mz Narveson to build carports without permits.
Craig Tschida, Mitch Frank, Keith Berkil and Jane Koenig, neighbors of Mr. Narveson expressed their
support in granting the variances.

Comments from Commissioners included: neighborhood support; alleviate east carport; should remodel and
make deck safe; remodification reducing impervious surface percentage; if Mr. Narveson did not know he
should have known to get permits for improvements; support for staff recommen~on.

ITEM IV - JEFF BONNEAU- VARIANCE
Applicant, Jeff Bonneau stated his request for the variances.
Assistant Planner, Deb Garross presented the Planning Report dated February 13, 1995. The applicant was
requesting consideration of several variances for the property located at 5060 Condons Street, legally
described as Lot 7, Condon's Wood Dale. The applicant requests that the Planning Commission grant the
following variances from the requirements of Prior Lake Zoning Ordinance 83-6 in order to construct a
carport, enclosed storage area, and a second story addition.
To permit a 4.5' west side yard setback instead of the required 10' side yard setback (from the
southwest comer of the proposed carport).
To permit a 6' west side yard setback instead of the required 10' side yard setback (from the
proposed storage area).
To permit a 2' south front yard setback instead of the required 25' front yard setback (from the
southwest comer of the proposed carport).
To permit a 21' south front yard setback instead of the required 25' front yard setback (from the
cantilever of the proposed second story addition).
To permit a 31% impervious surface coverage instead of the maximum impervious surface
coverage of 30%.
Neighbors, Larry Nickelson, 15543 Ridgemount Avenue; Ken Olson, 5038 Condons Street; Wally Stock,
5038 Condons Street; Don Jass, 5022 Condons Street and Anne Widerstrom, 5080 Condons Street, were
sympathetic to Mr. Bonneau's needs but were opposed to the construction of a carport for traffic safety and
aesthetic reasons.
Discussion of Commissioners included: altemative of building up and using existing space; carport too
close to road and concem for traffic; would like to see some sort of garage; denied request.
Garross recommended tabling the matter and having Mc Bonneau redesign his structure. Variances will
have to be considered with the new additions.

ITEMV - C1TY CODE AND ZONING ORDINANCE - PUBLIC HFARING
The Public Hearing was called to order at 10:22 p.m.
Assistant Planner Deb Garross presented the Planning Report dated February 13,
amendments to the City Code and Zoning Ordinance as follows:

Add provisions to allow the City of Prior Lake to initiate comprehensive rezoning of a substantial
part of the City which consists of not less than fifty (50) lots of platted area or five (5) acres of
unplatted area in order to conform to changing conditions. The proposed amendment would
establish procedures for: public heating; notification; adoption; publication; and map requirements
to implement comprehensive rezoning actions.
Add provisions which would require the City of Prior Lake to file certified copies of all conditional
use permit and variance actions with Scott County.
Change the notification requirement for Amendments to the Zoning Ordinance from property
owner's name and address within three hundred (300) feet to three hundred fifty (350) feet.
A "housekeeping amendment" is proposed to add a section heading for Landscape Requirements
and renumber subsequent sections under Title 5-5-10 of the City Code and Chapter 6 - General
Regulations of the Zoning Ordinance.
A "housekeeping amendment" is proposed to relocate "Driveway" provisions from the General
Requirements section to the Offstreet Parking requirements of the City Code and Zoning
Ordinance.
A "housekeeping amendment" is proposed to make minor text amendments and to the Business
Park zoning standards such as to change the name of the Business Park Zoning District from I- 1,
Business Park to B-P, Business Park within the text of the Zoning Ordinance and on the official
Zoning Map.
There were no co~ts from the public and the Commissioners supported the recommendation.

Ordinance 87-10.
There were no comments from the public.
