CONSIDER APPROVAL OF JOINT RESOLUTIONS
AUTHORIZING ANNEXATION OF A PORTION OF SPRING
LAKE REGIONAL PARK AND APPROXIMATELY~ACRES
ADJACENT THERETO 1013
History In recent months, staff has had several conversations with the
County, Spring Lake Township officials and the Stemmer family and
their representatives regarding annexation of the remainder of Spring
Lake Regional Park and the Stemmer property that is adjacent to the
Park on the west (see attached map). These conversations led to the
request of the County Board in a letter dated September 3,2002 asking
for the annexation of the 275 acre portion of Spring Lake Regional
Park located in Spring Lake Township. In addition, the owners of the
65 acre Stemmer property petitioned for the annexation of their
property adjacent to the west side of the park. On October2nd, 2002,
the Town Board adopted the joint resolution authorizing the
annexation of the two properties. Copies of the signed resolutions are
attached.
Issues The primary issue is whether the two properties in question
should be annexed. In the 2020 Vision and Strategic Plan for the City,
the Vision Element Urban Expansion Area states that all development
that occurs in the Urban Expansion area should be consistent with City
of Prior Lake standards. Approval of the annexation would insure that
City standards would indeed be applied to these two properties as they
are developed. Annexation of the park and the Stemmer property
would help to achieve this Vision Element, bring the entire park within
the City limits, simplify and streamline needed approvals and plan
development, provide the most appropriate way to bring urban services
to the area and facilitate the reconstruction of CSAH 12 from Highway
13 to County Road 17..
Conclusion Staff concludes the proposed annexations are consistent
with the Vision 2020 and applicable Vision Elements. The Township
Board has also concurred with the annexation requests. In the case of
the Stemmer property, the Township will be paid $23,100 over the

next 12 months to compensate for lost future taxes. The property
owner has also agreed to limit the number of boat slips associated with
his development to no more than 30. The DNR indicates that 50 to 70
slips were possible, depending on the specific development plan
proposed.
1. Adopt the Joint Resolutions approving the annexations.
2. Deny the Joint Resolutions
3. Defer action for specific reasons.
Alternative 1- Motion and second to adopt Joint Resolutions. A
separate motion is required for each resolution. If adopted, the joint
resolutions would be submitted to the Minnesota Department of
Planning which would then have 30 days to review and comment on
the proposed annexations.

JOINT RESOLUTION
CITY OF PRIOR LAKE AND SPRING LAKE TOWNSHIP
A RESOLUTION ANNEXING PROPERTY FROM SPRING LAKE TOWNSHIP
INTO THE CITY OF PRIOR LAKE
WHEREAS, this Joint Resolution designates an area in need of orderly annexation;
provides for the conditions for its annexation; designates that no consideration by the
Minnesota Office of Boundary Adjustments is necessary, but that the Office may review
and comment, but shaff, within 30 days, orderthe annexation in accordance with the terms
of this resolution; and, reflects that the City of Prior Lake and Spring Lake Township,
hereby jointly agree to the following:
1. That the following descnbed property in Spring Lake Township is subject to annexation
pursuant to Minnesota Statutes 414.031 and the parties hereto designate this area for
orderly annexation, to wit:
SEE ATTACHED EXHIBIT A.
2. That the City CounCIl of the City of Prior Lake and the Board of Supervisors of Spring
Lake Township, upon passage and adoption of this resolution, and upon acceptance by
the Minnesota Planning Board, agree to the annexation of the aforementioned property
into the City of Prior lake.
3. That there is no change in electrical service provided for the subject annexation,
therefore, State Statute 414.0235 Subd. 1 A, is not applicable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PRIOR LAKE. SCOTT COUNTY, MINNESOTA, THAT: The City of Prior Lake approves
the proposed annexation of the aforementioned property from Spring Lake Township into
the City of Prior Lake.
4. Condidt!ons: 030 b?at slips, ~23.'lOO be paid to the Township for lost
revenue WIth 50% paId at the SlgIUng of the Resolution and 50% paid 12
months later or at fmal platt approval, whichever is frrst. .
