MN 55372 CITY COUNCIL AGENDA REPORT MEETING DATE: January 3, 2012 AGENDA #: 9A PREPARED BY: Dan Rogness, Community & Economic Development Director PRESENTED BY: Dan Rogness AGENDA ITEM: CONSIDER APPROVAL OF AN ORDINANCE TO REPEAL OR AMEND CHAPTER 1306, RELATING TO SPECIAL FIRE PROTECTION SYSTEMS DISCUSSION: Introduction The purpose of this agenda item is to make a final decision on retaining, repeal- ing or amending optional Chapter 1306 of Minnesota Rules, which was previous- ly adopted as Chapter 1306 subpart 2 in Part 4 Building Regulations, Section 401 Building Code, Subsection 401.103, within the Prior Lake City Code of Or- dinances. Histo The City of Prior Lake previously adopted Chapter 1306, which authorizes for the installation of fire suppression systems by municipality in addition to the fire suppression requirements of the International Building Code. Once adopted, these sprinkler system requirements become part of the Minnesota State Build- ing Code in that municipality. Any new construction and /or remodeling in excess of 2,000 sq. ft., or a change of occupancy in any building in excess of 2,000 sq. ft. would require fire sprinkler systems. If adopted, the municipality must select one of two subparts without amendment, including: • Subpart 2 Existing and New Buildings Sprinkler systems must be in- stalled for new buildings, buildings increased in total floor area (including the existing building), or buildings in which the occupancy classification has changed. • Subpart 3, New Buildings Sprinkler systems must be installed for new buildings, additions to existing buildings, or buildings in which the occu- pancy classification has changed. Current Circumstances At the December 19 Work Session, the City Council discussed information pre- sented by staff related to the following issues: 1. Cost savings to building owners from commercial insurance providers as a result of the sprinkler installation or lack thereof. 2. The number of commercial /industrial buildings this provision may apply to in Prior Lake. 3. Costs, liability or exposure to others, such as firefighters, domestic ani- mals, clients attending classes, neighboring buildings, other communities for mutual aid, employees, etc. 4. A city comparison survey showing which ones have paid on -call or full - time firefighters. 5. Impacts or statistics on firefighter safety, such as any correlation be- tween firefighter injury to commercial fires where no fire suppression sys- tem is in operation. 6. The Board of Architect Smart Alternatives which can be mandated in lieu of fire suppression equipment. A survey was done that included cities above 10,000 population in Carver, Dako- ta, Hennepin, Ramsey and Scott Counties. Results show that sixteen cities have adopted Subpart 2 of Chapter 1306 and sixteen have not adopted Chapter 1306 at all, while nine cities adopted Subpart 3. Conclusion It is important to allow and promote economic growth through business expan- sion without undue financial costs tied to municipal codes and regulations. The optional provisions of Chapter 1306 of the Building Code have a cost impact on business growth in Prior Lake. However, life safety and security is enhanced through internal building fire suppression systems. ISSUES: The city council needs to balance economic development goals with public life safety and security, while evaluating the costs and benefits of its decision. FINANCIAL Some reduction in building permit fee revenue to the city. IMPACT: ALTERNATIVES: 1. Adopt an Ordinance amending Subpart 3 for existing Subpart 2. 2. Adopt an Ordinance repealing Chapter 1306. 3. Take no action (retains Subpart 2 of Chapter 1306). RECOMMENDED As determined by the City Council. THE CITY COUNCIL OF THE CITY OF PRIOR LAKE DOES ORDAIN THAT SECTION 401.103 1. OF PRIOR LAKE CITY CODE OF ORDINANCES, PART 4, BUILDING REGULATIONS, IS HEREBY AMENDED (deleted material is lined out; new material is underlined; provisions not being amended or repealed are omitted except as necessary for context): PART 4 Building Regulations Section 401 Building Code Section 401.103 The City of Prior Lake may adopt by reference Appendix J (Grading) of the 2006 International Building Code. The following optional provisions identified in Section 4, SUBP. B and C are hereby adopted and incorporated as part of the building code: 1. Chapter 1306 Special Fire Protection Systems subpart .23 2. Chapter 1335 Flood proofing Regulations, Parts 1335.0600 to 1335.1200 3.
