The March 17, 1994, Planning Commission Meeting was called to order by Acting Chairman Roseth at
7:35 P.M. Those presem were Cetnmissio~ Roseth, Lofius, Vonhof, Kuykendall, Director of Planning
Hca'st Gmser, Assistant City Planner Deb Garross, Associate Planner Gina Mitchell, and Secretary Rim
Schewe.

ITEMI - CONDmONAL USE- PRIOR LAKE FIRE DEPARTMENT
As the applicant is the City of Prior Lake, Deb Garross, Assistant City Planner, presented the infonnation as
per planning report of March 17, 1994. The purpose of the application is to locate a public building in a
R-1 Dislrict. Public buildings are a conditional use permitted within the R-1, Urban Residential Zoning
District. The subject site is located southwest of the intersection of Fish Point Road and CSAH 21 and the
legal description is Lot 1, Block 3, Waterfront Passage Addition. The Fire Department services the
adjoining townships as well as Prior Lake. Access would be on County Road 21. The building committee
and architect have worked very diligently and developed a design that compliments the site and the
adjoining properties. Fire sirens and fire apparatus used solely for public purpose shall be exempt from the
noise performance standard requirement. The criteria for a conditional use has been met. Staff's
reconmxmdafi on is to approve the conditional use as per Planning Commission discussion.
Paul Mikelberg representing the fu'm of Boannan, Kroos, Pfister, Rudin, & Associates, presented
information on the building design, exterior materials used, and landscaping. The tower design of City Hall
has been incorporated into the design of the Fire Hall.
Co~ts from the Commissioners were; furore expansion for city buildings, traffic signal, safety issues,
drainage into wetland, roof drainage, taming radius, responder parking, consider furore f'ue station satelites
in north and west portions of Prior Lake, speed limit, exlerior material selection, and length of bays.

RATIONAL BEING THE APPLICATION HAS MET THE APPROVAL CRITERIA OF THE CITY
CODE. THIS RECOMMENDATION TO BE FORWARDED TO THE CITY COUNCIL.
Vote taken signified ayes by Vonhof, Loftus, Roseth, and Kuykenclall. MOTION CARRIED.
ITEMH - VARIANCE- BRUCE ULRICH/SHANNON O'MALLEY
Brace Ulrich, 78 East 10th Street, Ape1710, SC Paul, stated they are requesting several variances in order
to construct a new home at 15209 Fairbanks Trail. Due to the substandard size of the lot, the building

envelope is severely restricted. They have worked with an architect to design a structure that would not be
overpowering for the lot.
Gina Mitchell, Associate Planner, presented the information as per planning report of M~ch 17, 1994. The
variances requested are;
1. 3 foot north sideyard variance from the 10 foot sideyard setback.
2. 2 foot south sideyard variance from the 10 foot sideyard setback.
3. 25 foot lakeshore variance from the 75 foot lakeshore setback.
4. 1.2% building coverage variance from the 22% maximum building coverage requirement
5. 2.8% imlxrvi0us surface variance from the 30% maximum impervious surface requirement
6. 5 foot west frontyard variance from the 30% maximum impervious surface requirement
7. 296 sq. ft. lot area variance from the 7,500 sq. ft. lot area requirement.
Because of the substandard lot, when all setbacks are applied, the resulting building envelope consists of
1,350 sq.ft. The axe~ was platled under the jurisdiction of Eagle Creek Township and all the lots within the
subdivision are substandard by current Prior Lake zoning regulations. Precedent has been set in the
neighborhood in granting variances to other homes. The applicant has indicated he will replace three trees
that will be removed during construction. Recomnxmdation from Staff is to approve the variances as
requested as hardship is caused by the application of the current zoning regulation to a substandard lot of
record, and not the actions of the property owner.
Comments from the Commissioners were on; number of variances in the neighborhood, substandard lot,
replacement of trees, distance of roof overhang to building next door, and concem of fh'e hazard.

BEEN SET IN THE NEIGHBORHOOD, SUBDIVISION WAS PLATIED UNDER A PREVIOUS
GOVERNMENTAL BODY, HARDSHIP IS CAUSED BY THE APPLICATION OF THE CURRENT
ZONING RF~ULATIONS AND NOT THE ACTIONS OF THE APPLICANT, AND IT WOULD NOT
BE DEI'RIMENTAL TO THE HEALTH AND WELFARE OF THE COMMUNITY.
Vote taken signified ayes by Vonhof, Loftus, Kuykendall, and Roseth. MOTION CARRIED.
ITEM III- PUBLIC HEARING CONTINUATION- SIGN ORDINANCE
Deb Garross, Assistant City Planner, presented the information as per memorandum from Steve Grittman,
Consultant for Northwest Associated Consultants, Inc., referencing the changes made by the Planning
Commissioners. Clarification was asked on the number (21 vs 30), days allowing a sign to be displayed,
under Menu Beard Signs the word" restaurant" is to be deleted and the word "business" be inserted in the

in its place in the entire paragraph, and the height of balloon signs.
Dick Casey, Viking Liquor, 16290 Hwy 13 South, corrnnen~ on the balloon sign height regulation and felt
it was not necessary. Also felt this public hearing should have had priority on the agenda as it was the third
time to be brought before the Commissioners. (Mc Casey was informed that this time slot was the only
one available when the public hearing was continued).
Corranents from the Commissio~ were on; 20 foot balloon height, 21 days for window signs, governing
signs in right-of-way, and agreed on the changes.
MOTION BY LOFTUS, SECOND BY VONHOF, TO REL-DMMEND TO CITY COUNCIL TO
APPROVE THE PROPOSED SIGN ORDINANCE WITH THE FOLLOWING CHANGES
INCORPORATED INTO THE DRAFT: THE WORD BUSINESS TO REPLACE THE WORD
RESTAURANT UNDER THE MENU BOARD SIGNS; 21 DAYS FOR WINDOW DISPLAY SIGNS; 20
FOOT HEIGHT, TAII.laR BAIIDONS SIGNS UP TO 35 FEET SHOULD REQUIRE A
CONDmONAL USE PERMIT.

A directive was given to Staff to research the goveming of signs in the public right-of-way (newspaper
receptacle boxes), and include a recommendation to the City Council.

Vote taken signified ayes by Lofms, Kuykendall, Roseth, and Vonhof. MOTION CARRIED. The Public
Hearing closed at 9:45 P.M.
ITEM IV - DISCUSSION OF 2010 LAND USE PLAN
Horst Gmser, Director of Planning, stated that the Council will likely hire a consultant to propose a
conarerci~ induslrial plan, and it would be prudent to wait until this study is finished prior to developing a
draft Land Use Map.
ITEM V - PLANNING COMMISSION WORKSHOP SUMMARIES
The Bed & Breakfast summary was distributed. The outline/summary of the workshop will be discussed at
a furore meeting. Discussion followed on upcoming projects for the Commission.
