Commissioner Roseth arrived at 7:05 p.m. ITEM I - JOHN MAHONEY VARIANCE APPLICATION; John Mahoney, 17276 Murphy Lake Blvd. stated the requested variances in the application. Associate Planner, Michael Leek, advised the site address was on Edinborough Avenue and presented the information per Planning Report dated April 10, 1995. The Planning Department received a variance application from John Mahoney for property legally described as Lot 37, Maple Park Shores Acres. The applicant proposes to construct a new, single-family house and auached garage on the subject pt~operty. The specific variances am: 1. A variance to pemqit a lot area of 7,512 square feet instead of the required 10,000 square feet. 2. A variance to permit impervious surface coverage of 33.4% instead of the maximum permitted coverage of 30% of total site area The plat of Maple Park Shores Acres dates to 1922. The subject property is substandard in area, consisting of 7,512.5 square feet. The majority of lots in this neighborhood are of similar size and configuration. The house to the North (15245 Edinborough Avenue), located on Lot 38, was constructed in 1992, and is similar in size and ground floor configuration. The house to the South (15265 Edinbomugh Avenue), located on Lot 36, was consla'ucted in 1%2. The proposal is to construct a modestly-sized house with an attached, 2-car garage measuring a total of 25'x62', and with a total area (inclu~ling the garage) of 1550 square feet of area on the first level. Staff recornrnendafion is to approve the variances requested. The ordinance hardship criteria have been met and the proposal for development of the property meets the spirit and intent of the ordinance by meeting the setback requirements for the underlying zoning district. Commissioner Vonhof read opposition letters from Gary and Made Bames, 15245 Edinborough Avenue and Jim Reagan, 15265 Edinborough Avenue. Comrcents from the audience: Gary Barnes cormmnted on purchasing the lot a few years ago and his concem for restriction of development on the lot; water mn off causing erosion and fire hazard with a building so close to his home and property. Kirby Morlock, 15287 Edinborough Avenue, stated his father sold the property to John Mahoney and that his father had previously given the adjoining land owners the opportunity to buy the land. Mc Morlock felt John was building an appropriate style home for the property. Comrrents from the Commissioners included: the property was a lot of record and all efforts had been made to meet the setbacks; concem from neighbors regarding the potential mn off and amount of vegetation removed and the problems it may cause; (Mahoney stated he is constxucting a roof that will not cause mn off to neighbors' property.) lot is buildable, similar to adjoining lots and taxes have been paid; conflict over sale of lot between parties is not an issue with the Commission; hardship criteria have been met and commissioners are supportive of variances. 1Vh: Bames sketched the site showing the elevation and slope of the lots and the potential problems it would cause. He also stated gutters have helped with his mn off. MOTION BY LOFFUS, SECOND BY ROSETH TO APPROVE THE 2,487.5 SQUARE FOOT VARIANCE FROM THE LOT AREA REQUIREMENT AND 3.4% VARIANCE FROM THE IMPERVIOUS SURFACE COVERAGE MAXIMUM OF 30% OF THE SITE AREA. Justification being the four hardship criteria have been met and the proposal for development of the property meets the spirit and intent of the ordinance by meeting the setback requirements for the underlying zoning district. CONDITION: No additional water or soil drain to the neighboring properties. Vote taken signified ayes by Loftus, Amold, Roseth and Vonhof. MOTION APPROVED. MOTION B Y ARNOLD, SECOND BY ROSETH, TO ADJOURN THE MFFrFING. Vote taken signified ayes by Loftus, Amold, Roseth, and Vonhof. MOTION CARRIED.
