(612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER PLANNING COMMISSION MINUIES OCIOBER 13,1994 The October 13, 1994, Planning Commission Meeting was called to order by Chairman Vonhof at 7:02 p.m. Those present were Commissioners Amold, Loftus, Kuykendall and Vonhof, AaJng Planning Director Blair Tremere, Assistant City Planner Deb Garross, Associate Planner Gina Mitchell, and Secretary Connie Carlson. Commissioner Roseth arrived at 7:10 p.m. REVIEW MINUTES OF PREVIOUS ~G MOTION BY LOFFUS, SECOND BY KUYKENDAI ] .~ TO APPROVE THE MINUTES AS WR1T'I]~. Vote taken signified ayes by Amold, Kuykendall, Loftus, and Vonhof. MOTION CARRIED. Brief discussion on the following: 1. Christmas party scheduled for Saturday, December 3, 1994. 2. Workshop(s) scheduled for the Planning Commission for the upcoming year. City Council is looking into the various workshops at this time. 3. Status of Comprehensive Plan to be presented by City Manager, Frank Boyles. ITEM I- VARIANCE/CONSIDER REQUEST FOR BRIAN O'BARSKI The Planning Department received a variance application from Brian O'Barski of 7624 West 157th Street, #306, Apple Valley. ~ O'Barski owns the property at 15371 Breezy Point Road, Prior Lake and presented his proposal to replace an existing cabin with a new single family home. The specific variances he is requesting are: 1. 4.35' north side yard variance fromthe 10' side yard setback requirement. 2. 44' lakeshore variance from the 75' lakeshore setback requirement. 3. 5' front yard variance from the 25' front yard setback requirement. 4. 3 % impervious surface variance from the 30% impervious surface maximum~ 5. A 2,706 square foot lot area variance from the 7,500 minimum lot area requirement. Associate Planner Gina Mitchell presented the Staff report dated October 13, 1994. The variances requested are consistent with variances that have been approved for other properties in the area. The DNR submitted a letter in support of the proposal. Builder, Ken Smith, 212 Walnut Lane, Apple Valley, presented a copy of the floor plans for the home. Comments from the Commissioners included: 75' setback from lake; drainage and erosion; and the proposed deck. All were in support of the requested variances. PLANNING COMMISSION October 13, 1993 Page 1 MOTION BY LOFTUS, SECOND BY ROSETH TO APPROVE THE FOLLOWING VARIANCES FOR THE PROPERTY LOCATED AT 15371 BRFFZY POINT ROAD: A 4.35' NORTH SIDE YARD VARIANCE FROM THE 10' SIDE YARD SETBACK; 44' LAKESHORE VARIANCE FROM THE 75' LAKESHORE SETBACK; 5' FRONT YARD VARIANCE FROM THE 25' FRONT YARD SETBACK; 3% IMPERVIOUS SURFACE VARIANCE FROM THE 30% IMPERVIOUS SURFACE MAXIMUM AND A 2,706 SQUARE FOOT LOT AREA VARIANCE FROM THE 7,500 MINIMUM LOT AREA REQ~. RATIONALE BEING THAT THE PROPOSAL IS CONSISTENT WITH THE NEIGHBORHOOD. IT IS A SUBSTANDARD LOT OF RECORD AND WILL NOT BE DETRIMENTAL TO THE HEALTH AND WELFARE OF THE COMMUNITY. Vote taken signified ayes by Roseth, Kuykendall, Loflus, Amold and Vonhof. MOTION CARRIED. Recess was called at 7:50 p.m. The meeting reconvened at 8:00 p.m. ITEM II - VARIANCE / CONSID ER REQUF_Sr FOR J AMES CHRISTENSEN The Planning Department received an application for variance from James W. Christensen of 3270 154th Street N.W. The applicant proposes to construct a new single family home. The previous home was built in 1880 according to the Office of the Scott County Assessor, and destroyed by fire within the past year. The applicant proposes to construct the new home on the previously occupied building pad. In order to construct the home in the location proposed the applicant requests the following variances from the Zoning Ordinance 330' farm building separation requirement from new construction homes: 200' north setback variance to the existing bam to the north of the proposed building site. 105' east side setback variance to the existing pole bam to the east of the proposed building site. Ma: Christensen explained the fire that destroyed his home and stated that he would like to rebuild on the existing home site. Assistant Planner Deb Garross presented the information as per the Planning report of October 13, 1994. This property has been a farm site for years. There are no livestock on the site. Staff reconuxends approval of the variances as requested. Conaxemts from Commissioners included: concem for neighbor's pole bam being located too close to applicant's home; reasoning for 330' setback; no previous health problems related to the pre-existing home being located closer than 330' to the bam; many farm sites are like this in the area. MOTION BY LOFFUS, SECOND BY ARNOLD TO GRANT A 200' NORTH SETBACK VARIANCE TO THE EXISTING BARN TO THE NORTH OF THE PROPOSED BUILDING SITE AND A 105' EAST SIDE SETBACK VARIANCE TO THE EXISTING POlE BARN TO THE EAST OF THE SUBJECT SITE. RATIONALE BEING HARDSHIP CRITERIA IN ZONING ORDINANCE HAVE BEEN MET. THE VARIANCE WOULD NOT BE CONTRARY TO THE HEALTH, WEItARE OR SAFETY OF THE COMMUNITY. Vote taken signified ayes by Roseth, Loftus, Amold and Vonhof. Nay by Kuykendall. MOTION CARRIED. MOTION BY KUYKENDAI l., SECOND BY ROSETH TO RECOMMEND TO THE CITY COUNCIL THAT STAFF RESEARCH THE BASIS FOR THE ZONING ORDINANCE SETBACK AND SEPARATION STANDARDS FOR BARNS AND OUTBUILDINGS IN RELATIONSHIP TO THEIR DWFI l INGS. Vote taken ayes by Kuykendall, Loftus, Amold, Roseth and Vonhof. MorION CARRIED. PLANNING COMMISSION October 13, 1993 Page 2 ITEMm - VARIANCE/CONSIDER RF~ FOR ROI LY HAUGH The Planning Department received a variance application from Rolly Haugh for the property located at 16080 West Avenue S.E. The applicant proposes to constmct a 20' x 20' detached garage 15' from the east front yard property line and therefore requests the Planning Commission to grant a 10' east front yard variance. Associate Planner Gina Mitchell stated Mr. Haugh informed Staff he had decided to withdraw his application. ITEM IV - CONSIDER HOME OCCUPATION REQ~ FOR JUDY JAHNZ The Planning Department received an application for a Home Occupation Permit from Judy Jahnz of 5313 Hampton Street NE, Prior Lake. The applicant is requesting the Planning Commission grant a Home Occupation Permit to allow her to operate a dog grooming business in her home. The applicant does not propose to have any employees initially, and plans to offer retail products once the business gets going. She believes that the maximum amount of dogs groomed within a week would be no more than 40. The applicant has stated there will be no more than 4 dogs at her home at any one time, and they will be in kennels when she isn't i~ately working on them. There will be no exterior signage. The maximum hoars of operation are proposed to be: Sunday & Monday: closed Tuesday & Thursday: 8:00 a.m. to 7:00 p.m. Wednesday, Friday & Saturday: 8:00 a.m. to to 5:00 p.m. Judy Jahnz stated she has done dog grooming before, and currently has a full time job. Ms~ Jahnz bought the house because she could set up her business in the basement. Associate Planner Gina Mitchell presented the Staff report dated October 13, 1994. Staff is of the opinion 40 dogs a week would create an excessive amount of traffic in the neighborhood. By limiting the number of employees to one, the proposed home occupation can operate consistent with past approved home occupations permits for dog grooming operations, and with the intent of the Home Occupation Permit chapter of the Zoning Ordinance, subject to the following conditions: 3. 4. 5. o No off-site parking; ample on-site parking for a maximum of two (2) customer vehicles must be provided. No exterior signage. No retailing of any products. No other employees beyond the one (1) employee/operator. No more than three (3) dogs be allowed on the premises at any one time, with separate kennels in the home provided for each. The hours of operation be limited to: Sunday & Monday: closed Tuesday & Thursday: 8:00 a.m. to 7:00 p.m. Wednesday, Friday & Saturday: 8:00 a.m. to 5:00 p.m. No transfer of the Home Occupation Permit. The Home Occupation Permit is subject to all applicable ordinance and legal requirements. Violation thereof shall be deemed grounds for revocation. Mitchell read into the record a letter received by the Planning Department from the Valeks. Their concerns were customer parking, number of pets, fencing and dog runs. Robin Farrell, 14128 Ash Circle, stated she does not want to hear dogs bark. PLANNING COMMISSION October 13, 1993 Page 3 Terry Hanson, 14142 Ash Circle, wanted to know what kind of control for traffic with grooming 40 dogs a week, and if them is an industrial park for this business that Staff would reco~d that the applicant locate. Acting Planning Director Blair Tremere stated the City has approved home occupation permits for dog grooming services and the ordinance provides for home occupations in the residential districts; and for for those reasons Staff would not direct an applicant to locate in a business zone provided the ordinance standards were met. Discussion by the Commissioners included the application is consistent with what has been approved in the past and support of the recommendations from Staff. There was also discussion following a question by Commissioner Loftus about the number of dogs the applicant owns and that approval of the home occupation permit can be made subject to the applicant complying with the number of dogs that the City Code allows. At this time the Applicant, Judy Jahnz withdrew her application. ITEM V - PRI~ENTATION BY CITY MANAGER, FRANK BOYL¥!q ON STRATEGIC PLANNING. The City Council felt is was appropriate to get a sense of direction for the community and last year hired Mr Kent Eklund of the consulting firm Cincinnatus. The main points of issue were: an entertainment/recreational corridor, co--iai office - induslrial park development, and housing. The City Council will complete a draft plan and tum the research over to the Planning and Business Development Committees. Discussion by the Commissioners included: use of the lake for recreational vehicles and places to eat; and deciding on a vision and marketing it. The Planning Commission would like direction from the City Council. He suggested a survey to f'md out the attitudes of community. City Manager Frank Boyles informed the Commissioners they had narrowed down the applicants for the Planning Director position and would like some involvement by the Commissioners in the in~rview process. Staff and City Council would also be involved. Applicants were recruited from other commtmities with only a few from out of state responding. MOTION BY ARNOLD, SECOND BY KUYKENDAI L, TO ADJOURN THE MEEFING. Vote taken: signified ayes by Loft'us, Amold, Kuykendall, Roseth, and Vonhof. MOTION CARRIED.
