The November 03, 1994, Planning Commission Meeting was called to order by Chairman Vonhof at 7:00
p.m. Those present were Commissioners Roseth, Amold, Loftus, Kuykendall and Vonhof, Assistant City
Planner Deb Garross and Secretary Connie Carlson.

ITEM I -VARIANCE / CONSIDER REQ~ FOR JUDSQN BROWN
The Planning Department received a variance application from Judson Brown of 16176 Evanston Avenue.
The subject site is legally described as Lot 1 and the North part of Lot 2, Block 11, Prior Lake Original
Townsite. The applicant proposes to construct a detached garage on the west, rear yard portion of the lot.
The specific variance requested is an 11' west rear yard variance from the 50 foot, S.T.H. 13 right-of-way
setback requirement.
Assistant Planner Deb Garross presented Staff report dated November 3, 1994. The home was built in the
center of the lot so that development options for a garage are limited on site. The applicant proposes to
construct a minimum size, double car, detached garage. The rear yard setback for the R-2 zone is 25'
however, the Zoning Ordinance permits detached structures to be located as close as 10" to the rear yard
property line. The hardship in this case is not caused by the applicant but is the result of Minnesota
Department of Transportation re-aligning S.T.H. 13 and subsequently the establishment of the 50'
right-of-way setback by the City of Prior Lake in 1983. Reconm-e. ndation by Staff is to approve the
variance request as the applicant has met all hardship criteria of the zoning ordinance.
Comrrents by Commissioners included: concern about encroachment toward S.TZI. 13 right-of-way; the
safety of walkway slab off house with ice and water buildup; possibility of an attached garage; aesthetics;
location of garage to north; and support of variance request.
Lori Brown of 16176 Evanston Avenue, stated there was a retaining wall next to their property and
practically and aesthetically a detached garage at the location proposed was the best alternative they could
find.

Commissioner Vonhof asked if one of the Commissioners would be willing to participate in the interview to
select the new Planning Director on Tuesday, November 15. The Commissioners will check their schedules
and get back to Commissioner Vonhof. Also, the Commissioners suggested a mock interview/presentation
in front of the Planning Commissioners at an evening meeting, possibly November 17; a video tape be
made of the candidates for Commissioner's review; and submit five interview questions from the
Commissioners to Administration. The Commissioners would like to meet with the new Planning Director
and discuss the concems of the Board.
There was a brief discussion on a preliminary workshop for the Business Park Development on Monday,
November 7, 5:30 to 7:00. Notices will be sent out to all Commissioners.
