CONSIDER APPROVAL OF A RESOLUTION ENTERING
INTO AN AGREEMENT TO PURCHASE AN EASEMENT
ON LOT 27, EASTWOOD ADDITION
DISCUSSION:
HISTORY
Estate Avenue is currently being reconstructed as a part of the 2002
Improvement Project (#02-11). During the design process, it was
discovered that a portion of the existing storm sewer pipe which
outlets to Prior Lake was not in an easement. Staff worked with the
property owner on whose land the pipe exists to purchase an
easement in the same location or on the adjacent property line. It
was determined that there were several obstructions. A better
location to outfall the storm water runoff was determined to be on
Lot 27 Eastwood Addition as the lot is vacant and there are fewer
existing features to be disturbed (see attached survey).
The City had the easement appraised and hired Dan Wilson, a land
acquisition specialist to negotiate an easement agreement with the
property owners, Laura Geraghty, Dennis Geraghty and Grace
Geraghty.
CURRENT CIRCUMSTANCES
The easement was appraised at $11,140.00. The Geraghty's have
agreed to sell the easement to the City for $16,000. In addition, the
pipe will be directionally drilled below the surface to minimize
disturbance of the lot.
CONCLUSION
An easement agreement was prepared by Mr. Wilson but it has not
been reviewed by the attorney for the Geraghtys' or the City
Attorney. Staff recommends that the City Council approve the
attached resolution and authorize the Mayor and City Manager to

enter into the easement agreement in an amount not to exceed
$16,000 once approved by the City Attorney's office.
FIINANCIAL IMPACT: The cost for easement in the amount of $16,000 will be funded
through the Water Quality Fund.
ALTERNATIVES: The alternatives are as follows:
1. Approve Resolution 02-XX authorizing the Mayor and City
Manager to sign the easement agreement once it has been
approved by the City Attorney granting an easement to the City
and authorizing payment to the property owners in the amount
of$16,000.
2. Table this item for a specific reason.
3. Deny the resolution.
RECOMMENDED
MOTION:
A motion and second as part of the consent agenda to approve
Resolution 02-XX authorizing the Mayor and City Manager to sign
the easement agreement following City Attorney approval granting
an easement to the City of Prior Lake and authorizing payment in
the amount of $16,0 0 to Laura L. Geraghty, and Dennis J. and
Grace Geraghty.

WHEREAS,
the City of Prior Lake is constructing storm sewer and roadway
improvements on Estate A venue; and
WHEREAS,
the City of Prior Lake requires a drainage and utility easement to run storm
water runoff to Prior Lake; and
WHEREAS,
Laura L. Geraghty, and Dennis J. and Grace L. Geraghty have agreed to
grant an easement over a portion of Lot 27, Eastwood Addition for drainage
and utility purposes as described on the attached exhibit.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE
THAT:
1. The Recitals set forth above are fully incorporated herein as if set forth herein.
2. The City Council authorizes the Mayor and City Manager to enter into the easement
agreement granting an easement to the City of Prior Lake and authorizing payment in the
amount of $16,000 to Laura L. Geraghty, and Dennis J. and Grace L. Geraghty upon
approval of the easement document by the City Attorney.
3. Funding for this easement acquisition is to be draw from the Water Quality fund.
Passed and adopted this 21 st day of October, 2002.
