CONSIDER APPRO V AL OF A CERTIFICATE OF
CORRECTION TO THE PLAT OF RED CEDAR HEIGHTS
History: On September 16, 2002, the City Council adopted Resolution
02-152 approving the final plat known as Red Cedar Heights. The plat
consisted of 4.34 acres, to be developed with 7 lots for single family
dwellings. The final plat documents were signed and recorded.
Current Circumstances: The surveyor recently discovered an error in
the dimensions of the curves for the dedicated right-of-way shown on
the plat. To correct this error, the surveyor is requesting the City sign
a Certificate of Correction to the plat. This certificate specifically
corrects the errors. It does not change any of the dimensions of the
lots.
The Issues: The Certificate of Correction is the proper way to correct
the errors on the recorded plat. The certificate does not affect the plat
as approved by the City Council. The required developer
improvements were included under the final plat, so no Letter of
Credit is necessary. In addition, the City fees normally associated with
a final plat have been collected.
Conclusion: A copy of the Certificate of Correction and the plat is
attached to this report. Staff will be available to discuss the details of
this plat with the Council.
Budf(et Impact: There are no budget impacts with the approval of this
Certificate of Correction.
The City Council has the following alternatives:
1. Adopt a motion authorizing the City Manager to sign the attached
Certificate of Correction.
2. Defer this item and provide staff with specific direction.

LAND SURVEYORS CERTlFICATE OF CORRECTION TO PLAT
Name of Plat: RED CEDAR HEIGHTS
Pursuant to the provisions of Chapter 505.174, Laws of Minnesota, 1957
Charles R. Christopherson, the undersigned, a Registered Land Surveyor in and for
the State of Minnesota, declares as follows: .
1. That I prepared the plat of RED CEDAR HEIGHTS dated and filed' on October
30TH. 2002 in the office of County Recorder, Scott County, Minnesota as Document
Number 569690.
2. That said plat contains errors, omissions, or defects in the following particulars, to-
wit:
The deltas and length of the south line of Lot 4, Block 1, (delta 38 degrees 29 minutes 35
seconds, length 83.98) and (delta 67 degrees 47 minutes 08 seconds, length 88.73) are in
error; the delta and length of the curved segments of the northerly line of Lot 2, Block 2,
(delta 105 degrees 46 minutes 52 seconds, length 138.47) and (delta 23 degrees 39
minutes 51 seconds, length 51.63) are in error, the delta and lengths of the centerline
curved segments of Overlook Drive (delta 105 degrees 49 minutes 34 seconds, length
184.70) and (delta 67 degrees 44 minutes 26 seconds, length 118.23) are in error; and the
bearing and distance of the dimension of the westerly line of the easterly drainage and
utility easement on Lot 2, Block 2, connecting to the point of reverse curve on the
northerly line of said Lot 2 (South 29 degrees 03 minutes 14 seconds West 33.78) is in
error.
3. That said plat is hereby corrected in the following particulars, to-wit:
The dimensions of the South line of Lot 4, Block 1 from west to east is as follows: delta
equals 38 degrees 36 minutes 47 seconds, length equals 84.24; delta equals 67 degrees 35
minutes 09 seconds, length equals 88.47. The curved segments of the north line of Lot 2,
Block 2 from west to east is as follows: delta equals 105 degrees 58 minutes 51 seconds,
length equals 138.73, delta equals 23 degrees 32 minutes 40 seconds length equals 23
degrees 32 minutes 40 seconds length equals 51.37.
The centerline curved segments of Overlook Drive from west to east is as follows: delta
equals 105 degrees 58 minutes 51 seconds, length equals 184.97; delta equals 67 degrees
35 minutes 09 seconds length equals 117.96. The bearing and distance of the westerly
line of the easterly drainage and utility easement on Lot 2, Block 2 connecting to the
point of reverse curve on the northerly line of said Lot 2 is South 29 degrees 24 minutes
03 seconds West, 33.62.

RE: Certificate of Correction to the plat of RED CEDAR HEIGHTS
Dear: Ms. Kansier
I have attached a copy of the Land Surveyors Certificate of Correction to Plat for your
review, approval, and signature. Also included is a copy of final plat with the dimensions
that are being revised for your information.
The reason for the correction is an error in the reverse curve points along the right of way
of Overlook Drive. This error was not caught by us or the County Surveyors office. The
positions of these points in the field did not move significantly but the mathematics must
be corrected. If you have any questions, please feel free to contact me or Steven
