BEEMM - VARIANCE CONTINUATION:
On March 17, 1988, Mr. Iarglard appeared before the Planning Commission to
request a lot size variance according to Section 9.3B1b of the Shoreland
Ordinance. The Commission continued the hearing to give the applicant time to
explore the possibility of acquiring additional property from the adjacent
homeowner to the east. Mr. Bergland was unable to obtain additional property to
bring the site to the 7,500 square feet required by the Shoreland District. (see
attached letter from Laurence Bergland dated 5 -9-88)
My recommendation is for the commission to consider the variance. In the event
the CommUssion does not grant the variance, than the City Council will decide
the issues of whether to Duke the site buildable or refund the assessments.
STEVE TOM - EXTENSION OF CODITICIM USE REMIT
Mr. Towle was granted a Conditional Use Permit on May 4, 1987, to construct a
car wash on Lot 1, Block 1 James 1st Addition. Section 7.7 of the Zoning
Ordinance invalidates the permit one year from the date it was issued unless a
building permit has been issued to implement its purpose. Mr. Towle has
petitioned to extend his permit in a letter dated April 19, 1988. (attached)
The letter does not include reasons nor a time frame for the extension.
Section 7.7 of the Zoning Ordinance does not provide for an extension. The
invalidation one year after the issuance date is mandatory and cannot be
extended. No action is required in this case.

The Common Council of the City of Prior Lake met in regular session on Monday,
December 21, at 7:30 p.m. in the City Council Chambers. Present were Mayor
Andren, Councilmembers Fitzgerald, Larson, Scott, White, City Manager Dave
Unmacht, City Planner Graser, Assistant City Planner Garross, Assistant City
Manager /Economic Development Director Schmudlach, and Assistant City Attorney
Brenner.
Mayor Andren called the meeting to order and asked everyone to rise for the
pledge of allegiance.
The minutes of the December 7, 1987 Council meeting were reviewed by Council.

The next order of business was the distribution of prizes for the "Catch the
Seasons" Spring /Summer photo contest. Assistant City Manager /Econanic
Development Director, Kay Schnudlach, reviewed sane of the details of the
contest and then introduced DaVid Miller who helped coordinate the contest.
Puller then introduced each prize winner and handed out the prizes, and Mayor
Andren distributed the Certificates of Appreciation. ']fie winning photos will
be hung throughout City Hall.
The next order of business was a Public Hearing on Green's First Addition,
Preliminary Plat. Mayor Andren called the Public Hearing to order at 7:45 p.m.
and read the legal notice as it appeared in the Prior Lake American on December
7, and December 14. Ron Swanson of Valley Engineering spoke on behalf of the
developers of the Plat. Assistant City Planner, Deb Garross, reviewed the
details of the request for preliminary plat approval as presented by
owners /developers, Roger H. and David J. Green. The question of clear cutting
which had taken place on the property was discussed extensively. Mr. Green
denied any knowledge of the City Ordinance against clear cutting and said he
would consider restoration measures.
MOTION MADE BY SCOTT, SECONDED BY FITZGERALD, TO APPROVE THE REQUEST FOR
PRELIMINARY PLAT SUBJECT TO THE FOLLOWING STIPULATIONS:
1. GRADING PLANS BE REVISED AS REQUIRED BY THE CITY ENGINEER.

The next order of business was a Ublic Hearing on Amended Resolution 87 -67 for
a Reserve Vacation. The Public Hearing was called to order at 8:26 p.m. and
Mayor Andren read the legal notice as it appeared in the Prior Lake American on
December 7, and December 14. Assistant City Planner Garross presented an
overhead of the area and outlined the details pertaining to the vacation. A
question was raised by Attorney Norbert Traxler as to whether or not the City
had an interest in the area proposed to be vacated. Extensive discussion
followed.
MOTION MADE BY WHITE, SECONDED BY LARSON, THAT COUNCIL TABLE THE ISSUE FOR AN
INJDEFINITE PERIOD OF TIME IN ORDER TO OBTAIN MORE INFORMATION, AND WITH THE
TABLING OF AMENDED RESOLUTION 87 -67 THAT THE PREVIOUSLY PASSED RESOLUTION BE
SUSPENDED UNTIL A DECISION RAS BEEN CLARIFIED.

Liquor License Issue. City Manager Unmacht reviewed the details of the past
hearing and discussed the Administrative Law Judge, Peter C. Erickson's, Finding
of Fact and noted that the written argument from McWillie's Legal
Representative, Norbert Traxler, had been received by Assistant City Attorney,
Caryn Brenner and by the Prior Lake City Council. Assistant City Attorney
Brenner clarified several points in question for the Councilmembers. Discussion
followed.

objections and arguments were sufficient and an oral argument was unnecessary.

inquired as to what penalties have been levied in the Past for similar types of

Note of record - the intent of the Council is that the Liquor License of the
establishment be suspended until the fine has been paid. (If fine isn't paid

The next order of business was consideration of Consent Agenda item (i)
Conditional Use Permit Amendment for SAS Car Wash. Councilmember Larson
expressed his concerns regarding the Conditional Use Permit Amendment. City
Planner Craser presented the details of the request to amend the Conditional Use
Permit, Discussion followed regarding the orignnal intent of the Council when
they approved the Conditional Use Permit in May of 1987 and why SAS now wished
to change the original plans.

The next order of business was a continuation of the Mollenhoff request for a
parking space on Quaker Trail. City Manager Unmacht reported back to the
Council on information requested from the last meeting. Mr. and Mrs.
Mollenhoff were appealing the Staff's decision to deny their parking request on
Quaker Trail. Discussion followed regarding the findings on ownership of the
street in question and whether or not the Mollenhoff's had street access. The
Mollenhoff's were given two options: (1) they could petition the City for street
improvements, or (2) they could plow the road themselves. No further action
was taken.
The next order of business was a report on the City's Personnel Policies and
Procedures Manual by City Manager Unmacht. The Manual consists of thirteen
sections and will be finalized after the City Attorney has a chance to review
and comment on the Manual's consistency with City Statutes and Codes. Council
briefly reviewed the document and City Manager Urwnacht requested that Council
share any ideas or concerns they may have with the Manual.

The next order of business was a presentation of the Comparable Worth Report by
Staff. Ed Wells, Consultant for DCA Stanton Inc., was present to answer any
questions. Discussion followed.

Council directed Staff to prepare a Resolution accepting the Study.

Manager. Council agreed to use the sane format used last year.

Oouncil /Manager workshop. The first two weeks of February were suggested as
dates to consider for the workshop. Oanerai input was provided to Staff by the
Council with regard to the workshop.
The next order of business was discussion of using money from the contingew;
fund to provide badly needed inprovenents for the Library.

Councilmenber Fitzgerald suggested that the monthly reports such as Police and
Fire Reports be structured in a more informative format, possibly to include a
neighborhood identification.
Assistant City Attorney Brenner informed Council that the Mcwillies On -The -Lake
penalty be in writing, signed by the City Manager and mailed to Janis Ballard,
Attorney Norbert Traxler, Administrative Law Judge Peter C. Erickson, and
Brenner herself.
City Manager Unmacht handed out new Scott County maps.

RATE: DECEMBER 21, 1987
INTRODUCTION: SAS Development Inc. has submitted a petition dated November
16, 1987 (attached) to amend their Conditional Use Permit
granted May 4, 1987. The Conditional Use Permit permits SAS
Development to construct a car wash on Lot 1, Block 1 of
James 1st Addition. The petition requests the City Council
to drop the requirement for the water reclamation system.
The Conditional Use Permit will expire on May 4th, 1988
unless a building permit has been issued for its purpose.
BACKGROUND: The major emphasis during the initial permit review was the
restricted sanitary sewer capacity and total water
reclamation system proposed by SAS Development to address the
lack of sewer capacity. The current permit requires the
applicant to construct an L shaped building consisting of
four self service bays and are full service bay. The
building and site is to be fully landscaped. (See attached
May 4th, 1987 Council Minutes.)
On 0(. Ober 29, 1987 the Planning Commission conducted a
hearing for SAS Development to amend the Conditional Use
Permit to change the shape of the building, drop the water
reclamation system and increase the self service bays from 4
to 6 and drop the automatic bay. This amendment was approved
by the Planning Commission but at the request of the
applicant never brought before the Council.
Along with the amendment currently under consideration was a
request by SAS Development Inc. to strike the October 29th
Conditional Use Permit Amendment and reinstate the original
permit but without the water reclamation system.
The Planning Caaaission conducted a hearing on November 19,
1987 and approved the request with the following motion:

The facts which permitted this amendment came from City
Engineer Larry Anderson. He found that the North Shore Sewer
Project diverted sufficient flow to the west to free up
excess capacity downstream from the car wash. SAS
Development submitted their water usage calculation and were
checked by Planner Horst Graser for validity. A comparison
with Revak and Triangle Car Wash is as follows:

Staff recommends the Conditional Use permit be amended to
drop the required water reclamation system. All applicable

CITY OF PRIOR
The applicant, SAS Development Inc., has petitioned the City to amend their
Conditional Use Permit for a car wash granted by Council on May 4, 1987 and
amended by Planning Commission on October 1, 1987. (5 -4 -87 Council minutes are
attached). The amendment by Planning Commission on October 1, 1987 deleted the
water reclamation system and allowed the 4 self service bays and 1 automatic bay
to switch to 6 self service bays. The amended site plan indicates a rectangular
shaped building versus an L shaped building on the original concept.
The applicant now wants to go back to the original concept but excluding the
water reclamation system. Originally the City required such water conservation
measures due to limited systems capacity. The City Engineer conducted a study
prior to the October amendment and determined that the North Shore project
diverted enough flow to create ample excess capacity in the trunk line to which
the car wash is tributary.
The site plan for this amendment lacks specificity. Since the outset of this
Conditional Use review in may of this year the applicant has failed to include
certain staff required in his site plan. They include a landscape
plan, grading plan, concrete curb on internal drives and dumpster requirements
according to city code. The storm sewer system as proposed in this submittal is
also not acceptable. Before a building permit will be granted these items must
be satisfactorily resolved.
SAS Development did not request the October 1st Planning Commission
recommendation on the Conditional Use Amendment go to City Council for approval.
By their application dated November 16, 1987 (attached) SAS Development forfeits
the Planning Commission recommendation of October 1, 1987 regarding the SAS
Development conditional use permit.
Staff suggests the Planning Commission approve the requested amendment since
proven reserve capacity exists in the subject trunk line. The attached site
plan accompanying this amendment should not be accepted but rather the original
site plan submitted for the review should be maintained for the record. The
motion should be to amend the SAS conditional use permit deleting condition
number 3 as outlined in the Council minutes dated May 4, 1987.

Denny Fitzgerald, 15060 Fish Point Road, developer commented on the plat with
regard to dam sizing the lots from 10 to 9, a pond on the lot donated to the
city, a trail path an the 10th lot, and due to taxes the developer cannot afford
to keep the lots and requests preliminary plat approval.
City Planner Graser canted per memo dated September 29, 1987, and also stated
that City Parka Director, Bill Mangan rejected the Mark fee of the pad donation
since this is not the type of pad for a park. In this case, cash in lieu of
land for this plat would be required. City Planner Graser presented a plan
utilizing Omega Trail for lot plans.
At this time audience input was called for.
The area residents had concerns over the high density causing traffic problems
and safety, steep grades off lots on Fish Point Road for drainage and driveways,
preserving the natural area, compatibility of the proposed homes to the area,
and development cost of Cmega Trail.

Staff has received a proposal from SAS Development to amend the Conditional Use
Permit that was issued to them in May of 1987 for a superspray car wash. The
amendment is outlined in a memorandum from SAS Development dated September 24,
1987 and attached. For comparative purposes you will also find attached
supporting data which was submitted for review in May. The Conditionrl Use
Permit was granted by City Council on May 4, 1987 and subject to the fo- lowing
three contingencies:
LANDSCAPE AND LIGHTING PLAN ACCEPTABLE TO STAFF BE SUBMITTED.
2. THE HEIGHT OF THE BERM ALONG THE WEST PROPERTY LINE BE INCREASED TO
BETWEEN FOUR AND FIVE FEET ABOVE THE GRADE OF THE LOP AND EXTENDED TO
THE NORTHERN TERMINUS, AND THAT BERMING ALOFT THE COMMERCE AVENUE
FRONTAGE BE CONSIDERED BY STAFF AND APPLICANT.
3. THE APPROVAL ALSO To BE PREDICATED ON THE FOR'1HODMING ANALYSIS BY THE
METROPOLITAN WASTE CONTROL COMMISSION APPROVING THE RECLAMATION SYSTEM
AND VERIFICATION OF ONE SAC UNIT CHARGE.
These contingencies have not been met consequently the Conditional. Use Permit is
not valid. However, it is expected that prior to issuance of the building
permit these issues will be addressed. The amendment if approved will delete
the self service bay and the 1008 water reclamation system. Instead of the four
self service and one automatic bays, the applicant is requesting six self
service bays. According to the applicant, cost was the primary motivation for
the amendment.
It is highly unfortunate that the self service bay is being eliminated. Such a
service is not only but also adds some sophistication and character to an
otherwise mundane use. Hopefully the design takes future conversion to a full
service car wash into account.

The key issue in May was the inpact on the City's sanitary sewer system. Until
a major portion of the flaw from the Sand Pointe P.U.D. was diverted to the
viest, the System. downstream fran the subject site was near capacity. A recent
study by the City Engineer revealed exoess rapacity in the system, therefore,
eliminating the need for water conservation techniques.
SAS Developnent has submitted their water usage calculation (attached). Their
assumption concur with established water uses of the Triangle Car wash and Revak
Car Wash.

the new proposal are for the first building. If the Commission feels it is
imperative these be provided then the pror, al should be tabled.

ITEM III - CONCEPT PLAN _AD1D31' BY MAF2V FY;GUM
Mary Eggum, developer, commented on the request to develop the Farnum farm which
is 7 acres zoned R-1 into 8 lots with 90 to 100 foot widths. Mr. Eggum further
commented on the extensive grading and filling required, City Staff has been
consulted with regard to utilities and drainage, the existing buildings will be
turned over to the fire department for training if desired, and due to the
extension of County Road 21 and the selling of all his lots, a time element
here is important for Mr. Eggue.
Assistant City Planner Garross commented with regard to the concept plat on lot
size, berms, hills throughout, Storm Seater Management Plan for 100 year flood
elevations, saving of a few Oak trees, extensive grading and filling, utilities,
easements needed, driveway access and setbacks depending on County Road 21
alignment, time frame and future access south from abutting subdivision.
The Planning Ccwmdssioners discussed the concept plan with regard to outlot A
donated to the City, road access from County Road 21 or a frontage road, grading
and filling, erosion to pond, Storm Water Management Plan 100 year study taken
into account, cul-de -sac done properly, and any concerns of area residents.
ITEM IV - REZONING DISCUSSION OF WILICW$ 77H ADDITION BY TOM SMEMS
Greg Halling representative for Tam Steffens, discussed the proposed framework
as it relates to zoning and design. The property is zoned R-3 and B-3 but due to
the market forces today they would like to rezone the property to fit single
family and multiple hones but leave the B-3 district. Mr. Halling also
commented on the ponding, little grading of the flat land, and connecting
streets.

The Planning Commissioners discussed the Willows 7th Addition and were in favor
of the rezoning from R-3 to R-1 for single family hones. However they had
concerns over the raw of lots next to the business district, the inclusion of
multiple units in the northern edge of the site, the intersection of Spring Lake
Road and Highway 13 to the Willows, interconnecting of neighborhoods, and a
walkway to Five Hawks School.

This review process was continued from March 5, 1987. Specific directions were
given to the applicant regarding the building and landscaping. The revised
proposal is attached.
In general, the proposal has been upgraded however not to the detail. requested.
The stacking distances on site have been increased by moving the access south
thereby permitting a 21 vehicle stacking capabiliLy. The landscape plan has
been altered to reflect staff's comments however, several items still are
absent.
1. The landscape plan designed by a registered landscape architect.
2. The height of the berm increased to 4 or 5 feet.
The exterior construction materials for the building have not been submitted. I
suggest that a sample of the brick be submitted. The internal curbing has been
upgraded to concrete. The elevation indicates that drainage will Fhoot across
the lot to Oammerce Avenue. The entire property will be sodded instead of
seeded.
The main .issues are the exterior material and berm heights. Unless they are
resolved, the proposal should be continued. The landscape plan could be made a
contingency item subject to staff review. Subject to above referenced issues
the proposal should be approved.

The Planning Commissioners discussed the proposed amendment, the purpose of the
B-1 District and the compatibility of the use with existing business and
residential development. The Commissioners were concerned with architectural
style, neighbors opinion, landscape plan, parking and radii of driveways,
elevations, berming to protect the residential district frc„ light, sound,
visual, noise and pollution, outside storage, reclamation system and impact on
the the sewer system and proposed signage. The general consensus of the
Cammission was that if designed properly, a car wash facility could be
introduced without detrimental impacts to the area.

Greg Balling, Engineer for Rebder Wenzel, and representative for the developer,
commented on the request to increase the density of the P.U.D. to 118 units with
the annexation of Holly Court. The proposed development framework consists of 2
single family hones which would be located off Roanoke Street, one 12 unit
building and six 5 unit buildings on 13 acres in Holly Court for a total density
of 50 units. Mr. Balling presented pictures of the building knoll showing the
disturbed land and trees already dead from grading. Also the pictures showed
the type and style of units in Burnsville which will be incorporated here. Mr.
Halling also commented on sidewalk along Five Hawks, additional parking stalls,
trash handled by resident, location of development with respect to the 10 year
flood plain, and the biggest concern of the tot lot on 1 1/2 acre site.
City Planner Graser commented per memo dated 3/3/87 with regard to memo's
presented by City Engineer, Larry Anderson and Parks Director, Bill Mangan.
Also concern over the guidelines of a P.U.D. being upheld such as steep slopes,
design of units, density, 100 year flood plain, every portion of the development
made to be the best place to live, elevations, natural features, mature trees,
mee ting setbacks, non - buildable low area, and tot lot consideration.
At this time audience input was called for.
The area residents were opposed to the increased density proposed, destroying of
natural feats. -as, de- valuation of their property, and impact of development on
the enrvirL:mentally sensitive area. Residents were also opposed to the proposed
location of th tot lot because they felt children would trespass into their
Property.

The Planning Commiissioners had concerns over the increased density, haw changes
from the first P.U.D. request to this amendment affect the density bonuses
given, if density bonuses can be re-evaluated, tot lot location, destruction of
elopes, developers lack of concern for :he environment, amount of buildable
area, trail/walkways, aesthetic design, damage to natural features, engineering
and parks meet's. The Commissioners were concerned that the density the
developer is attempting to achieve is in direct conflict with the goals of
P.U.D. development as specified in Section 6.11 of the Zoning Ordinance.

SOPERSPRAY CAR WASH
Planting plan needs additional information on size of material.
For example the Douglas Fir Should be specified at six feet in
height and the deciduous material would need to be 2 1/2" B and
B. The selection of Douglas Fir, Linden (greenspire) and summit
Ash are acceptable materials and have been used elsewhere in this
plat. However, the White Cedar and Robusta Poplar will not be
satisfactory. The Cedar has an unattractive color during winter
months and the poplar are not likely to live very long. It seems
to me that the emphasis on landscaping, from the City's point of
view, should be directed toward the berm and its function of
separating business uses from residential uses. I would
recommend that Pine (Norway) and Summit Ash should be introduced
on the berm as replacements. The Douglas Fir on the other hand
could be reduced in quantity particularly on the south boundary
of the site. One final comment is that the Linden at a 15 foot
spacing are likely to be much too close together. In addition
this location may not be good, particularly if the car wash were
to be expanded by another bay or two to the south at a later
date. I would also scr}gest that the Ash along the street right
of way should maintain spacing of 49 feet except where the access
drive prevents it.

CITY OF PRIOR LAKE
The developer, SAS Development is proposing to construct and operate a
self-service and automatic car wash on Lot 1, Block 1 of Janes 1st Addition.
Before such a use can be constructed, the applicant must be successful in
amending the Zoning Ordinance and obtaining a Conditional Use Permit. I have
scheduled both the Conditional Use Permit and Code Amendment hearing
contemporaneous in order that both issues can be discussed. Only a few months
ago in a similar case the Planning Commission, City Council, and public had a
difficult time separating zoning and conditional use issues.
The Zoning Code Amendment proposes to permit car washes as a conditional use in
the B-1 Limited Business District. This evaluation process involves all B-1
districts and is much more general, and purposeful in nature. On the other hand
a Conditional Use Permit is site specific and may be approved based on positive
site and construction elements.
The B-1 Limited Business District is intended to provide business opportunities
adjoining high and medium density residential districts on major streets for
offices, retail and service establishments. There are four B-1 districts in
Prior Lake totalling about 20 acres. Two are located at the extreme reaches of
the Highway 13 business strip at County Road 42 and 170th Street. The other two
are more centrally located with respect to other business zones at Franklin
Trail and Highway 13 and south of intersection Highway 13 and Duluth Avenue.
The B-1 district was originally envisioned to provide transition between
residential and more intensive districts and land uses. However, its original
intent has gone by the wayside since this district has been intensified via
amendment process. Its purpose is no longer an integral part in land use
transition or neighborhood shopping opportunities but serves as just another
strip shopping area. The districts location and access to Highway 13 sealed its
fate. In 1975 the B-1 district consisted of the following permitted uses;
personal and professional services, funeral homes, clinics, and offices and
banks. Twenty acres of such uses would require a much larger population base to

support it. Most importantly the developers of such land did not want to wait
an eternity for a market to develop. The R-1 district for all practical
purposes is now similar to the B-3 district. Prior Lake has processed
application after application to change the district but where do we stop?
Perhaps we should face the facts and rezone the County Load 42 site. But L
cannot face the possibility of exterior storage uses on this site were it zoned
B-3. Moreover what will take the place of the old B-l. Zone? We should be
moving towards establishing a new neighborhood commercial zone.
Currently there are two car wash facilities in Prior Lake, one in the B-1 zone
which is a non - conforming use and the other is in the B-3 zone which requires a
conditional use to operate. Out of the 20 acres of B-1 lard only 5 lots are
vacrnt. The car wash is a service and convenience orientated business similar
to a PDQ store, bank and convenience care facility. It is similar in mass and
does not over burden the road system with traffic. It is a use that does not
have outside storage nor require large amounts of on-site parking. Such a use
can be accammodated in the B-1 districts without negative impact or compromising
other uses. Since it would be a conditional use, Prior Lake will retain the
flexibility of evaluating every proposal.
The Conditional Use Permit application is for a self -service and automatic car
wash facility on Lot 1, Block 1 of James 1st Addition. The property abutts an
R-1 residential zone on the west and B-1 Limited Business on the north, east,
and south. Existing uses in the immediate area include a bank and clinic,
liquor store, PDO store and single family homes. Commerce Avenue provides
access to the site. At the time of platting T.F. James Company was required to
grade a berm of adequate height and width along the entire west side of the
plat. The berm, when landscaped, will provide separation between the R and B
districts. On this lot the berm does not extend to the north terminus of the
west property line and its extension should be a condition of approval.
The planting plan is not adequate and must be done by a registered landscape
architect. The Austrian Pine plantings on the berm is generous but the Pfitzer
Juniper should be removed and perhaps clumps of Birch introduced. The lot must
be sodded rather than seeded. The berm on the south side of the building is in
the expansion area. The plant material could be used elsewhere on the lot,
perhaps along the south property line.
The construction material is scheduled to be split face concrete block which is
inconsistent with the other buildings in this commercial strip. In addition to
a rather ugly block the building has no windows and six large garage doors. The
proposed color is tan with facia material to be of redwood or oedar. Block
should not be allowed but rather emphasize brick of a color similar to the
existing construction. A window should be required adjacent to the front
entrance. The dark brown aluminum doors may rust and must be replaced if this
occurs. Do they have a raw of windows in them?
The site plan features two entrance points fran Cmmerce Avenue. The most
easterly drive is poorly designed and must intersect at right angles and does
not need to be wider than 24 feet. The northerly drive lines up with the
north -south section of Cmwrce which makes a goad intersection. The miniam
parking and driveway setback from R-1 property is 20 feet. This plan has a
drive that is at the setback line for over half of the site. Is that being
sensitive to the single family homes adjacent to the west? Also the garbage
enclosure does not meet our ordinance.
the equipment will consist of coin operated machines that apparently are state
of art. The facility will be equipped with a 1006 water reclamation system.
Scheduled hours of operation are from 7:00 A.M. to 10:00 P.M. year round.
Attendants will be on duty to open and close the use and police the grounds.
Car washes in general are qutet, poorly integrated into a district, unwholesane
and poorly maintained. The County road 42 and Highway 13 area is well
established but the ap4.licant has chosen to ignore the character and has
proposed a typical car wash that is lacking design detail, has ugly block, no
windows, a seeded yard, a partially enclosed duapeter, a driveway that does not
cmnply to code, no elevations and out of scale.
Under sane circumstances a car wash could be introduced to the neighborhood but
not this one. This petition should be denied.

Introduction*
Applicant proposes to develop a car wash in James let Addition on Lot 1 Block 1.
To accommodate the applicant the Planning Commission has held two public
hearings. One to amend Section 3.2 of the Zoning Ordinance by introducing car
wash as a permitted use, and the second hearing was the evaluation of the
Conditional Use Permit.
Discussion-
Both staff and Planning Commission are recommending the adoption of the
amendment and approval of the Conditional Use Permit. My memo dated 3 -2 -87
(attached) discusses the issues and concerns. Since then the applicant has been
willing to upgrade and/or change those unacceptable elements of the plan as
requested by staff. The major issues in this application were use separation
between residential and commercial and use integration.
The original submittal was disrespectful to the area. Since then the
development plan has been upgraded substantially and acceptable to staff. The
only unresolved issue is the landscape plan which has been completed by a
landscape architect as requested by staff. However the plant material is
unacceptable to staff. The applicant has been given a list of acceptable plant
material.
Reccmmendat
Approve the Zoning Code Amendment to add car wash as a Conditional Use in the
B-1 Limited Business District.

SAS Development, a Minnesota corporation proposes to build and operate
a self- service and automatic car wash facility in Prior Lake, M.
Enclosed following is all pertinent information for purposes of describing
project, location, operation, ownership and impact on the Prior Lake
community.

DEMOGRAPHIC INFORMATION
A. Prior Lake, Minnesota is a suburban community of the greater
Minneapolis -St. Paul area located south of the Minnesota River
between Savage and Shakopee. Its population is comprised of
primarily middle clan. families who commute to other locations
for employment. Current population is approximately 10,000 people
with expected consistent growth through the next ten years.
Population is younger than average and has experienced a significant
growth during the previous 3 -5 years.
B. Vehicle density into Prior Lake area as measured by average
daily traffic counts on Highway 13 south is 18,000. Vehicle
registrations in the immediate Prior Lake area currently number
15,000.
C. Area for proposed car wash location is in the southwest corner
of Highway 13 and County Road 42. This is a high traffic cornet
for Prior Lake area residents commuting for business, shopping,
pleasure, and other daily activities. There is a traffic semaphore
located at intersection. Other businesses in the James First
Addition plat include; PDQ Convenience Store with gas, two multi-
use ship centers, a multi -use office building, bank and a liquor
store. All businesses currently located here have a stable history
and require support from the same clientele as the proposed self -
service car wash facility.
D. Competitive businesses to proposed car wash facility are two
existing facilities. Both operations are exclusively self - service
wand type operations which have been in operation for numerous years.
Overall appearance and operation have a number of undesireable
characteristics. Feasibility of their facilities operating profitably
in Prior Lake is good, however existing operations will see a signifi-
cant decline in income unless major renovation is undertaken. Services
and equipment available to customers is antiquated, outdated and limited
in both locations. Competitive businesses in current operation are
considered an asset for proposed facility due to creation and existence
of an established washing clientele and ability of new facility to offer
a significantly better facility and service. There are no automatic
car washes in the Prior Lake area. Demographics indicate a strong need
for a state of the art unit as is proposed.

E. Future growth in greater Prior Lake area appears excellent.
Indications are that residential growth and commercial development
will increase steadily in the immediate future. Traffic patterns
necessitate further growth in the immediate intersection of Highway
13 south and County Road 42. Proposed car wash layout has allowances
for additional car wash bays and other associated businesses.
DESCRIPTION OF JAMES FIRST ADDITION, BLOCK 1, LOT 1
Location of proposed car wash on James First Addition Block 1,
Lot 1 is well suited. Site is elevated from front lots allowing
added visibility from both Highway 13 south and County Road 42.
Location of Dakota Liquor east of site allows added visibility due
to parking lot location of this business. All access to and from
proposed operation is via Commerce Avenue. Limited traffic on
Commerce Avenue eliminates any possible congestion associated
with normal business traffic.
DESCRIPTION OF PRO•IECT
A. Building
a. Construction
Primary construction material for walls of building to be split
face concrete block. Building to have modified truss, hip style
roof with a four foot overhang on eaves around circumference of
building. Facia to be constructed of redwood or cedar. Roof to
be shingled. All doors to be dark brown in color, aluminum clad
with foam core insulation.
b. Color
All exterior split face block to be sprayed with a medium tan
color paint. Eaves to be stained with a natural tint wood treat-
ment. Roof to be a dark brown color.
B. Landscaping
a. North /South Sides of Building
On both north and south sides of building dirt is to be bermed
against side of building and various shrubs and bushes to be in-
stalled and maintained.

A twenty foot wide by five foot high berm will be installed and
maintained along entire length of west property line. Berm to
be fully landscaped to include approved evergreens installed along
peak for purpose of shielding any light pollution, noise transfer
and direct visibility to adjoining properties.
c. Lighting
Exterior building lighting shall consist of underhang lighting
attached to building on all four sides. Additional pole lighting,
downward directed over each vacuum island. Additional boulevard
lighting to be provided per City of Prior Lake.
d. Traffic Flow
Design of site to accomodate smooth entrance and exit of facility
on peak business days. Entrance and holding area for car wash is
on east side of building and designed to hold a minimum of three
cars per bay off street, out of building parking. Exit is to north
of building and will allow unobstructed, safe exit onto Commerce
Avenue.
e. Equipment
Car wash facility is to be equipped with state of the art car wash
equipment. Primary facility is four coin operated self- service
bays and one self- service coin operated automatic car wash. Self -
service wand bays to have a full complement of services including
air operated door openers, in -floor heating, high pressure spray
wands, trigger safety guns, pre-soak vehicle sprayer, whitewall
cleaner, tire cleaner, foaming brushes, reverse osmosis final rinse
system, artificial and natural light system and automatic door
openers with auto close for exit. In -bay vacuum system and vehicle
blow- dryers for removing excess water prior to exiting facility.
Self- service automatic is coin operated with automatic entrance
and exit doors. Bay has in -floor heating for comfortable, safe
wash environment. Vehicle wash machine is currently the most
technologically advanced available in the U.S. Machine washes
vehicle, coaxes vehicle, does final spot -free reverse osmosis
rinse, optically senses and located wheels, washes thee and finally
optically senses contour of vehicle as it dries entire surface.

Dce to Prior Lakes sanitary waste disposal problems this facility
will be equipped and operated with a 100% water reclamation system.
With the exception of toilet, there will be zero discharge into
sanitary sewer from facility. The revolutionary design engineered
for this facility will be one of only three in the U.S. at projected
business opening date.
f. Operating Guidelines
Scheduled hours of operation for car wash are 7:00 a.m. - 10:00 p.m.
year round. Attendant will be on duty to open facility, during
busy after work hours, closing and on week -ends. Inside of building,
exterior parking lot and grounds to be picked up on a daily basis.
COMMUNITY IMPACT
Impact to Prior Lake is one of offering the most efficiently designed,
state of the art wash facility in the U.S. All design and planning
has been directed at providing a first -class service for customers,
a positive addition to the business community and a well needed model
for current similiar businesses. Most importantly, this business
is designed to meet the needs and concerns of area residents today
and for years to come.
SAS DEVELOPMENT /PERSONNAL DATA
SAS Development is comprised of three individuals incorporated for
the sole purpose of designing, constructing and operating self- service
car wash facilities in our seven county metropolitan area. Two of
the partners are Prior Lake residents with new families who plan
on making this area their residence for years to come. This facility
will be managed directly by them and can assure the first class oper-
ation which Prior Lake deserves. Their location to business is 1.5
and 3.0 miles respectively. Both individuals are currently employed
by the largest car wash design, manufacturing and supply company
in the U.S.

This proposal has been designed to assist the residents of Prior
Lake to better understand the business suggested. All factors
from location, design, equipment and impact on local residents
have been considered. We feel the project proposed will be a
positive addition to all of Prior Lake and surrounding areas.

we will realize these goals for all of us. We look for your input
