Present were Mayor Andren, Councilnembers Fitzgerald, Larson, Scott, white, City Manager Dave Omnscht, City Engineer Anderson, City Planner Grazer, Assistant City Manager /Ek,c mic Developrent Director Schmudlach, Finance Director Tescbner and City Attorney Bremner. Mayor Andres called the meeting to order and asked everyone to rise for the pledge of allegiance. The minutes of the March 7, 1988 meeting were reviewed by Council. The next order of business was discussion of Consent Agenda Item (b) - Liona Club Request for Pull -Tab Gambling at T.J. Hooligans, Councilmamber White stated that after a discussion with Roger France of the Charitable (ambling Board he learned there had been sore changes in the laws with regard to the terms of a lease between the organizations conducting the pull -tab operations and the establishment in which the pull -tab operation is being conducted. Bob Bailey, a representative for the Prior Lake Lions Club, addressed the Council and advised them of the deletions and charges in the lease terms between The Lions Club and T. J. Hooligans. Mother change discussed was the implementation of an ordinance giving the City the authority to collect 3% from the proceeds of organizations conducting gambling within the City of Prior Lake. Discussion followed regarding an amendment of the City of Prior Lake Gambling Ordinance and other issues pertaining to this subject. The next order of business was review of the first draft of the Prior Lake Assesanent Policy 88-03. City Manager Ur acht briefly discussed the process used by the Assessment Policy Committee to draft this Policy. Finance Director Wachner and City Manager Unvacht then reviewed the Policy page by pace to allow the Councilm a hers to make eom ants, suggestions or asendmen ts. Extenatve discussion followed. Council directed Staff to bring the Policy back for further consideration after the City Attorney and Policy Ozmdttee have reviewed and revised the sections questioned by Council. A abort recess was called. The meeting was reconvened at 9:06 p.m. The next order of business was a Public Bearing on the Tax Increment Financing District Plan 1 -2. Mayor Andren called the Public Hearing to order at 9:07 p.m. and read the legal notice as it appeared in the Prior Lake American on March 7 and 14, 1988. City Manager Unmacbt summarized the Council alternatives, Staff recommendations and action required by the Council in considering this item, and he reviewed the action taken on February 1, 1988 by the Council. Ed Tschida, a Consultant from Professional Planning and Developoent Inc., representing the City of Prior Lake reviewed the TIP Plan for Council and answered questions pertaining to the site plane. Lengthy discussion followed. A contemporaneous public hearing for the purpose of considering the Walker Avenue Vacation was called to order at 9s40 p.m. Mayor Andren real the public hearing notice as it appeared in the Prior Lake American on Parch 7 and March 14, 1988. City Manager Lsmacht smamarized CITY OF PRIOR LAKE PLANNING COMMISSION MINUTES MARCH 17, 1988 The March 17, 1988, Prior Lake Planning Crnunission meeting was called to order at 7:32 P.M. by Chairman Roseth. Present were CAimiSaioners Arnold, Kedrwski, Loftus, Wells, City Planner Graser, and Assistant City Planner Garross. ITEM I - REVIEW MIR= OF PREVIOUS MEETING NOTION BY REDRLNSRI, SEORAIEO BY WELLS, TO APPROVE THE FEBRUARY 18, 1988, PRIOR LAID: PLANNING OOMKISSION MINUTES AS PRESENTED. Upon a vote taken, ayes by Arnold, Kedrwski, Loftus, Roseth, Wells; the motion passed unanimously. At this time the Camnissioners commended Staff on a well planned and infornative retreat. ITEM II VARIANCE RMNFST BY LBPpNaat BERGLUND Mr. Berglund consented on the request for 1900 square foot lot size variance for 15521 Mitchell Circle BE with regard to increased taxes and assessments against Lot 19 Condom's Wood Dale. Mr. Berglund is willing to work with staff to resolve the problem of buildability. City Planner Graser comoented per memo dated March 17, 1988. The Planning O mmissioners had concern over the severe variance request fron the zoning Ordinance. Informal discussion followed with the Commissioners. Assistant City Planner Garross commented per memo dated March 17, 1988. The Planning Caimissionner discussed the request. The School District wishes to place a public service information sign on the south side of the High School to promote school activities and events. In order to erect the sign, a variance, conditional use permit and sign permit must be obtained by the School District. MCKGROU D: The applicant contacted staff approximately two weeks ago with the proposal to place a public service information sign at the school. The proposal is to erect a 72 square foot illuminated sign with interchangeable copy, to be placed on the south wall of the High School. See attached area nap for further detail. The School has requested that this item be considered in as timely a manner as possible. In order to facilitate the process, the School District submitted complete applications and paid all fees due. It is their desire to have the sign in place in order to advertise the spring play. In an attempt to accommodate znd work with the School District, this item will be presented to the Planning Cammission on March 17th then presented to the City Council March 21, 1988. The comments and recommendations from the Planning Commission will be presented to the City Council on March 21st. Staff has no problem with this process in light of our positive position regarding the applications. The specific sections of Prior Lake Sign Ordinance 83 -5 which pertain to this request are: Sections 5 -7 -1 Definitions, 5 -7 -2 (A) 7 and 9. The School wishes to erect a public service information sign which under Section 5 -7 -2, requires a conditional use permit. In addition, because the School is located within a C -1 Conservation District, variances are needed to allow a public service, illuminated sign in a district other than Business or Industrial. Approximately fifty residents within three hundred feet of the school boundaries have been notified of the request. Tb date, staff has received no commwnts from area residents regarding this proposal. ALTEYNATIVES: The alternatives are as follows: 1. Approve the applications as requested. 2. Deny one or both of the applications for specific reasons. 3. Table the items for further study or additional information. BEDDM ENORTION: The recommendation from staff is to approve the applications as presented. The intent of the ordinance regarding the aforementioned sections is to regulate signs in Business Districts. The proposed sign requested by the School is clearly a public service information sign even though it does not directly correspond to the definition of such sign as presented in the ordinance. Staff has no objection to the granting of variances to allow the sign. The variances observe the intent of the ordirwrce and would be in the public interest.
