HomeMy WebLinkAbout10F - City Council Vacancy CITY COUNCIL AGENDA REPORT November 18, 2002 10F PREPARED BY: Frank Boyles, City Manager AGENDA ITEM: CONSIDER APPROVAL OF A PROCESS AND TIMELlNE TO FILL THE VACANCY CREATED BY THE RESIGNATION OF COUNCllMEMBER MIKE GUNDLACH. DISCUSSION: Historv: Councilmember Mike Gundlach has submitted his written resignation from the City Council which is effective Monday, November 18, 2002 (attached). According to MN Stat. Section 412.02 subd. 2a vacancy, "Except as otherwise provided in subdivision 2b, a vacancy in an office shall be filled by Council appointment until an election is held as provided in this subdivision. In the case of a tie vote in the Council, the Mayor shall make the appointment... If the vacancy occurs....when less than 2 years remain in the unexpired term, there shall be no special election to fill the vacancy and the appointed person shall serve until the qualification of a successor elected at a regular City election." When Councilmember LeMair was appointed to fill the term of former Council member Ericson, the City Council utilized an open process and timeline. The same process and timeline is proposed to fill this vacancy. Current Circumstances: Attached for City Council review is a process and timetable recommended for filling this vacancy. The process contemplates notices (attached) and articles in two editions of the Prior Lake American. Applications would then be received from November 30th through December 21st. Candidates would be interviewed on December 30th at a special City Council meeting and the appointment would be made at the January 6, 2003 meeting. Conclusion: The City Council should by motion declare a vacancy to exist on the City Council and then determine if the proposed process is acceptable and if the timeline is appropriate. ISSUES: Given that there will be less than one year in the appointee's term (1/6/03 to 12/31103), it is important that the process be timely but effective at identifying the most appropriate candidate. The interviews would be conducted at a special City Council meeting on December 30th which would be cablecast. The questions will be drawn from the 2020 Vision and Strategic Plan. ALTERNATIVES: (1) Motion and second to declare a vacancy on the City Council. (2) Motion and second to authorize the staff to proceed with implementation of the process and timeline for filling the City Council vacancy. (3) Authorize the implementation of the process and timeline with amendments. (4) Take no action. The vacancy on the City Council wa created when City Councilmember Mike Gundlach submitted a resignatio effective November 18, 2002. pplicants must be 21 years of age and currently reside within the corporat limits of the City of Prior Lake for a minimum of thirty days. Council member receive $425 per month. Council meetings occur the first and third Monday 0 each month at 7pm. Work sessions are typically scheduled preceding eac regular Council meeting at 5:30pm. Councilmembers may be responsible fo attending other periodic day or evening meetings.
