(612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER PLANNING COMMISSION MINUTES October 27,1994 The October 27, 1994, Planning Commission Meeting was called to order by Chairman Vonhof at 7:00 p.m. Those present were Commissioners Roseth, Loftus, Kuykendall and Vonhof, Assistant City Planner Deb Garross, Associate Planner Gina Mitchell, and Secretary Connie Carlson. Commissioner Amold arrived at 8:06 p.m. REVIEW MINUrEs OF PREVIOUS ~G MOTION BY LOFI'US, SECOND BY KUYKENDAIIJ, TO APPROVE THE MINUIF_S AS CORRF_LWED. Vote taken signified ayes by Roseth, Kuykendall, Loftus, and Vonhof. MOTION CARRIED. ITEM I - VARIANCE/CONSIDER REQ~ FOR ARNOLD ERP. The Planning Department received a variance application from Amold Erp. The applicant requested the Planning Commission to approve the following variances in order to construct a porch addition over an existing cement patio. 5' south from yard variance from the 25' front yard setback requirement. 30' south front yard variance from the 50' State Highway 13 right-of-way setback requirement. Associate Planner Gina Mitchell presented the Staff report dated October 27, 1994. Staff feels the variances requested are reasonable and support the approval of the variances. Comrmnts from Commissioners included: ice build-up creating a safety hazard; slope of roof installation of gutters; rationale for S.T.H. 13 setback requirement; right-of-way width; and future plans for S.T.H. 13 improvements and possible impacts to a future hom~wr~r if variance is granted and S.T.H. 13 is widened. MOTION BY LOFFUS, SECOND BY ROSETH TO APPROVE A 5' SOUTH FRONT YARD VARIANCE FROM THE 25' FRONT YARD SETBACK REQUIREMENF AND A 30' SOUTH FRONT YARD VARIANCE FORM THE 50' STATE HIGHWAY 13 RIGHT-OF-WAY SETBACK REQUIRF_3/IENT RATIONAl JE FOR GRANTING THE VARIANCES INCLUDE ELIMINATION OF THE SAFETY HAZARD CAUSED BY THE ICE BUILDUP IN THE WlN'IER; THE SITE HAS UNIQUE TOPOGRAPI-~ BUILDING ENVELOPE WAS RESTRICTED DUE TO THE LEGAL NONCONFORMING LOT OF RECORD; THE PROPOSAL WOULD NOT BE DETRIMENTAL TO THE HEALTH, SAFETY AND WFI FARE OF THE COMMUNITY Vote taken signified ayes by Roseth, Loftus and Vonhof. Nay by Kmykendall. MOTION CARRIED. Discussion by Commissioners included: overall right-of-ways for State and County Roads; future expansions and setbacks. MOTION BY ROSETH, SECOND BY KUYKENDAII., TO RECOMMEND THAT THE CITY COUNCIL DIRECT STAFF TO REVIEW RIGHT-OF-WAY VS. CENTERLINE SETBACKS, AND CONSIDER ESTABI JSHING SETBACKS BY ROADWAY CLASSIFICATION. ITEM II - WORKSHOP - DISCUSS C-1 CONSERVATION DISTRICT - URB~UR~I, SERVICE AREA CLASSIFICATION Assistant Planning Director, Deb Garross, gave a brief history of the commtmity and explained that many zoning districts were established and carded over from most of the land annexed into the commtmity. Comprehensive Plan and zoning ordinance definitions, permitted and conditional uses were reviewed for the Agricultural and Conservation Districts. Discussion by Commissioners included: reclassification of A-1 and C-1 zones outside the MUSA to a "HZ" (Holding Zone) classification to be consistent with the Comprehensive Plan; a Holding Zone would be the designated land use until utilities would become available; state acts such as the Wetland Conservation Act and zoning restrictions such as a Tree Preservation Ordinance would be used to protect natural features; R-1 Zone in Titus Addition should be redesigned to another zone classification; set zoning discussions in stages. A recess was called at 8:57 p.m. The meeting reconvened at 9:03 p.m. rrm In - DISCUSSION- UPDATE ON STATUS OF THE WILDS PUD Assistant Planning Director Deb Garross gave an update on The Wilds PUD Plan and the development status of the single family homes, multi-family, conummial and a golf course. Associate Planner Gina Mitchell is researching all of The Wilds Ordinances, PUD, and land uses, to put together information as a reference document. Discussion by Commissioners included: some developers do not have a clear understanding of the PUD Plan and ordinances; The Wilds was approved the Fall of 1993; several potential amendments may be submitted in the near future such as ternix)mrily relocating the sales office which may become the temporary club house; private street concept; hotel; reduction of multiple family units and development options for commercial sites. Discussion on The Wilds Second Addition included: procedure for platting outlots, PUD Amendment or preliminary plat and final plats; impact of declining ratio of multi-family units; and tax impact. The Business Development Committee should be involved in any potential comtmmial changes in the PUD. The Metropolitan Council Regional Blueprint was handed out for reference. Commissioner Vonhof participated on a panel that interviewed candidates for the position of Planning Director. Selection should be made soon and possibly on staff in 30 days.
