Those present were Commissioners Roseth, Amold, Lofms, Vonhof, Kuykendall, Director of Planning Horst Graser, Associate Planner Gina Mitchell, and Secretary Rim Schewe. REVIEW MINUFF_S OF SPECIAL MEETING OF APRIL 12, 1994 MO'HON BY V ONHOF, SECOND BY ROSETH, TO APPROVE THE MINUTES AS WR1TIEN. Vote taken signified ayes by Vonhof, Roseth, and Amold. Loftus and Kuykendall abstained as they were not present for the meeting. MOTION CARRIED. ITEMI - HOME OCCUPATION-CYNTHIA & CHARLES AUSrlN Charles Austin, 15231 Howard Lake Road, stated that he and his wife would like to operate an antique shop from their home. He is remodeling his tuck-under garage to living space and the shop would be located in this area. The shop would be open Friday and Saturday. He felt the traffic would not be increased by their business and parking would not be a pmblerrz Mm. Austin had a shop that was located in Jordan which did not generate enough income to pay the rent, therefore Mm. Austin wished to work out of the home. Cynthia Austin, 15231 Howard Lake Road, cornmmted that they had talked to their neighbors and all were in approval of the shop. Also, she wished to be home with their children and felt having the shop in the home would accomplish this goal. Associate Planner Gina Mitchell, presented the information as per planning report of April 21, 1994. The application is for the operation of an antique shop from the 11'10" X 26'9" rock-under garage which is currently being remodeleck The subject site is approximately 90 X 400 and consists of approximately 39,204 square feet. The 80' driveway is bituminous and has a gravel tumaround area adjacent to the driveway. The site is zoned A-I-Agricultural, and SD as it is in the shoreland district of Howard Lake. The neighborhood is developed with single family homes within close proximity of each other. The proposal is to operate an antique shop which is a cornrnercial/retail operation not intended by the Zoning Ordinance to be a home occupation. Typically home occupation permits are granted for a professional or consulting service nature or with restricted client access by appointment. Recommendation from Staff is to deny the application on the basis that it is a retail operation and not consistent with the intent of the purpose of the A-1 Zone nor the Home Occupation Permit chapter of the Zoning Ordinance. If it is the intent of the Comn~sioners to approve the Home Occupation Permit, Stuff recommends the 11 conditions listed in the planning report be included in the motion. Comments from the Commissioners were on: days of operation, age of children, business in Jordan, amount of taxes, ~affic increase concems, type of signage, increase in clientele, screening, mar driveway location, PLANNING COMMISSION April 21, 1994 Page 1 inventory of item use of consignment sales elsewhere, other options are available, site not zoned for retail and therefore is not consistent with the Zoning Ordinance. Comments from the applicants were not audible on tape as they did not use the microphone. MOTION BY KUYKENDAII~, SECOND BY VONHOF, TO DENY THE HOME ~ATION PERMIT FOR CYNTHIA AND CHARI FS AUSTIN AT 15231 HOWARD LAKE ROAD. RATIONAl F. BEING THE APPLICATION IS NOT CONSISTENT WITH THE COMPREHENSIVE PLAN OR THE INTENT OF~ P~E OF~ A-1 ZONE AND THE HOME ~ATION CHAP-IER OFTHE ZONING ORDINANCE, A PRECEDENF WOULD BE SET, AND IT WOULD BE DETRIMENTAL TO THE HEAEII-I AND WF/FARE OF THE NEIGHBORHOOD. Vote taken signified ayes by Kuykendall, Vonhof, Amold, Roseth, and Loftus. MOTION CARRIED. The applicant was advised that he could appeal the Planning Commission decision to the City Council. A recess was called at 8:30 P.M. and reconvened at 8:32 P.M. ITEM II - BY-LAWS Horst Gmser presented the Planning Commission By-Laws adopted March 21, 1994 to the Commissioners for input. The following changes were suggested: Section 2-3-1: second paragraph, last sentence "Said monbers shall serve for two (2) year terms from July 1 to June 30". be deleted here and added to E under the def'mition of APPOINTMENT in SECIION 7-OFFIClmS. Section 2-3-3: Day of meeting to be left as is or change to second and fourth Monday. Moeting time changed to 7:00 P.M. Section 2-Planning Cormrfission Agenda and Meeting Formal: Add consent agenda to the format. A suggestion was made to have a microphone placed above the audience to better record public input. This problem rmy be rectified when the Planning Commission meetings will be held in the new Fire Hall meeting room. Section 7 - OFFICERS: (D) Delete the definition of Secretary. This is found in Section 3 (A). (E) Continue the present format for appointing the chair and vice-chair thereby having staggered terms and direct Staff to survey other commmities. Delete the second sentence The committee shall be a representative of the citizens who live in Prior Lake, and the werds or business ownership from the third sentence. Add the words "from July 1 to June 30" to the end of the first sentence. The word committee be changed to commission wherever referenced. A recess was called at 9:10 P.M. and reconvened at 9:32 P.M. ITEM III - MEETING PROCEDURES The issue discussed was to start the Commission meetings at 7:00 P.M. ITEM IV - BED AND BREAKFAST OPERATIONS As Deb Garross was unavailable to present the information on Bed & Breakfast it was continued to the meeting of May 5, 1994. PLANNING COMMISSION April 21, 1994 Page 2 ITEM V - BEYOND THE BASICS - TOM VONHOF Conarissioner Vonhof gave a brief sunanaary of a seminar he attended called "Seminars for Citizen Planners". 1Vk Vonhof felt this was an excellent seminar and it will be personally helpful to him in the future in rendering decisions on various applications that are brought before the Commission. MOTION BY LOFTUS, SECOND BY ROSETH, TO ADJOURN THE MEETING. Vote taken signified ayes by Loftus, Roseth, Vonhof, Arnold, and Kuykeodall. MOTION CARRIED. The meeting adjourned at 9:55 P.M.
