REPORT FOR NECESSARY IMPROVEMENTS TO CSAH 42 NEAR

DISCUSSION:
Historv
During the past year City Staff has been working with personnel from the City of
Savage, Scott County, and the Minnesota Department of Transportation
(MnDOT) on the new TH 13 intersection of Boudin Street/Commerce Avenue in
Prior Lake, and South Park Drive in Savage in accordance with the proposed
SuperTarget commercial development in the southeast quadrant of the TH
13/CSAH 42 intersection. In May 2002 the City entered into a Memorandum of
Understanding (MOD) with the City of Savage to design and construct the
necessary improvements to facilitate the Commerce/BoudinlSouth Park/TH 13
intersection. This "TH 13 MOU" included a provision placing the City of Prior
Lake as the lead agency for the project.
During this time period Savage has also received plans for a Cub Foods store in
the northeast quadrant of the TH 13/CSAH 42 intersection. Due to the volume
of traffic generated by the Cub and SuperTarget developments a traffic analysis
was completed for the TH 13/CSAH 42 intersection and area City streets. The
traffic analysis provided recommendations as to short and long term
improvements necessary to accommodate the current and future traffic through
this intersection. However, Scott County, City of Savage and Prior Lake staff all
recognized the physical limitations and features of the CSAH 42 corridor, and
mutually agreed that a thorough feasibility study of the area was needed. The
purpose of this agenda item is to consider entering into a MOU with the City of
Savage and Scott County to have WSB & Associates complete a detailed
feasibility report to address the needed improvements on CSAH 42.
Issues
The proposed MOU (attached) is only for the necessary Feasibility Report. The

total cost of the Feasibility Report is not to exceed $25,000 with the cities each
picking up 25% of the cost or $6,250 and the County covering 50% of the cost or
$12,500. The proposed "42 Feasibility Report MOU" provides that the City of
Savage be the lead agency for the project.
The Feasibility Report will identify necessary improvements needed on CSAH
42 between Boone Avenue on the west and Louisiana Avenue on the east. These
termini were chosen due to the probable turn lane improvements necessary to
accommodate future 2024 traffic demands near the TH 13/CSAH 42
intersection.
There is an open house scheduled for October 9 from 5 to 7 pm at the Edina
Realty offices on Commerce Avenue to gather input from the public for the
Feasibility Report.
FISCAL IMPACT: Budget Impact
The funding for the CSAH 42 MOU Feasibility Report should come from the
Collector Street Fund.

The City currently does not have any improvements on CSAH 42 identified in
the City 2003 to 2007 Capital Improvement Plan, nor does Scott County have
improvements shown in their CIP. Any improvements identified by the
Feasibility Report should be included in future CIP's and the funding should
come from the Collector Street Fund and Municipal State Aid Funding. Other
funding may be needed for utility improvements and should come from the
appropriate water, sewer, and stormwater quality funds, but will be further
identified when the feasibility report is complete. .

execution of the agreement.

The Cities of Prior Lake and Savage and Scott County agree that short and
long term roadway improvements are needed to accommodate traffic on
CSAH 42 between Boone Avenue and Louisiana Avenue, and
The Cities of Prior Lake and Savage and Scott County agree that short and
long term roadway improvements will serve to enhance public safety and
increase development opportunities in the region, and
The Cities of Prior Lake and Savage and Scott County agree that a detailed
Feasibility Report is needed to identify the necessary roadway
improvements, and
The Cities of Prior Lake and Savage and Scott County agree that a
Memorandum of Understanding, which outlines agency costs and
responsibilities, is the appropriate method to accomplish such a Feasibility
Report.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that:
1. The recitals set forth above are incorporated herein.
2. The City Council approves the attached Memorandum of Understanding with the City of Savage
and Scott County and authorizes the Mayor and City Manager to execute the agreement.
3. The funding for the Feasibility Report should be drawn from the Collector Street Fund.

MEMORANDUM OF UNDERSTANDING
Between
City Of Savage, Minnesota; City Of Prior Lake, Minnesota; and Scott County, Minnesota
This Memorandum of Understanding ("agreement") made and entered into on this _ day of September
2002, by and between the City of Savage Minnesota, a public body corporate and politic organized under the
laws of the State of Minnesota; the City of Prior Lake, Minnesota, a public body corporate and politic
organized under the laws of the State of Minnesota; and Scott County, a public body corporate and politic
organized under the laws of the State of Minnesota.
WITNESSETH:
WHEREAS, the City of Savage, the City of Prior Lake, and Scott County agree that major roadway
improvements are needed to the County Road 42 corridor, and
WHEREAS, the City of Savage, the City of Prior Lake, and Scott County agree that short-term and long-
term improvements will need to be made to County Road 42 to enhance public safety and increase economic
development opportunities in both communities; and
WHEREAS, major commercial developments within the City of Savage proposed for construction in 2003
have increased the urgency to identify the specific short-term and long-term improvements necessary on
County Road 42 in the area ofTH 13; and
WHEREAS, the City of Savage, the City of Prior Lake, and Scott County in cooperation with Opus and
Ryan Development Company have jointly completed a traffic study to evaluate the short and long-term
impact of development on the roadways within the TH 13/CR 42 quadrant; and
WHEREAS, the traffic study recommends improvements to Trunk Highway 13, County Road 42 and
supporting roadways to accommodate commercial and residential growth as well as future redevelopment;
and
WHEREAS, the City of Savage, the City of Prior Lake, and Scott County mutually agree that they shall work
together to develop a viable improvement plan for County Road 42, between Louisiana Avenue and Boone
Avenue; and
WHEREAS, WSB has completed a cost proposal in an amount not-to-exceed $25,000 for a Scope of Work
which is intended to identify those improvements that are necessary to pursue in 2003; and
WHEREAS, representatives from the City of Savage, the City of Prior Lake, and Scott County have
reviewed the cost proposal and find that the proposed cost is appropriate.
NOW, THEREFORE, IN CONSIDERATION of the mutual promises and understandings ofthe parties
hereto, the parties agree as follows:
1. The City of Savage and the City of Prior Lake shall each cover 25% of the consultant costs for the
proposed Scope of Work.
2. Scott County shall cover 50% of the consultant costs for the proposed Scope of Work.

3. The City of Savage shall serve as a lead agency in directing the consultant's work and the City of
Savage will invoice the City of Prior Lake and Scott County on a monthly basis, or as invoiced by the
consultant and the contractor(s).
4. The parties agree to proceed in good faith to complete the project pursuant to the understanding set
forth herein.
