The September 1, 1994, P 'lamfing Commission Meeting was called to order by Chah'man Arnold at 7:00
P.M. Those present were Commissioners Roseth, Amold, Loftus, Vonhof, Acting Plamfing Director Blah'
Tmmem, Associate Plmmer Gina Mitchell, and Secretary Rita Schewe. Commissioner Kuykendall was
absent.
ITEM a - REVIEW MINUFES OF PREVIOUS MEETING
Corrnrdssioner Vonhof stated on page 1, paragraph 1, line 1, to change the time of 7:30 P.M. to 7:00 PM.
Commissioner Roseth stated on page 2, paragraph 2, line 2, change the wo~rl being to bring.
MOTION BY VONHOF, SECOND BY ROSETH, TO APPROVE THE MINUTES AS AMENDED.

ITEM b - REVIEW PLANNING DEPARTMENT PROJECT LIST
Blair Tmmere, Acting Plamfing Director, presented the information to the Commissioners and explained the
mt~ch~g system. Discussion followed and the projects were prioritized. Tiffs item will be brought back to
the Commissioners at the next meeting for recommendation to the City Council to consider.
ITEM I - PERRI HANNES - HOME OCCUPATION PERM1T
Pen-i Hannes, 15243 Bluedom Circle SE, stated she is requesting a home occupation pen'nit to operate a
two station beauty salon in her home that would allow her to be with her family. The salon would be open
five days a week and she would offer hair products and supplies on a retail basis and she would employ one
part-time person.
Gina Mitchell, Associate Plam~e~; presented the information as per planning repo~'r of September 1, 1994.
The subject site is a comer lot in a developed single family neighborhood. The number of clientele would
be approximately 20-25 per week. The Planning Commission has granted similar home occupation permits
in the past. A basic premise of the home occupation regulations is that a pennit would not be granted to an
operation that would disrupt the neighborhood. Staff recommends approval of the application contingent
on the conditions listed in the plannh~g report.
Bob Schafe~; 15223 Bluedom Circle, voiced his objections to the home occupation application as he felt the
u"~c would invade his privacy, be a hazard for the clfilchen playing in the slav, et, the ordinmace states
where businesses should be, and he did not want change.
Comments from the Commissioners were; retail business, number of clients, rationale for 1 chah' station,
other salons with home occupations permits, horn's of operation, location of driveway, size of lot, walk-in
n-'~c, visibility of house numbers, minimal impact of neighborhood, and precedent has been set.

Occupation Section 6.8A allows for an additional employee that is not a family member. MOTION
CARRIED.
ITEM II - ANDREA NATHANSON. HOME OCCUPATION
Andrea Nathanson, 17108 Stm'ise Avenue SW, stated she is requesting a home occupation to operate a
secmtm'ial/bookkeeping service h~ her home in olrler to be home with her small child. She has operated
businesses out of her home in Oregon amd California. Business would be generated over the phone or by
leaving business cat'ds.

The applicant proposes to be the only employee offering the services of wotrt pt,ocessing, typh~g, mailing
labels, bookkeeping, resumes, and pmofi'eading. There would be no clientele coming to the home and no
exterior signage. Staff mcotramnds approval wkh the conditions listed in the plannh~g report.
Co~nents fonn the Commissioners were that all were in suppolt of the proposal and commended the
applicant for applying for the home occupation pelmit.
MOTION BY VONHOF, SECOND BY ROSETH, TO APPROVE A HOME OCCUPATION PERMIF
FOR 17108 SUNRISE AVENUE SW, WITH THE FOLLOWING CONDITIONS;
1. NO EXTERIOR SIGNAGE.
2. NO OTHER EMPLOYEES BEYOND THE ONE (1) EMPLOYEE/OPERATOR.
3. NO CLIENTELE WILL BE AT THE HOME.
4. NO TRANSFER OF THE HOME OCL-1JPATION PERMIT.
5. THE HOME OCCUPATION PERMIT IS SUBJECT TO ALL APPLICABLE ORDINANCE AND

ITEM IH - SUMMIT CONSTRUCTION - VARIANCE
Rick Mtradian of Strut Construction, 1609 West County Road 42, Bumsville, sated he is requesting a
lot mea variance for a non waterfront lot located in the Shoreland Dislrict h~ olrler to be buildable.
Gina Mitchell, Associate Planner, presented the information as per planning report of September 1, 1994.
The subject site is app~oximately 82 feet wide and 120 feet deep, containing 9,722 square feet of lot re'ea.
The subdivision was platted in 1923 in Spring Lake Township and annexed into the City of l%ior Lake in
1973. In 1979, the minimum lot area in the R-1 district was 10,000 square feet, however, a lot area vmim~ce
was not issued to the subject site as it was inadvertently missed by the City at the time of an adminisu'ative
land division in 1979.
The 278 square foot minimttrn lot area variance request is reasonable because the property was subdivided
within the City of Prior Lake, assessments have been paid on the property, and the subject site is a "Lot of
Record". Denial of the lot area variance would render the lot non-buildable which would create an undue
hardship wkh respect to the property. Staffs recornmendation is to approve the vm-iance as requested.
Jan Ballmrl 500 Cedm'lane Circle, Jordm~, stated she was the previous owner and would be glad to answer
any questions if necessary.
Comments from the Commissioners were on; di-iveway easement, hardship not caused by applicant, and
vmance is error correcting for the property.
MOTION BY LOFTUS, SECOND BY ROSETH, TO APPROVE A 278 SQUARE FOOT AREA
VARIANCE FROM THE 10,000 SQUARE FOOT MINIMUM LOT AREA REQUIREMENT FOR A
NON WATER FRONTAGE LOT LOCATED IN THE SHORELAND DISTRICT ADDRESS OF 16458
PARK AVENUE. RATIONALE BEING THE SUBJECT SITE IS A LOT OF RECORD, THE SITE WAS
ADMINISTRATIVELY SUBDIVIDED BY THE CITY OF PRIOR LAKE, HARDSHIP IS CAUSED BY
THE APPLICATION OF THE SHORELAND MANAGEMENT ORDINANCE AND NOT THE
ACTIONS OF THE APPLICANT AND WOULD NOT BE DETRIMENTAL TO THE HEALTH AND
WELFARE OF THE NEIGHBORHOOD.
Vote taken signified ayes by Lofms, Roseth, Vonhof, and Amold. MOTION CARRIED.

ITEM IV - JERRY MILLER - VARIANCE
Jen'y Mille~; 15563 Cahnut Avenue, stated he is proposing to construct a pole building on Outlot A, Titus
Second Addition. The building would be used for storing fm~n machinery and alfalfa bales as he will
continue agricultural production on his p~operty and the building would not be used for housing aninYals.
T~ees will be planted on the p~operty to increase the overstory.
Blair Tremere, Acting Plmmh~g Dhector, presented the information as per plarming report of September 1,
1994. The request is for a 70 foot north side and a 90 foot south side variance from the 100 foot property
setback m. quirement for accessory fan'n buildings and a 2,668 square foot m'ea variance from the 832 square
foot maximum mca requirement for accessory su'uctmes within the R-I, Subm'ban Residential Disla'ict. The
building is an accessory to the agricultural use and not to a primary building and the council is empowered
to allow this. The ctment Zoning Standmrts of the R-1 Subm~oan Residential Zone me not appropriate for
prope~xies not served by mtmicipal services. The hardship is the result of application of m'bm~ development
standmrls to a property located in the tm-al tuea. Staff is not opposed to the gqm~t of minimal setback
variances provided fl~at a condition stating no animals be housed withhl or about the pole building. It is
also suggested that the building size be reduced in order to provide additional sepmttion between

properties. The pole building should be located on tlie most visually inconspicuous pat of the lot and
should be screened from the adjacent properties to the north and south.
Corrunents from the Commissioners were; dimensions of building, building use, building height, 100 foot
setback from adjacent homeo tree line, and land is being farmed.

FOOT SOUTH S1DE YARD VARIANCE FROM THE 100 FOOT PROPERTY SETBACK
REQUIREMENT FOR ACCESSORY BUILDING, (C1TY CODE SECTION 5-5-2(A), AND A 2,668
SQUARE FOOT AREA VARIANCE FROM THE 832 SQUARE FOOT MAXIMUM AREA
REQUIREMENT FOR ACCESSORY STRUCTURES WITHIN THE R-l, SUBURBAN RESIDENTIAL
DISTRICT (CITY CODE SECnON 5-5-2(A)3), WITH THE CONDITIONS THAT NO ANIMALS BE
HOUSED ON THIS PROPERTY, THE LOCATION WOULD BE VISUAl I .Y INCONSPICUOUS, HAS
MET THE STANDARDS OF HARDSHIP, AND IS AN AGRICULTURAL USE.
