PUBLIC HEARING TO CONSIDER APPROVAL OF A
RESOLUTION VACATING THE EXISTING DRAINAGE AND
UTILITY EASEMENT LOCATED ON THE TIMBER CREST
PARK SITE (CASE FILE #02-071)
History: Ray Brandt has filed an application to vacate the existing
drainage and utility easements located within the Timber Crest Park
property. New easements for the existing and relocated utilities within
the existing easement will be dedicated as part of the final plat of
Timber Crest Park.
Current Circumstances: The Planning Commission reviewed this
vacation request on October 14, 2002. The Planning Commission
recommended approval of the proposed vacation, subject to the
condition that the resolution vacating the easement be recorded with
the final plat.
The Issues: Minnesota Statutes 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states, "no such
vacation shall be made unless it appears to be in the public interest to
do so." The Comprehensive Plan does not specifically discuss utility
easements, other than as a function of ensuring access to public
utilities.
There is a sanitary sewer line currently located within the existing
easement. As part of the Timber Crest Park project, a portion of this
line will be relocated and extended to serve the new development. The
vacation of this easement is not inconsistent with any specific goal or
objective of the Comprehensive Plan. There is no need for the
retention of the existing easement once the final plat is recorded.
Conclusion: The Planning Commission and staff recommend
approval of this request, subject to the condition that the resolution
vacating the easement be recorded with the final plat.

1. Adopt a Resolution approving the vacation.
2. Direct staff to prepare a resolution denying the vacation.
3. Defer this item and provide staff with specific direction.
The Planning Commission and staff recommend Alternative #1. A
motion and second to adopt a Resolution approving the vacation of the
easement subject to the listed condition is required.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON
INTEREST COMMUNITY NUMBER 1079 (DEERFIELD CONDOMINIUM) ELEVENTH
SUPPLEMENTAL CIC PLAT

WHEREAS: On January 18, 2000, the City Council approved the preliminary plat known as
Deerfield, subject to conditions identified by Resolution 00-08; and
WHEREAS: On July 17, 2000, the City Council adopted Resolution 00-57 approving the
final plat of Deerfield 3rd Addition; and
WHEREAS: On May 7, 2001, the City Council adopted Resolution 01-53 approving the
final plats of Deerfield 4th Addition and Deerfield 5th Addition; and
WHEREAS: On August 5,2002, the City Council adopted Resolution 02-120 approving the
final plat of Deerfield 7th Addition; and
WHEREAS: The City Council has found that the Common Interest Community Number
1079 (Deerfield Condominium) Eleventh Supplemental CIC Plat is in
substantial compliance with the approved preliminary plat for Deerfield and
the approved final plats; and
WHEREAS: The City Council has approved the Common Interest Community Number
1079 (Deerfield Condominium) Eleventh Supplemental CIC Plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to
be met, prior to release of, and recording of said plat:
1. The recitals set forth above are incorporated herein as if fully setforth.
2. The final plat of Deerfield Jlh must be recorded prior to recording the Common Interest
Community Number 1079 (Deerfield Condominium) Eleventh Supplemental CIC Plat.
3. The CIC plat and all pertinent documents must be filed with Scott County within 60 days
from the date of final plat approval. Failure to record the documents by December 21, 2002,
will render the CIC plat null and void.
