This project is for the improvement of Toronto Avenue from Tower Street to Trunk Highway 13, the realignment of Vine Street to Tower Street and the extension of Duluth Avenue to the realignment of Vine Street and Tower Street. Improvements in this project include storm sewer, 9rading, paving, concrete curb and gutter, lighting and landscap1ng. Enclosed with this letter is the following: 1.) PERMIT APPLICATION 2.) THREE COPIES OF STORMWATER IMPROVEMENT PLAN 3.) THREE SETS OF BLUELINE DRAWINGS OF THE PLAN SHEETS. Erosion control barriers, as shown on the plans, will be installed adjacent to the wetland, around catch basins and other areas as the work dictates. INSTRUCTIONS The applicant must complete each section of the permit application. If any section is not applicable, the applicant should so state. Attach supplements or exhibits if more space is ne~ded to fully respond to any section. FEES Each applicant must pay a $lO.OO filing fee. The fee must accompany the application and be in the form of a check, bank draft, or money order ~, made payable to the "Prior Lake-Spring Lake Watershed District." The filing fee is refundable only if it is determined that a permit is not required for your project. The District may also charge a field inspection fee for actual costs incurred by the District to process, analyzel investi- gate, inspect and monitor the application and the proposed project. No permit application or field inspection fee may be imposed upon an agency of the United States or any governmental unit in the state. .' SUBMITTING APPLICATION Make sure to furnish all requested information and sign the application. Submit the application, filing fee and additional project data to the District at 4690 Colorado Street Southeast 1 Prior Lake, Minnesota 55372. Call the District Office at 447-4166, or its engineer, Eugene A. Hickok and Associates, at 473-4224, for assistance in completing the application. The application must be submitted at least ten business days before the next District meeting. The Rules promulgated by the District require that each application be accompanied by certain exhibits. The applicant must consult with the Rules to determine the required exhibits in each instance. ENFORCEMENT A violation of a permit issued by the District is a misdemeanor. The Rules and permits issued by the District may be enforced by criminal prosecution, injunction, action to compel performance, restoration, abate- ment and other appropriate action. In this project, Vine Street will be aligned to Tower Street & Duluth Avenue extended to meet the new alignment. Toronto Ave. From Tower Street to 600' north will be reconstructed with a permanent street section with the rest of Toronto Avenue to receive temporary improvements such as bituminous overlay and bituminous curbing. r 4. JUSTIFICATION (Explain why this project is needed) Existing traFFic circuletion to the Mall area needs improvement. The City is proposing to construct a "ring road" From 170th Street to Franklin Treil along T.H. 13 to better serve the commercial arees. The reeligning of Vine Street to Tower Street is necessary For the "ring road concept" and to obtein Municipal Stete Aid Funding. The existing Toronto Avenue needs to be upgraded to hendle the increase in traFFic volume. d 5. ENVIRONMENTAL IMPACT (Including unavoidable but detrimental effects) The reelignment of Vine Street to Tower Street will be located along the edge of a lowland eree. This aree has 32 Feet of peat deposits in locetions and will sattle when additional weight is placed For the roadbed. The City is proposing to use shredded tires as e lightweight fill to minimiza the settlement & time required. All provisions of the Minnesota Watershed Act, Overall Plan and Rules of the District, and the statements and conditions in the Permit Application, are by reference made a part of this Permit. 2. BY ACCEPTANCE OF THIS PERMIT, PERMITTEE ACKNOWLEDGES AND AGREES TO PERFORM ,AND BE BOUND BY ALL GENERAL AND SPECIAL TERMS AND CONDITIONS OF THE ISSUANCE OF THIS PERMIT. 3. Permittee will indemnify and hold the District harmless from any claims for injury or damage resulting directly or indirectly from the Project. 4. Before starting work on the Project, Permittee shall: a. Obtain and file with the District copies of any permits required by other governmental entities or agencies; b. If required by the District (see Special Conditions), deposit with the District a performance bond or cash and escrow agreement for an amount and on terms and conditions acceptable to the Board; and c. Notify the District of the date it intends to begin work, so that the work may be viewed in progress. 5. A Certificate of Completion, PLSLWSD Form 7 (86), shall be filed with the District within ten (10) days after completion of the Project so that a final inspection can be made to assure compliance with the Permit. 6. This Permit is not transferable, and is valid for one (1) year after its date. If the Project has not been commenced within the one (1) year period, Permittee must apply for renewal of this Permit. If work on the Project is under way, a time extension may be granted by the Board, on written request of the Permittee, for good cause shown. 7. Failure to comply with this Permit may result in its cancellation and constitutes a violation of the Minnesota Watershed Act (a misdemeanor). 8. If Permittee fails to comply with this Permit, the District may, at its option, perform any work necessary or incidental to cure the default. Permittee shall promptly upon demand reimburse the District for any expense so incurred by the District, provided that Permittee shall first be given at least 48 hours written notice by certified mail, return receipt requested, of the work in default and the requirements to cure the default. In the event of emergency, as determined by the District's Consulting Engineer, the 48-hour notice requirement to Permittee may be waived, and Permittee shall reimburse the District for any expense so incurred in the same manner as if mailed notice had been given. 9. All notices required to be given shall be sent to the addresses specified on page 1 of this Permit. 10. The Minnesota Pollution Control Agency (MPCA) has reviewed the City of Prior Lake }:I.l..vpvsal and based on available infonnation will not negatively bnpact the envi.l..vJB,cl1t if the following guidelines are followed: 1. TDP is used on! Y above water table; 2. Measures are taken to insure TDP is not exposed; and 3. Measures are taken to minimize water infiltration on driving surface of road and the side slope. Thompson Unit SUJ?ervisor Waste T1re Management Unit site Response section Ground Water & Solid Waste Division Dear Mr. Thompson: RE: REQUESTING APPROVAL FOR USE OF SHREDDED TIRES ON PROJECT #90-12, CITY OF PRIOR LAKE The City of Prior Lake is proposing to use shredded tire chips as a lightweight fill in the construction of the Vine Street/Tower Street roadway in the City of Prior Lake. The total amount of tire chips is estimated to be 2,600 tons and this letter is requesting written approval of the use of tire chips by your office. The following information is enclosed for your review of our waste tire use proposal: 1. Report of Subsurface Exploration Program and Addendum by Twin City Testin<1' (Report includes specification of type of tire der1ved product.) 2. Plan Sheets for Project #90-12 A. Title Sheet B. Typical Sections C. Street Improvement Plan Sheet D. Storm Sewer Plan Sheet E. Site Grading Plan 3. Letters from Attorneys regarding the use of tire chips. A letter was received by the City on March 20, 1990 stating the guidelines on the use of tire chips as a light weight material for subgrade roadbed construction. The following statements will address each guideline as it relates to our project: MPCA Guideline #1 Waste tires, bales of waste tires, or TDP cannot be used in saturated conditions. (Below the water table or in surface waters. ) 4629 Dakota St. S,E" Prior Lake, Minnesota 55372 Ph, (612) 447-4230 / Fax (612) 447-4245 The lowland area the City is proposing to cross is considered a dry ponding area since it has an outlet and does not hold water permanently. On Project #90-12, a 15" pipe outlet is proposed which would cause the lowland area to have a 100 year flood of 949.50. However, the water would flow out within 24 - 30 hours. The ground water level in this area as shown in the soils report for Twin City Testing is at elevation 940.00. The low point of the lowland area is at 943.80 which is the elevation the outlet pipe inlet invert is proposed to be. The estimated total settlement of the lightwieght fill method is 18 inches, thus the tires placed at the lowest elevation of the lowland of 944.0 would still be at elevation 942.50 which is above the current ground water level of 940.0. MPCA Guideline #2 Verification must be provided that the proposed use of the tires is economically and technically beneficial to the proposed project (as opposed to burial for disposal.) Refer to the Soils Report by Twin City Testing. The lowland area has peat deposits up to 32' in depth. A lightweight fill method as well as a surcharge method is described in the report. The amount of peat deposit is such that removal of the organic material and replacement with engineered fill is cost prohibitive. The lightweight fill method minimizes the weight on the peat and the associated settlement and has a lesser risk of a shear failure of the underlying peat deposits. MPCA Guideline #3 Measures must be taken to m1n1m1ze infiltration of water or leaching in the area of the waste tires, waste tire bales, or TDP use. Refer to the lightweight fill typical section plan sheet. A one foot clay soil cap and four inches of topsoil along with a geotextile fabric to separate the clay cap will extend over the top and sides of the entire embankment. Perforated sewer pipes will be installed upstream, from the lightweight fill area to intercept as much ground water as possible from entering the tire chip section. Also, the 15" pond outlet pipe is perforated to collect any infiltrated water in the tire section and to remove this water as soon as possible, and thus minimize the time any infiltrated water will have in contact with the tires. MPCA Guideline #4 Measures must be taken to insure the waste tires, waste tire bales, or tire derived product is not exposed to the environment at the surface of the construction project. Refer to the lightweight fill typical section. An urban curb and gutter with storm sewer roadway section is proposed for this area with the street and sidewalk areas graded to flow towards the storm sewer system. The side slope from the roadway to the lowland area will be a 4:1 slope and silt fences will be installed parallel to the roadway length along the lowland area to minimize erosion of material to the lowland. The height of the embankment area is 6.5' maximum in the tire chip section, thus the drainage area of the' side slope should not wash away the clay cap and expose the tire chips. Also enclosed are letters from the City's Attorney, Owen V. Nelson and Orrin M. Haugen, Patent Attorney on the proposed use of tire chips in our road improvement. These letters are being furnished as requested by Andy Ronchak of your office. Box 653 Prior Lake, MN 55372 Dear Mr. Franklin: RE: UNNAMED WETLAND, DULUTH AVENUE & TOWER STREET, CITY OF PRIOR LAKE, SCOTT COUNTY It was a pl easure meeting with you on Wednesday, July 18, 1990 to give you an assessment of the undeveloped property located in the southeast quadrant of Duluth Avenue and Tower Street in Prior Lake. Based upon the field inspection of July 18, along with subsequent review of maps on file at this office, I judge the area to be comprised of a mixture of type II/III wetland, bordered by a fringe of type IV wetl and and upl and hardwood forest. The innermost area was representative of type II/III wetland; saturated soils with some standing water, sedge, reed canary, and cattail the predominant vegetation types. I've estimated the wetland area to be roughly 2~ to 3 acres in size. As we discussed, the subject area is not a DNR-regulated wetland, thus, not subject to regulation in accordance with Minnesota Statutes, Chapter 105.42.
